Go1ernment to $e%!#re #n%ent mon,ment), et%., to -e o( n#ton#! m.ort#n%e.8 91: 'here the 3entra )overn!ent is of opinion that an( ancient !onu!ent or archaeoogica site and re!ains not incuded in section = is of nationa i!portance, it !a(, $( notification in the officia )a>ette, give t+o !onthsD notice of its intention to decare such ancient !onu!ent or archaeoogica site and re!ains to $e of nationa i!portanceA and a cop( of ever( such notification sha $e affi"ed in a conspicuous pace near the !onu!ent or site and re!ains, as the case !a( $e. 92: An( person interested in an( such ancient !onu!ent or archaeoogica site and re!ains !a(, +ithin t+o !onths after the issue of the notification, o$%ect to the decaration of the !onu!ent, or the archaeoogica site and re!ains, to $e of nationa i!portance. 9=: On the e"pir( of the said period of t+o !onths, the 3entra )overn!ent !a( after considering the o$%ections, if an(, received $( it, decare $( notification in the Officia )a>ette, the ancient !onu!ent or the archaeoogica site and re!ains, as the case !a( $e, to $e of nationa i!portance. 94: A notification pu$ished under su$8section 9=: sha, uness and unti it is +ithdra+n, $e concusive evidence of the fact that the ancient !onu!ent or the archaeoogica site and re!ains to +hich it reates is of nationa i!portance for the purposes of this Act. PROTECTED MONUMENTS 5.A%2,)ton o( r3ht) n # .rote%te$ mon,ment.& 91: 4he Birector8)enera !a(, +ith the sanction of the 3entra )overn!ent, purchase, or ta#e a ease of, or accept a gift or $e?uest of, an( protected !onu!ent. 92: 'here a protected !onu!ent is +ithout an o+ner, the Birector8)enera !a(, $( notification in the Officia )a>ette, assu!e the guardianship of the !onu!ent. 9=: 4he o+ner of an( protected !onu!ent !a(, $( +ritten instru!ent, constitute the Birector8 )enera the guardian of the !onu!ent, and the Birector8)enera the guardian of the !onu!ent, and the Birector8)enera !a(, +ith the sanction of the 3entra )overn!ent, accept such guardianship. 94: 'hen the Birector8)enera has accepted the guardianship of a !onu!ent under su$8section 9=:, the o+ner sha, e"cept as e"press( provided in this Act, have the sa!e estate, right, tite and interest in and to the !onu!ent as if the Birector8)enera had not $een constituted a guardian thereof. 95: 'hen the Birector8)enera has accepted the guardianship of a !onu!ent under su$8section 9=:, the provisions of this Act reating to agree!ents e"ecuted under section 5 sha app( to the +ritten to agree!ents e"ecuted under the said su$8section. 95: Nothing in this section sha affect the use of an( protected !onu!ent for custo!ar( reigious o$servations. 4.Pre)er1#ton o( .rote%te$ mon,ment -5 #3reement.& 91: the 3oector, +hen so directed $( the 3entra )overn!ent, sha propose to the o+ner of a protected !onu!ent to enter into an agree!ent +ith the 3entra )overn!ent +ithin a specified period for the !aintenance of the !onu!ent. 92: An agree!ent under this section !a( provide for a or an( of the foo+ing !atters, na!e(&8 9a: the !aintenance of the !onu!ent& 9$: the custod( of the !onu!ent and the duties of an( person +ho !a( $e e!po(ed to +atch itA 9c: the restriction of the o+nerDs right8 9i: to use the !onu!ent for an( purpose, 9ii: to charge an( fee for entr( into, or inspection of, the !onu!ent, 9iii: to destro(, re!ove, ater or deface the !onu!ent, or 9iv: to $uid on or near the site of the !onu!entA 9d: the faciitates of access to $e per!itted to the pu$ic or an( section thereof or to archaeoogica officers or to persons deputed $( the o+ner or an( archaeoogica officer or the 3oector to inspect or !aintain the !onu!entA 9e: the notice to $e given to the 3entra )overn!ent in case the and on +hich the !onu!ent is situated or an( ad%oining and is offered for sae $( the o+ner, and the right to $e reserved to the 3entra )overn!ent to purchase such and, or an( specified portion of such and, at its !ar#et vaueA 9f: the pa(!ent of an( e"penses incurred $( the o+ner or $( the 3entra )overn!ent in connection +ith the !aintenance of the !onu!entA 9g: the proprietar( or other rights +hich are to vest in the 3entra )overn!ent in respect of the !onu!ent +hen an( e"penses are incurred $( the 3entra )overn!ent in connection +ith the !aintenance of the !onu!entA 9h: the appoint!ent of an authorit( to decide an( dispute arising out of the agree!entA and 9i: an( !atter connected +ith the !aintenance of the !onu!ent +hich is a proper su$%ect of agree!ent $et+een the o+ner and the 3entra )overn!ent. 9=: 4he 3entra )overn!ent or the o+ner !a(, at an( ti!e after the e"piration of three (ears fro! the date of e"ecution of an agree!ent under this section, ter!inate it on giving si" !onthsD notice in +riting to the other part(& /rovided that +here the agree!ent is ter!inated $( the o+ner, he sha pa( to the 3entra )overn!ent the e"penses, if an(, incurred $( it on the !aintenance of the !onu!ent during the five (ears i!!ediate( preceding the ter!ination of the agree!ent or, if the agree!ent has $een in force for a shorter period, during the period the agree!ent +as in force. 94: An agree!ent under this section sha $e $inding on an( person cai!ing to $e the o+ner of the !onu!ent to +hich it reates, fro!, through or under a part( $( +ho! or on +hose $ehaf the agree!ent +as e"ecuted. 6.O0ner) ,n$er $)#-!t5 or not n .o))e))on.& 91: *f the o+ner of a protected !onu!ent is una$e, $( reason of infanc( or other disa$iit(, to act for hi!sef, the person ega( co!petent to act on his $ehaf !a( e"ercise the po+ers conferred upon an o+ner $( section 5. 92: *n the case of viage propert(, the head!an other viage8officer e"ercising po+ers of !anage!ent over such propert( !a( e"ercise the po+ers conferred upon an o+ner $( section 5. 9=: Nothing in this section sha $e dee!ed to e!po+er an( person not $eing of the sa!e reigion as the person on +hose $ehaf he is acting to !a#e or e"ecute an agree!ent reating to a protected !onu!ent +hich or an( part of +hich is periodica( used for the reigious +orship or o$servances of that reigion. 8.A..!%#ton o( en$o0ment to re.#r # .rote%te$ mon,ment.& 91: *f an( o+ner or other person co!petent to enter into an agree!ent under section 5 for the !aintenance of a protected !onu!ent refuses or fais to enter into such an agree!ent, and if an( endo+!ent has $een created for the purpose of #eeping such !onu!ent in repair or for that purpose a!ong other, the 3entra )overn!ent !a( institute a suit in the court of the district %udge, or, if the esti!ated cost of repairing the !onu!ent does not e"ceed one thousand rupees, !a( !a#e an appication to the district %udge, for the proper appication of such endo+!ent or part thereof. 92: On the hearing of an appication under su$8section 91:, the district %udge !a( su!!on and e"a!ine the o+ner and an( person +hose evidence appears to hi! necessar( and !a( pass an order for the proper appication of the endo+!ent or of an( part thereof, and an( such order !a( $e e"ecuted as if it +ere a decree of a civi court. 9.*#!,re or re(,)#! to enter nto #n #3reement.& 91: *f an( o+ner or other person co!petent to enter into an agree!ent under section 5 for the !aintenance of a protected !onu!ent refuses or fais to enter into such an agree!ent, the 3entra )overn!ent !a( !a#e an order providing for a or an( of the !atters specified in su$8section 92: of section 5 and such order sha $e $inding on the o+ner or such other person and on ever( person cai!ing tite to the !onu!ent fro!, through or under, the o+ner or such other person. 92: 'here an order !ade under su$8section 91: provides that the !onu!ent sha $e !aintained $( the o+ner or other person co!petent to enter into an agree!ent a reasona$e e"penses for the !aintenance of the !onu!ent sha $e pa(a$e $( the 3entra )overn!ent. 9=: No order under su$8section 91: sha $e !ade uness the o+ner or other person has $een given an opportunit( of !a#ing a representation in +riting against the proposed order. 17.Po0er to m#8e or$er .roh-tn3 %ontr#1enton o( #3reement ,n$er )e%ton 4.& 91: *f the Birector8)enera apprehends that the o+ner or occupier of a protected !onu!ent intends to destro(, re!ove, ater, deface, i!peri or !isuse the !onu!ent or to $uid on or near the site thereof in contravention of the ter!s of an agree!ent under section 5, the Birector8)enera !a(, after giving the o+ner or occupier an opportunit( of !a#ing a representation in +riting, !a#e an order prohi$iting an( such contravention of the agree!ent& /rovided that no such opportunit( !a( $e given in an( case +here the Birector8)enera, for reasons to $e recorded, is satisfied that it is not e"pedient or practica$e to do so. 92: An( person aggrieved $( an order under this section !a( appea to the 3entra )overn!ent +ithin such ti!e and in such !anner as !a( $e prescri$ed and the decision of the 3entra )overn!ent sha $e fina. 11.En(or%ement o( #3reement).& 91: *f an o+ner or other person +ho is $ound $( an agree!ent for the !aintenance of a !onu!ent under section 5 refuses or fais +ithin such reasona$e ti!e as the Birector8)enera !a( fi", to do an( act +hich in the opinion of the Birector8)enera is necessar( for the !aintenance of the !onu!ent, the Birector8)enera !a( authorise an( person to do an( such act, and the o+ner or other person sha $e ia$e to pa( the e"penses of doing an( such act or such portion of the e"penses as the o+ner !a( $e ia$e to pa( under the agree!ent. 92: *f an( dispute arises regarding the a!ount of e"penses pa(a$e $( the o+ner or other person under su$8section 91:, it sha $e referred to the 3entra )overn!ent +hose decision sha $e fina. 1'.P,r%h#)er) #t %ert#n )#!e) #n$ .er)on) %!#mn3 thro,3h o0ner -o,n$ -5 n)tr,ment e"e%,te$ -5 o0ner.8 2ver( person +ho purchases, at a sae for arrears of and revenue or an( other pu$ic de!and, an( and on +hich is situated a !onu!ent in respect of +hich an( instru!ent has $een e"ecuted $( the o+ner for the ti!e $eing under section 5 or section 5, and ever( person cai!ing an( tite to a !onu!ent fro!, through or under, an o+ner +ho e"ecuted an( such instru!ent, sha $e $ound $( such instru!ent. 1+.A%2,)ton o( .rote%te$ mon,ment).8 *f the 3entra )overn!ent apprehends that a protected !onu!ent is in anger of $eing destro(ed, insured, !isused, or ao+ed to fa into deca(, it !a( ac?uire the protected !onu!ent under the provisions of the Eand Ac?uisition Act, 1894 91 of 1894:, as if the !aintenance of the protected !onu!ent +ere a pu$ic purpose +ithin the !eaning of that Act. 1/.M#nten#n%e o( %ert#n .rote%te$ mon,ment).8 91: 4he 3entra )overn!ent sha !aintain ever( !onu!ent +hich has $een ac?uired under section 1= or in respect of +hich an( of the rights !entioned in section 5 have $een ac?uired. 92: 'hen the Birector8)enera has assu!ed the guardianship of a !onu!ent under section 5, he sha, for the purpose, of !aintaining such !onu!ent, have access to the !onu!ent at a reasona$e ti!es, $( hi!sef and $( his agents, su$ordinates and +or#!en, for the purpose of inspecting the !onu!ent and for the purpose of $ringing such !aterias and doing such acts as he !a( consider necessar( or desira$e for the !aintenance thereof. 15.9o!,nt#r5 %ontr-,ton).8 4he Birector8)enera !a( receive vountar( contri$utions to+ards the cost of !aintaining a protected !onu!ent and !a( give orders as to the !anage!ent and appication of an( funds so received $( hi!A /rovided that no contri$ution received under this section sha $e appied to an( purpose other than the purpose for +hich it +as contri$uted. 14.Prote%ton o( .!#%e o( 0or)h. (rom m),)e, .o!!,ton or $e)e%r#ton.& 91: A protected !onu!ent !aintain $( the 3entra )overn!ent under this Act +hich is a pace of +orship or shrine sha not $e used for an( purpose inconsistent +ith its character. 92: 'here the 3entra )overn!ent has ac?uired a protected !onu!ent under section 1=, or +here the Birector8)enera has purchased, or ta#en a ease or accepted a gift or $e?uest or assu!ed guardianship of, a protected !onu!ent under section 5, and such !onu!ent or an( part the derives used for reigious +orship or o$servances $( an( co!!unit(, the 3oector ha !a#e due provisions for the protection of such !onu!ent or part thereof, fro! poution or desecration8 9a: $( prohi$iting the entr( therein, e"cept in accordance +ith the conditions prescri$ed +ith the concurrence of the persons, if an(, in reigious charge of the said !onu!ent or part thereof, of an( person not entited so to enter $( the reigious usages of the co!!unit( $( +hich the !onu!ent or part thereof is used, or 9$: $( ta#ing such other action as he !a( thin# necessar( in this $ehaf. 16.Re!n2,)hment o( Go1ernment r3ht) n # mon,ment.8 'ith the sanction of the 3entra )overn!ent, the Birector8)enera !a(,8 9a: +here rights have $een ac?uired $( the Birector8)enera in respect of an( !onu!ent under this Act $( virtue of an( sae, ease, gift or +i, rein?uish, $( notification in the Officia )a>ette, the rights so ac?uired to the person +ho +oud for the ti!e $eing $e the o+ner of the !onu!ent if such rights had not $een ac?uiredA or 9$: rein?uish an( guardianship of a !onu!ent +hich he has assu!ed under this Act. 18.R3ht o( #%%e)) to .rote%te$ mon,ment).8 .u$%ect to an( rues !ade under this Act, the pu$ic sha have a right of access to an( protected !onu!ent. PROTECTED AREAS 19.Re)tr%ton) on en:o5ment o( .ro.ert5 r3ht) n .rote%te$ #re#).8 91: No person, incuding the o+ner or occupier of a protected area, sha construct an( $uiding +ithin the protected area or carr( on an( !ining ?uarr(ing, e"cavating, $asting or an( operation of a i#e nature in such area, or utiise such area or an( part thereof in an( other !anner +ithout the per!ission of the 3entra )overn!ent& /rovided that nothing in this su$8section sha $e dee!ed to prohi$it the use of an( such area or part thereof for purposes of cutivation if such cutivation does not invove the digging of not !ore than one foot of soi fro! the surface. 92: 4he 3entra )overn!ent !a(, $( order, direct that an( $uiding constructed $( an( person +ithin a protected area in contravention of the provisions of su$8section 91: sha $e re!oved +ithin a specified period and, if the person refuses or fais to co!p( +ith the order, the 3oector !a( cause the $uiding to $e re!oved and the person sha $e ia$e to pa( the cost of such re!ova. '7.Po0er to #%2,re .rote%te$ #re#.8 *f the 3entra )overn!ent is of opinion that an( protected area contains an ancient !onu!ent or anti?uities of nationa interest and vaue, it !a( ac?uire such area under the provisions of the Eand Ac?uisition Act, 1894 91 of 1894:, as if the ac?uisition +ere for a pu$ic purpose +ithin the !eaning of that Act. ARCHAEOLOGICAL E;CA9ATIONS '1.E"%#1#ton) n .rote%te$ #re#).8 An archaeoogica officer or an officer authorised $( hi! in this $ehaf or an( person hoding a icence granted in this $ehaf under this Act 9hereinafter referred to as the icensee: !a(, after giving notice in +riting to the 3oector and the o+ner, enter upon and !a#e e"cavations in an( protected area. ''.E"%#1#ton) n #re#) other th#n .rote%te$ #re#).8 'here an archaeoogica officer has reason to $eieve that an( area not $eing a protected area contains ruins or reies of historica or archaeoogica i!portance, he or an officer authorised $( hi! in this $ehaf !a(, after giving notice in +riting to the 3oector and the o+ner, enter upon and !a#e e"cavations in the area. '+.Com.,!)or5 .,r%h#)e o( #nt2,te), et%., $)%o1ere$ $,rn3 e"%#1#ton o.er#ton).& 91: 'here, as a resut of an( e"cavations !ade in an( area under section 21 or section 22, an( anti?uities are discovered, the archaeoogica officer or the icensee, as the case !a( $e, sha,8 9a: as soon as practica$e, e"a!ine such anti?uities and su$!it a report to the 3entra )overn!ent in such !anner and containing such particuars as !a( $e prescri$edA 9$: at the concusion of the e"cavation operations, give notice in +riting to the o+ner of the and fro! +hich such anti?uities have $een discovered, of the nature of such anti?uities. 92: 1nti an orders for the co!pusor( purchase of an( such anti?uities is !ade under su$8section 9=:, the archaeoogica officer or the icensee, as the case !a( $e, sha #eep the! in such safe custod( as he !a( dee! fit. 9=: On receipt of a report under su$8section 91:, the 3entra )overn!ent !a( !a#e an order for the co!pusor( purchase of an( such anti?uities at their !ar#et vaue. 94: 'hen an order for the co!pusor( purchase of an( anti?uities is !ade under su$8section 9=:, such anti?uities sha rest in the 3entra )overn!ent +ith effect fro! the date of the order. '/.E"%#1#ton), et%., (or #r%h#eo!o3%#! .,r.o)e).8 No .tate )overn!ent sha underta#e or authorise an( person to underta#e an( e"cavation or other i#e operation for archaeoogica purposes in an( area +hich is not a protected area e"cept +ith the previous approva of the 3entra )overn!ent and in accordance +ith such rues or directions, if an(, as the 3entra )overn!ent !a( !a#e or give in this $ehaf. PROTECTION O* ANTI<UITIES '5.Po0er o( Centr#!
