So you stop at the local pub for some
wings and a beer or two afer work. Ten
you get pulled over at a roadside police
checkstop while driving home. You blow
into an approved screening device (a
hand-held breath test machine). Now
what?
If, triggered by a blood alcohol level of
0.05 or 0.08, you blow warn or fail, your
drivers licence will be suspended on the
spot for a number of days. Tere are other
nasty consequences, and the costs and
penalties mount if its not your frst time.
Tis is BCs automatic or immediate
roadside prohibition law. Advocates
supporting the law say it helps prevent
injuries and death caused by drunk driving.
Critics say it ensnares too many innocent
people who really arent impaired.
One issue is whether a warn reading
by itself is enough for an automatic
prohibition. Or must the police have
other reasons for thinking your ability was
impaired before taking away your licence?
If they dont, and they remove your licence
anyway, can you win if you fght the
prohibition?
An important BC Court of Appeal
decision considered this question in May.
Te driver in this case blew warn. Te
review ofcial said that was enough for the
police ofcer to conclude the drivers ability
was afected by alcohol and to stop him
from driving. Te trial court said no, the
police need more evidence of impairment
(like erratic driving), and it tossed out the
prohibition.
But the Court of Appeal decided
diferently. It looked at the broader
purpose of the law and said the provincial
ofcial had interpreted the law reasonably.
Te court fagged scientifc evidence
showing that at the 0.05 to 0.08 blood
alcohol level, ones driving ability starts
to get signifcantly impaired and theres a
higher risk of getting in an accident. It also
pointed out that its very hard to nab drunk
drivers only by a lucky police observation
of impaired driving. Chances are such
drivers have been a risk to others many
times before. A person may have averaged
over 40,000 km of impaired driving before
being caught.
Tis favours random police roadblocks
to test for impairment, said the court. It
also favours standard rules like the laws
blow warn or fail and youre of the
road for curbing unacceptable driving
behaviour. Ultimately, societys interest
and the laws purpose is to get risk-prone
impaired drivers of the road promptly and
discourage people tempted to drive under
the infuence from driving. Tis trumps
an individuals privilege of driving.
Tis case is now headed for another
possible appeal to the Supreme Court of
Canada. Well have to wait and see whether
you can fght a driving prohibition for a
warn alone.
Of course, there are other ways to
challenge a roadside suspension. For
example, you may not have been told of
your right to blow a second time into a
diferent police roadside screener. Or if
you ask for an initial review, the police
report might be defective. So if youve
recently been slapped with an automatic
roadside driving prohibition, contact your
lawyer immediately the time window
for protecting your rights is short, but
it may be possible to undo the drastic
consequences of a prohibition.

Be Safe on the Slocan River
Te Regional District of Central Kootenay (RDCK) and
the Slocan Riverwatch Society are urging recreational
users of the Slocan River to be safe this summer.
Please keep the following in mind when canoeing, kay-
aking, boating or foating on the river:
Always wear a personal fotation device (pfd) that fts
you properly
Do not drink alcohol and play on the river
Do not stand up in moving water your feet can get
stuck or lodged between rocks or other objects on
the bottom of the river and as the water keeps mov-
ing it can push you and hold you down. Tis is called
foot entrapment and is very dangerous. Float with
your feet high in the water
Respect log jams, fallen trees and wood pilings. Tey
are called strainers the water goes through strain-
ers but people dont. Wood in the river is very dan-
gerous and must be avoided
Use a sturdy and dependable craf.
Know where to put in and take out, and be prepared
for the length of your trip
Slocan Riverwatch has posted signs at certain access
points along the river. Please refer to this signage for gen-
eral safety instructions, access and pull out points and to
indicate where hazardous log jams and wood pilings exist
on the river. If youre in doubt about whether or not you
can go on the river safely, then it is best to be cautious and
stay of the water. Have a safe summer!

Selkirk College Summer Camps for
Kids Open Up New Worlds
Elizabeth Cunningham will take kids on a journey of
imagination this August. Cunningham is ofering two
summer camps for children between August 18 and 22.
Both Nature & the Arts for kids aged fve to eight and
Razzmatazz Circus Arts for kids nine to 12, ofer exciting
opportunities for children who love to create.
Using a well-received model that she applied to 22 years
of summer camps in Eden Mills, Cunningham will focus
the Nature & the Arts camp on a story. Based on First
Nations legend, the story How Summer Came to Canada
will act as the theme for the camp. Cunningham will ex-
plore the myth through activities that include storytelling,
drawing, painting, kite making, music and sculpture.
For the Razzmatazz Circus Arts camp, the older chil-
dren will get a chance to immerse themselves in circus
life and bring it alive through music, dance, mask making,
giant puppets, clay and photography. Working with a pro-
fessional circus artist, the kids will get to learn a variety of
circus skills like making juggling balls and fower sticks,
and clown character creation.
Cunningham says partnering with Selkirk College to bring
kids programming alive this summer was a natural ft. Te
camps will take a maximum of 15 children in each fve-
day adventure. Nature & the Arts will take place between
9 am and 12 pm. Razzmatazz Circus Arts is scheduled to
run from 1 pm to 4 pm. Both camps take place at Nelsons

July MarketFest Is Almost Here!
MarketFest is once again back on Nelsons Baker Street
this July 25 starting at 6 pm and going until 10:30 pm. Tis
is a rain or shine event, but with some luck the weather
will be beautiful, the sun will shine, and the music will
soar. Tis MarketFest musical line-up is power packed
with luminaries such as Adham Shaikh, Cam Penner, Ms.
Erica Dee, Rhoneil and more.
EcoSocietys Markets Director Jesse R. Woodward is
once again working with vendors, business owners, and
city agencies to ensure that July MarketFest is a great suc-
cess. MarketFest attendees will, as always, have a fantastic
variety of products to choose from, including handmade
hats and clothes, locally made pottery and jewellery, and
an array of body care products and, of course, lots of dif-
ferent and delicious ready-to-eat foods.
MarketFest will once again have a food court area on
Kootenay Street that makes it very easy for festival goers
to fnd and choose from the wide selection of ready to
eat foods that will be on hand. What better way to spend
a warm summer evening than eating scrumptious fresh
foods, shopping for locally made goods and listening to
wonderful live music.
West Kootenay EcoSociety is a non-proft organization

Pick fruit when ripe, and clean up windfall within 3 days

Summer Events Announcement
Summer is here and Friends of Kootenay Lake are plan-
ning the following fun free events around the lake:
Western Toad Monitoring workshop in Harrop. Am-
phibian expert Jakob Dulisse will train citizens how to
monitor for western toads. Afer the workshop we will be
looking for volunteers to conduct regular toad monitor-
ing at the Harrop wetlands from June-September for the
next couple of years. Tuesday, July 22, 1 pm to 3 pm with
16 spots available (8 spaces will be reserved for residents
of Harrop and Procter). Free event but registration re-
quired, email info@friendsofootenaylake.ca to register.
Harrop Wetlands Restoration Project Update. Tursday,
July 24, 7 pm to 8 pm, Harrop Hall. Everyone welcome!
Wildlife Tree Mapping workshops will teach attendees
how to identify important wildlife trees, and record their
locations using GPS and GIS technology. Wildlife trees
are integral to maintaining a healthy ecosystem. Over 70
species of vertebrates depend upon wildlife trees. Osprey
and eagles perch on the snags, many birds build nests in
their branches, and amphibians use them for shade and
shelter. Mapping and recording important wildlife trees
allows for these trees to be protected, in turn protecting
vital wildlife habitat. Workshops are located as follows:
Monday, July 28, Argenta Community Hall, 7 pm to 9
pm; Tuesday, July 29, Langham Teatre, Kaslo, 7 pm to 9
pm; Tursday, July 31, Nelson Rod and Gun Club, 7 pm
to 9 pm; Saturday, August 2, Gray Creek Hall, 2:30 pm to

Te Secret Garden a Musical
Nelsons brilliant young theatre talent is again lighting
up the Capitol Teatre stage at the end of July. Tis years
26th annual Summer Youth Program will see the produc-
tion of Te Secret Garden. Tis is the 50th Summer Youth
Teatre production the Capitol Teatre is producing since
its inception. Books and lyrics for Te Secret Garden are by
Marsha Norman, music by Lucy Simon. Te play is based
on the novel by Frances Hodgson Burnett. Tis years pro-
gram is directed by Geof Burns, with music directed by
Allison Girvan and choreographed by Lynette Lightfoot.
Adriana Bogaard, an alumna of the Capitols Summer
Teatre Program herself, is thrilled to be back home to de-
sign the set for this group of talented youngsters. Current-
ly a design student at the National Teatre School of Can-
ada, Adrianas past work in Nelson includes the design for
Jesus Christ Superstar and directing Alphonse for Nelson
History Teatre in 2012. Adrianas Assistant Set Designer
is Gillian Nasser. Halifax born and Montreal based, Gil-
lian is a new designer currently studying at the National
Teatre School of Canada. She has always loved making
and dreaming things up and is really excited to be involved
with Capitols Summer Teatre Program this year.
Te Secret Garden premiered on Broadway in 1991 and
ran for 709 performances! Te story is set in the early
years of the 20th century. Mary Lennox, a young Eng-
lish girl born and raised in the British Raj, is orphaned
by a cholera outbreak when she is eleven years old. She is
sent away from India to Yorkshire, England, to live with
relatives whom she has never met. Her own personality
blossoms as she and a young gardener bring new life to a
neglected garden, as well as to her sickly cousin and uncle.
Performances are schedule for Tursday, July 24, Friday,
July 25 and Saturday, July 26 at 7:30 pm and Saturday, July
26 at 2 pm. Tickets are $15 Adult, $10 Student and $45

Selkirk instructors Dave Stryck
and Dave Buller, the Capitol Te-
atre now has cabinets crafed by a
class of students who have since
graduated and embarked on new
challenges with their Selkirk
education.
Te Selkirk College students
donated their time to the pro-
ject, allowing the cost of the
cabinet portion of the project
to be shaved considerably. Te
front doors were custom built
by David Ringheim Custom
Woodworks, a Selkirk College
alumnus.
