ORDER No. 5
RESTRICTIONS ON TRANSFER OF REAL PROPERTY
OWNED BY THE CITY OF DETROIT
By THE AUTHORITY VESTED IN THE EMERGENCY MANAGER
FOR TI-IE CITY OF DETROIT
PURSUANT TO MICHIGAN'S PUBLIC ACT 436 OF 2012,
KEVYN D. ORR, THE EMERGENCY MANAGER,
ISSUES TI-IE FOLLOWING ORDER:
Whereas, on April 11,2013, the Emergency Manager signed Emergency Manager Order
No.3; and
Pursuant to Emergency Manager Order No.3, any orders, ordinances, resolutions,
appointments, approvals, terminations, appropriations, contracts, permits or other related actions of
the Detroit Mayor and City Council from and after March 28,2013, shall be submitted to the
Emergency Manager for consideration, but will not be valid or effective unless and until approved by
the Emergency Manager or his designee in writing; and
Consistent with Emergency Manager Order No.3 and without limiting the terms thereof,
interests in real property belonging to, owned by andlor in the possession ofthe City of Detroit,
including, but not limited to any parcel, land, building, real estate, realty, immovable property or
other property rights and interests belonging to, owned by andlor in the possession of the City of
Detroit, may be transferred, sold, encumbered, conveyed, leased, licensed, assigned or otherwise
dispose of only after obtaining the express written approval of the Emergency Manager or his
designee.

It is hereby ordered that:
1. Any transfer, sale, encumbrance, conveyance, lease, license, assignment or other
disposition of any interest in real property belonging to, owned by andlor in the
possession of the City of Detroit, including, but not limited to any parcel, land, building,
real estate, realty, immovable property or other property rights and interests belonging to,
owned by andlor in the possession ofthe City of Detroit requires the approval in writing
of the Emergency Manager or his designee.
2. Any attempt to enter into or consummate a transaction covered by paragraph 1 of this
Order without prior written authorization of the Emergency Manager or his designee shall
be void and of no force of effect.
3. This Order is effective immediately upon the date of execution below.
4. This Order shall be distributed to the Mayor, City Council members and all department
heads.
5. The Emergency Manager may modify, rescind, or replace this Order at any time.
