The following sections identify questions and answers for clarifications in connection with the Bidders Questions
for clarifications regarding the RFP No. A6CV-90-K115. These are clarifications before the bid closing.


SECTION 2: COMMERCIAL CLARIFICATIONS

RFP Document and Section: Contract Part II (Commercial Terms) - Item 5.1 (Payment Terms).

Question Bidder :
We understand that invoices shall be payable thirty (30) calendar days after Contractor issues the
correspondent monthly invoice, based on approved progress payment certificate. Please confirm our
understanding.


Answer Fluor :
Within 15 calendar days, Contract shall submit payment application to Engineer/Company for pre-
approval.
After payment application is approved, Contractor shall submit an official invoice based on the approved
payment application and it will be paid within 30 calendar days.

We understand that the method of measurement of Item No. 5 Inspection and Testing shall be unit prices
instead of Lump Sum because it forms part of direct portion of work. Please confirm our understanding.

(Unit Prices and Method of Measurement) GMI Rev.05 Tab 1 (Civil) Row #4.

Question Bidder :
We understand that Row #4 shall state Direct Cost instead of Indirect Cost because it forms part of
direct portion of work. Please confirm our understanding.


Answer Fluor :
Its typo and should be corrected to Direct Cost.

4 RFP Document and Section : Contract Part II (Commercial Terms) Item 1.8 (Surety Instruments).

Question Bidder :
In case Company requests additional bonds in connection with specific activities and events, we
understand that Company shall reimburse Contractor for the actual costs that such additional bonds may
require. Please confirm our understanding.


Answer Fluor :
10% CARTA FIANZA for Performance and Payment are the minimum requirements in the Contract.

If Contractor requests the release of 10% retention in monthly progress payment/invoice, retention CARTA
FIANZA will be required in return and associated cost shall be included in the Contract Price as part of the
Surety cost.

Same as advance payment, if its requested by Contractor, CARTA FIANZA for advance payment needs
to be approved by Engineer/Company prior to release the payment and the associated cost shall be
included in the Contract Price as part of the Surety cost.

5 RFP Document and Section : Contract Part II (Commercial Terms) Item 1.8.1 & 1.8.2.

Question Bidder :
Please consider reducing the amount of the Performance Bond to 5% of the Contract Price once the
Notice of Acceptance of the Work is issued.


Answer Fluor :
10% CARTA FIANZA for Performance and Payment are not negotiable.

Please provide Bidders with a copy of the All Risk Builders Risk Insurance or full details of the
conditions and deductibles of this coverage.


Answer Fluor :
Builder's All Risk Insurance deductible is at USD 500K per occurrence w/ no limit of the total
occurrences. Refer to the policy attached to this QABC (last four pages).

Question Bidder :
We understand Item 2 (Lump Sums for Direct Work) of the above referenced Proposal Form is a typo
because the contractual arrangement for all direct work is unit price. Please confirm our understanding.


Answer Fluor :
Correct. Should be corrected and consistent with Part II Commercial Terms.
Refer to Part II Commercial Terms, all direct work is on Unit Price (UP) basis, unless otherwise specified.
Only indirects (Site Establishment) are on Lump Sum (LS) basis.
