:

Scope of work for the proposed Multi Storied Housing Complex with basement belowthe
tower shall broadly comprise of the following:
Areas:
Floor Area in Super Structure is 365559.97 sq.ft.Floor Area in Basement is 25115.42 sq.ft.Area of
Raft is 30675.57 sq.ft.

The scope of work shal l compri se mai nl y of carryi ng out constructi on work f or
the proposed multi storied residential complex (Ground + 14 story maximum +
machineroom & roof top water tank) covering approx. 365559.97sq.ft. of Super structure
floor ar ea and appr ox. 25115. 42 s q. f t . of bas ement f l oor ar ea ( under t ower
onl y ) . TheContractor shall arrange all materials, labour & equipments as required for
successfulcompletion of the work.

Work shall be executed as per C.P.W.D. specification, Quality Plan, BOQ
TechnicalSpecification attached to BOQ and as per approved drawings and direction of
Engineer In-charge of Crossings Infrastructure Pvt. Ltd.The s i t e s hal l be handed over
t oM/s. ABC Developers Pvt. Ltd. with completeexcavation and laying of hard core surface.

The Contractor shall be completing the entire work of the proposed housing complex andhandover
the complete apartments as per the following broad specification:-
1 Structure:
Earthquake resistant structure duly vetted.
1 External Finish:Most Modern & Elegant finish with texture paint.
2 Internal Finish: All internal walls shall be plastered & painted in off whiteshade with oil
bound distemper & ceilings in white. Plaster of Paris punning &Cornices is to be done in
Drawing/Dining room and Bedrooms.
3 Flooring: Drawing/Dining/Kitchen to have vitrified Tiles. Bedrooms to havewooden
laminated flooring. Ceramic Tiles Flooring in toilets and balconies.
4 Doors/Windows: All external doors and windows are to be of UPVC/aluminiumglazing. All
Internal and main entrance door frames in mirandi wood with SkinMoulded main door and
all internal with Flush door shutters duly Painted.
5 Hardware: Al l shutter hi nges i n steel . Al l i nternal and mai n entrance door frames
with aluminium powder coated fittings with mortice lock in bedrooms. All external doors and
windows with aluminium fittings.
6 Kitchen: Granite working platform with 2 ft. high glazed ceramic tiles above itwith stainless steel
sink. Independent RO system.
7 Electrical: Al l copper wi ri ng i n P. V. C. conceal ed condui t. Provi si on for adequate light
and power points as well as telephone & TV outlets with Modular Switches and protective M.C.Bs.
8 Water Supply: Under gr ound and over head wat er t anks wi t h pumps
f or uninterrupted supply of water.
9 Toilets:Provision for Hot & Cold water system without Geyser. Glazed tiles in pl easi ng col ours
on wal l s up to door l evel . European W. C s, washbasi ns &cisterns in white shade of
Standard make. Chrome plated fittings of standardmake.
10 Water Proofing: Waterproofing of basements, all Terraces and toilet areas. Toilets and
Kitchen Sink areas to have false ceiling.
11 Services: Provision of 2 nos. lift/tower with complete machine room. ii) AllPlumbing,
Sanitary and Electrical works as per specification inside the buildingand connect i on up
t o t he Mai n Feeder / Ri ng Mai n. i i i ) St or m Wat er and Sewerage line to be
connected to main feeder near the tower. iv) Fire fightingsystem i nsi de the bui l di ng
wi th provi si on of f i re hydrant i n each f l oor for al l towers but no sprinkler system.
TYPE OF CONTRACT:
Item Rate Contract: Also called a schedule contract, in this contract, the contractor undertakes the
execution of work on an item rate basis. The amount to be received by thecontractor depends upon
the quantities of various items of work actually executed. The
Payment of the contractor is made on the basis of detailed measurements of differentitems of work
actually done by him.

Suitability : The item rate contract is most commonly used for all types of engineeringworks financed
by public or government bodies. This type of contract is suitable for works which can be split in to
various items and quantities under each item can beestimated with accuracy.
In this type contract, there is no need for detailed drawings at the time of allottingcontract as in
the case of lump sum contract. The detailed drawings can be preparedafter the contract is awarded.
Changes in drawings and quantities of individual items can be made as per requirement within
agreed limits.
The payment to the contractor is made on the actual work done by him at theagreed rates.

TIME SCHEDULE:
The time allowed for execution of the work indicated at scope of work shall bethe essence
of the contract.

The work shall be carried out and completed strictly as per the following time schedule: -

1. 1. 1 The acti vi ty wi se ti me schedul e shal l be i ndi cated i n Bar Chart to be
submi tted prior to issuance of Letter Of Award. The Contractor shall strictly adhere to thetime
schedule of all activities as mutually agreed.
1.1.2 Quantities given in the schedule (BOQ) are provisi onal. The quantity given in theBOQ
may vary up to any extent. The Contractor will have no claim on account of variation of quantities
and shall be liable to carry out the quantity under variationas per his item wise agreed rate. The
overall variation limit of the contract valueshall be 30%.
1.1.3 The rates for all items covered under the BOQ or any other items which may cropup
during the execution are for all leads, lifts and heights.
2 . 0 The rates as agreed between Crossings Infrastructure Pvt. Ltd.
And M/s.ABC Developers Pvt. Ltd. shal l remai n f i rm and val i d f or a peri od of 30months
beyond which the same shall be reviewed.
3 . 0 P A Y ME NT OF R UNNI NG A C C OUNT ( R A ) B I L L S :

wi t h s u p p o r t e d measurement sheets. 70% of the certified amount shall be paid within
10 daysand balance shall be paid within 20 days of the certification of bill. The minimumvalue of
interim Running Account Bills shall not be less then Rs. 25 lacs. 5%securi ty deposi t shal l
be deducted f rom each Runni ng Account Bi l l s. Thecumulative amount of Security Deposit
deducted from RA Bills shall not exceedRs. 100 lacs.

50% of securi ty deposi t so deducted shal l be rel eased wi thi n three months
of vi rtual compl eti on of the work whi ch woul d be certi f i ed by the Engi neer - i n-
Charge and the Architect. Balance 50% shall be released after completion of defect liability
period of 12 months.The Contractor shal l furni sh guarantee f or anti - termi te treatment
towardss at i s f act or y per f or mance f or a mi ni mum 10 y ear s f r om t he dat e of
f i nal completion of the works on an approved Performa.

4.0
ADVANCES
4.1 Types of advancesSubj ect to the condi ti ons provi ded herei n, the Contractor may
avai l of thefollowing advances for the execution of the Works:
a. Mobilization advance
b. Advance against materials at site.
4.2 Mobilisation Advance

4. 2. 1 For compl eti ng prel i mi nari es such as constructi on of si te off i ce, hi ri ng
of accommodation, labour hutments, arranging electricity and water supply
andmovement of staf f, l abour pl ant and machi nery, an advance speci fi ed i n
theContract Data and as required by the Contractor shall be payable against a
Bank Guarantee of a Scheduled Bank duly approved by the Company for an equivalentamount of
advance in a format acceptable to the Company.

4. 2. 2 Such adv ance s hal l be gi ven onl y af t er t he Cont r ac t or has s ubmi t t ed
t hePerformance Securi ty and executed the f ormal Contract and the Company
i srightly entitled to check that this Mobilization Advance is utilized for the the purpose
envisaged in the Contract
4.2.3 Recovery of Mobilisation Advance
:Recover y of mobi l i z at i on advanc e s hal l be made by deduct i on f r om
t hecontractors bills commencing after the first 10% (Ten percent) of the gross valueof wor k
dul y cer t i f i ed i s ex ecut ed and p ai d, on pr o- r at a per cent age bas i s calculated @
15% of the gross value of certified work billed beyond 10% of thecompleted work in such
a way that the entire advance is recovered by the time80% (eighty percent) of gross value of
contract is executed and paid.The Bank guarantee for the advance shall be initially for the full
amount and validfor a period of ________months beyond the period of defect liability .period,
and be kept renewed from time to time to cover the balance amount and likely periodof complete
recovery.

4.3 Advances against Material at Site
Advance on account of main non-perishable construction materials required
for incorporation in the permanent Works, shall be paid on request of the Contractor after these
materials are brought to site, against an Indemnity Bond duly executed.The Indemnity Bond will be
furnished in a Form acceptable and approved by theCompany. The advance s hal l be
l i mi t ed t o 75% of t he act ual v al ue of t he materials or the value as assessed by the
Project Manager and the total advance onaccount of construction materials at a time shall be
limited to 3% (three percent)of original Contract Value or likely average consumption of such
materials for three months whi chever i s l ess and at any ti me the total outstandi ng
advance against material at site shall not exceed four percent of the original contract value. The
valuation of the average consumption of such main construction materials
shall be approved by the Project Manager. For the purpose of valuation of theaforesaid
materials, all incidental charges such as packing, handling, freight,transportation, storage,
etc shall be excluded. The Contractor shall be bound tostore the materials at the site of
work earmarked for this purpose and shall not remove them from the site or use them for
any purposes other than execution of the Works. If any material is rendered surplus, the
Company shall not take over such materials, and the Contractor shall remove the same
from the site of work within 7 days from the date of completion of the Works.

4.4 Written Request for advance
Advance as admi s s i bl e under t he Cont r act , s hal l be pay abl e onl y af t er t he
Contractor makes a written request for the same to the Company. The amount payable
shall be the amount applied for by the Contractor, subject however to the conditions and limitations
given herein
5 . 0 D E F E C T L I A B I L I T Y P E R I O D :
Defect Liability Period of the Contract shall be 24 months from completion of the work
under different phases. The Contractor during the said Defect Liability peri od shal l be
responsi bl e to make good and remedy at hi s own expenses al l defects pointed out by
the Engineer-in-Charge.
6 . 0 E X T R A I T E M :
In case any item not covered in the BOQ is required to be carried out, the rate for the same shall be
derived from the nearest similar item available in the BOQ.However, in case no such similar item of
work exists in the BOQ, the rate for thesame shal l be deri ved as per market rate + 10%
profi t. Materi al and Labour component for such extra i tem shal l be as per norms
gi ven i n DAR. (Lat est revision)

7. 0 The WCT s hal l be bor ne by t he Cont r act or . The Cont r act or wi l l be
r equi r ed t oget himself registered with the sales tax department before commencing the work.As
per the existing law, under the relevant clauses for the Work Contract Tax, theContractor shall be
able to get the road permit and C form which shall be issued by the concerned authorities in
his name without any tax liability. You have tosubmit copy of registration in regard to service
tax.

8. 0 T. D. S . s hal l be appl i cabl e as per Gover ni ng r ul es of I ncome Tax Act . Al l
t axes will be applicable as per rules.

9 . 0 P R O G R E S S R E P O R T S A N D R E V I E W:
The Contractor shall submit monthly progress report by 7
th
of next month andshall attend fortnightly progress review meeting at site.

10. 0 The Contractor shal l depl oy one Proj ect Manager (BE i n Ci vi l Engg. wi th 12 -
15yrs. experi ence) and at l east 2 experi enced Engi neers (5-7 yrs. experi ence),
required Supervisors, Foreman etc. for execution of the work. You have to submit registration
copies in regard to E.S.I. & P.F. And also have to submit copies of contribution on this A/c
from time to time.

11. 0 The Cont r act or s hal l depl oy al l r es our ces ( L abour , machi ne,
equi pment s andmaterials etc.) to maintain the required rate of progress and of quality
to ensureworkmanship of the degree specified and to the satisfaction of the Engineer -in-
Charge/Project Manager of the Owner.

12. 0 The Cont r act or s hal l make al l ar r angement s f or El ec t r i ci t y and wat er
s uppl yrequired for the construction work at his own cost and shall also provide requiredD.G. Sets
1 3 . 0 I n s u r a n c e : The Contractor himself or through his Sub-contractor shall
obtainand maintain insurance as under for the complete period of work:a)Contractor All Risk
(CAR) Policy for cost of contract. b) Wor kmen Compens at i onc)Third Party & any other
statutory obligationd ) L a b o u r L i c e n s e
14.0 The Contractor shall, in respect of labour employed by him shall comply withthe
provision of labour legislation including latest requirement of all the Act, Law,
the payment of mi ni mum wages Act, ESI C, Empl oyees Provi dent Fund and al l
other statutory orders in relation to the execution of work. You have to submit
registrationcopies in regard to E.S.I. & P.F. And also have to submit copies of contribution
on thisA/c from time to time.
15.0 Quality Assurance and Quality Control:
The works shall conform to highstandard of design and workmanship. The
Owner/Architect shall be free to carry outtests as may be decided from time to time. Materials
not meeting the prescribed criteriashall be rejected and the same shall be removed from the
site immediately at the cost of the Contractor.
16.0 Safety: The Contractor shall throughout the execution and completion of work shal l arrange
and ensure al l saf ety measures as per the saf ety code of CPWD. The Contractor will
indemnify

from any consequencearising due to failure in respect of non compliance of safety code.
17.0 The Contractor shall take care and provide all safety measures to avoid anyaccident at
site. However, in case of any accident occurring at site, the Contractor shall be solely responsible to
take care of any eventuality arising out of any accident.
18.0 Al l i ndi vi dual s (staff and workers) at si te shal l wear saf ety hel mets
wi thchinstraps. Persons working at height shall be secured by safety belts and provision
of net at lower level.

19.0 Arbitration: All disputes of any kind whatever arising during the progress of work or after their
completion, shall be settled by the Arbitrator appointed by the Owner under the provision of
Arbitration and Conciliation Act, 1996 as amended from time totime including provisions
in force at the time the reference is made and their decisionshal l be f i nal wi thout any
appeal . The venue of Arbi trati on/j uri sdi cti on shal l be Ghaziabad only.

20.0 Duri ng progress of work i f any defects of whatsoever nature are f ound
byArchitect/engineers, the same shall have to be rectified within 3 days of intimation. If
any building material brought to the site, does not meet the specifications of CPWD, the sameshall
have to be removed immediately from the site. In case any legal dispute arises out of this
contract, the same shall be settled in Ghaziabad Courts.

21.0 DRAWINGS:
Drawings duly signed by the Architect / Consultants are diagrammatic but shall befollowed as closely as actual
construction permits. Any deviations made shall be inconformity with the direction and approval of the
Owner.Architectural drawings shall take precedence over Structural drawings, which inturn shall take
precedence over services drawings in regard to all dimensions.The Contractor shall verify all
dimensions at the Site and bring to the notice of the Owner. For discrepancies i f any, the
Owners decision in this respect shall be final.

22.0 WORK TO BE CARRIED OUT BY LICENSED PERSONS/FIRMS:
Technically competent persons or firms holding valid licenses shall only carry outany special service installations
included in the scope of the Work.

INSPECTION AND TESTING OF MATERIALS;
The Contractor shall, if sorequired, produce manufacturers' test certificates for any particular batch of
materialssupplied by him. The tests carried out shall be as per relevant Indian Standards andshall be carried
out at Government approved test facility. For checking setting outand testing materials at the Site the
Contractor shall provide the following minimumapparatus/ testing equipment:

Theodolites
Automatic levels
Steel tapes
Weighing machines
Spirit levels, plumb bobs
Micro meters
Thermometers
Hydraulic testing machines
Smoke test machines
Complete concrete testing lab
Equipment Moisture meters Complete sets of sieves
Oven.
Slump Testing Apparatus
Cube Moulds
Balance
All such equipment shall be calibrated at specified frequency for accuracy at aTesting
Facility approved by the Owner.The Contractor shal l get other tests carri ed out at hi s
own cost at approvedlaboratory as per the directions of the Owner.
22.0 REFERENCE DRAWINGS :

The Contractor shall maintain on site one set of all drawing issued to him for reference.

SHOP DRAWINGS:

The Contractor shall submit, during the currency of the project, to the Owner, four (4) copies of all shop drawings
for his approval. Shop drawings shall be submittedgenerally for the following:Construction and
installation details for shuttering and formworks StructuralSteelwork, especially joint
details.Metal Sheet Roofing: Laps, Ridges, Gutters etc.Metal Sheet Cladding and structural glazing details.For
specific areas requiring detailing as called for by the Project Manager
/Architect.Manufacturer's and/or Sub Contractor's fabrication drawings for equipment supplied by the
Contractor. Sampl es of al l fi ni shi ng materi al s l i ke Ti l es (vi tri f i ed and cerami c),
marbl e, paints, HDF skin door shutters, door locks, switches, CP fittings,
chinawares, bath tubs, stai nl ess steel si nks etc. shal l be submi tted for approval
pri or to procurement. These will be submitted in triplicate for approval and retention
bythe Owner and Architect and shall be kept in their site office for reference
andverification till the completion of the Project.
COMPLETION DRAWINGS & STANDARD MEASUREMENT BOOK (SMB):
On completion of the Work, the Contractor shall submit three (3) complete sets of the site produced
drawings and marked up prints of "AS BUILT" drawings verifiedand approved by the Architect to the Owner.
These drawings shall include and showall the changes / deviations made from the working drawings
during the course of construction and also the other details as called for. During the execution of
theWorks a set of drawings shall be retained in the Contractors Site Offices for theexclusive
purpose of recording changes made to the Work as the construction

Aut oCADSoftware.Along with the completion drawings the Contractor shall also prepare and
submitto the Owner the Standard Measurement Book (SMB) in the form of a bound b o o k
a n d a s o f t c o p y o f t h e s a me . S MB s h a l l i n c o r p o r a t e t h e
s t a n d a r d measurements of the items as per the compl etion /as built drawings in
modulesfinalized in consultation with the Owner.
2 3 . 0 C O N T R A C T D R A W I N G S :
Drawings issued/to be issued shall also firm part of the contract.
2 4 . 0 F I R E P R E C A U T I O N S :
The Contractor shall take all precautions and preventive measures against firehazards at the Site and
shall assume full responsibility for the same.
2 5 . 0 D R I L L I N G , C U T T I N G E T C . :
All cutting and drilling of walls or other elements of the building for the proper entry/installation
of inserts, boxes, equipment, etc. shall be carried out usingelectrically operated tools only.
Manual drilling, cutting, chiseling, etc. shall not be permitted. Cutting and drilling of structural members
shall be carried out usingvi brati on free di amond wi re sawi ng and di amond dri l l i ng onl y
wi th pri or permission. The cost for procurement and using such equipment is deemed to
beincluded in the Contract and no extra costs will be paid.
2 6 . 0 A P P R OV A L B Y S T AT UT OR Y B ODI E S :
The Owner will handle Commencement Certificate, No Objection Certificate andOccupation
Certificate if applicable for the permanent building works under thisContract.The Contractor shall
be responsible for providing required notices to authoritiesand to obtain and retain with him
at his own cost all other approvals/permissionsf rom the statutory bodi es, (Labour, ESI , PF,
Tax Deptts. etc. ) and any other approval/permissions required to facilitate performance of
the Contractors work under the Contract till completion.
27. 0REPORTS & CHECKLI STS BY SUB CONTRACTOR:
The Contractor has to note that the Owner follows the ISO procedures and all reports,
returns & checklists shall conform to ISO standards & procedures. During progress of the Work
the Contractor shal l prepare and submi t to the Owner vari ous checkl i sts, f or
havi ng checked vari ous Works at di ff erent stages of progress and reports as per the
approved formats and at specified frequency.

The Contractor shal l fi l e dai l y category-wi se l abour return. The report shal l indicate
scheduled requirement against actual strength.The Contractor shall prepare weekly reports of
planned and actual progress of theWork and the subsequent week' s schedul ed Work.
These wi l l al so i ncl udematerial procurement status.These reports shal l be submi tted to
the Owner and shal l be revi ewed i n co- ordination meeting.The Contractor shall submit
monthly report along with monthly bills.Further progress charts and schedul es shal l be
prepared by the Contractor asdirected by the Owner.The Contractor shall submit a safety
procedure manual or Company policy onsafety. Complying with the SHE Plan and outlining
its implementation by theContractor and including:Quality Assurance and Control System
(Sample format). Realistic construction programme/schedule. The Contractor shall
maintain and make available all therecords pertaining to reports, returns and checklist to
the Owner during audits(i nternal as wel l as external ) and make necessary
correcti ons, addi ti ons andactions based upon the findings / observations of the audits.
SITE BARRICADING:
Site Boundary fencing of RCC posts and barbed wireand r andom r ubbl e s t one
mas onr y boundar y wal l ex i s t i ng at s i t e s hal l be mai ntai ned by the Contractor
at hi s own cost ti l l compl eti on of the Proj ect. However if it is required for the Contractor to
replace / rectify the existing fencing/ boundary wall for security purpose the same shall be
done at Contractors owncost subject to approval of design. The Contractor for safety reason shall
providethe GI sheet barricading around the excavated pits and his work area, which shall be put in
proper line and level and shall be painted. The Contractor shall at his own cost provi de
l ockabl e gates at al l the openi ngs i n the si te barri cadi ng, boundary wal l , access
roads that may be requi red f rom ti me to ti me duri ng progress of work. The
Contractor shal l be requi red to provi de appropri ate barricading within the site to ensure
safety of men and material, at his own cost.RATE ONLY ITEMS/ EXTRA ITEMS AND QUANTITIES
EXCEEDING THETENDERED QUANTI TI ES: The Contractor shal l i mmedi atel y and
bef ore procurement and execution of the work obtain a written approval of the variationorder
from the Owner for the rate only item, extra items and quantities exceedingthe BOQ. No payments
will be entertained without the Owners written approvalof the change / variation order. The
onus shall be upon the Contractor to obtainsuch prior written variation order. The allowed
percentage is 10% towards CP &Overhead.
2 8 . 0 WA T E R A N D E L E C T R I C I T Y :
The Contractor shal l make hi s own arrangement for el ectri ci ty and water
f or construction purposes / labour hutments.The electricity required for Construction Work shall be
arranged by the Contractor from the authorities and/ or generators at his own cost. The
Contractor shall beresponsi bl e for al l di stri buti on poi nts as may be requi red f or the
Work. The

Contractor shall also make arrangement for alternative standby services at his owncost in the form
of additional Generators of adequate capacity (day & night) so thatthere is no delay in progress
of Work as per construction schedule submitted byhim. The Contractor shall prepare
schematic distribution diagrams of distribution of el ectri ci ty and water for
constructi on purposes and get them approved. Thedi s t r i but i on at s i t e s hal l be
i n ac cor danc e wi t h t he appr oved s cheme. The Contractor shal l ensure
i ncorporati on and stri ct i mpl ementati on of al l saf ety parameters, equipments,
instruments and directions given by the Owner from timeto time in this regard.The Cont r act or
s hal l i ns t al l t he t empor ar y di s t r i but i on l i nes f or wat er and electricity ensuring
that work of other Contractor is not interrupted or hampered. Incase during the course of
construction these lines foul or interrupt or hamper thework of other Contractor, the
Contractor shall remove and relocate the servicel i nes and r el oc at e t he s ame at hi s
own cos t . Al l Fees f or power and Wat er connection for construction purposes shall be
borne by the Contractor.
2 9 . 0 A S S O C I A T E D C I V I L WO R K S :
All civil works required for the storage of materials or the installation of equi pments for
the Contractor' s functi oni ng shal l be the responsi bi l i ty of theContractor.
3 0 . 0 G U A R A N T E E T O P E R F O R M
:The Cont r act or s hal l c ar r y out t he wor k i n ac cor dance wi t h t he
dr awi ngs , specifications, schedule and other documents forming part of the contract.
TheContractor shall be fully responsible for the performance of the works executed by
him. All waterproofing works and termite proofi ng works executed by theContractor, shall
be guaranteed for a minimum period of ten years from the dateof final completion of
Project.. The guarantees on the approved format shall besubmitted to the Owner along
with the as-built documentation at the end of the project.
3 1 . 0 E S C A L A T I O N :
Rates as mutually agreed shall remain firm & valid for a period of 30 months beyond which
the rates shall be reviewed for price adjustments if any.
3 2 . 0 DE WA T E R I NG A ND F L OODI NG C ONT R OL :
The Contractor is deemed to have allowed for any and all temporary dewatering,during the
execution of his Work. Such work shall include but not necessarily belimited to the safe disposal
of the resulting water; removal, replacement and/or recompacti on of the water l ogged

3 3 . 0 P R OT E C T I ON / P R E S E R V AT I ON OF T R E E S :
The Contractor shall take all measures necessary to ensure the protection
and preservati on of exi sti ng trees wi thi n / outsi de the boundary of the si te.
TheContractor shall be responsible of any damage / casualty to the trees happing as aresul t of
hi s worki ng at si te and f or any acti on, cl ai m, penal ty or expenses imposed by the
forest / any other department / authority. No claim / payment shall be payable to the Contractor on
this account.
Functional Organization
:
A typical functional organization for a construction site management will consists of Site Engineer, who is
obviously a specialist and hold his place in the organization because of the specialist functions of
management he performs. On technical side hewill be assisted by Junior Engineers who are also
specialists. They control thedepartmental heads, the Foreman. There may be Masonry
Foreman, CarpentryForeman, Electrical Foreman, Plumbing Foreman and General Foreman. Each
of these Foreman, is a specialists and controlled the skilled workman who will actuallydo the work. For example,
under the Masonry Foreman, there may be eight skilledmasons who are again specialist and can not be
replaced by anybody but mason.Same is the case with other Foreman, except in the case of General
Foreman, under whom there will be no skilled workman but only general unskilled labour who willnot do any
specialist job. A similar type of organization can be devised for Architectoffice. This office is headed by the head
of the organization called probably as Chief Architect. There may be two Senior Architect working under
the Chief Architect.These will control the work of four Junior Architects. These will be
directlyinvolved in the preparation of architectural drawings for which they may take theassistance
of draughtsmen. Thus it can be seen that each person in the hierarchy of afunctional organization is
specialists, whether he be a mason or carpenter or aForeman or an Engineer. The size of
the organization depends on the volume, complexity and the time periods of the various works being
done.The construction team consists of owner, engineers/ architects and contractor. Theteam is formed to
co-operatively plan, design and execute a particular project. Theobj ecti ve of the team i s to
execute the owner' s proj ect i n the best and most economical manner within the stipulated
completion time. The owner forms theconstruction team to serve his interests through the services
of both the contractor and engineers. The functions of the constituents of any construction team
dependupon the scope and nature of the work.

:They are the ones who assist skilled workers and performed many unskilled jobsat the site.They
expect the right payment and need to be given clear instructionsregarding what to do.

personshaving complete knowledge of that work and deputed by parties involved. these person
or persons appointed to settle the dispute is called "Arbitrator". Arbitrator gives decision onthe
basis of evidences available; enquiries made and his own skills and knowledge. Hisdecision
accepted by both the parties and also incorporated in the decree of the court if required
i.e. if earlier decision is not accepted by either of the parties and if matter isreferred to
court of law. Arbitrator has to take such decision which must be correct andaccepted by

Performance of thecondition of the proposal, for the acceptance of any consideration for a
reciprocal promise which may be offered with a proposal, is an acceptance of the proposal.All
agreements are contracts if they are made by the free consent of parties competentto contract,
for a lawful consideration and with a lawful object, and are not herebyexpressly declared to
be void.The consideration or object of an agreement is lawful, unless it is forbidden by
law,or -is of such nature that, if permitted it would defeat the provisions of any law or
isfraudulent or -the court regards it as immoral, or opposed to public policy.I n each of the
above cases, the consi derati on or obj ect of agreement i s sai d be unlawful. Every
agreement of which the object or consideration is unlawful is void.
CONCLUSION:
Public contract are required to be let in accordance with certain statutes. The performanceof construction
work is done pursuant to contractual agreement. Although there arenumerous types of
contracts, the contractor's obligation and initial concern is much more basic. With the proper
understanding of the basic requirements for the formation of legalcontract, the contractor will be
better able to avoid pitfalls, lawsuits and liabilities. Theessential contractual requirements are an offer, an
acceptance of the offer and consideration.
