LAW STUDENTS CONSTITUTION AND BY-LAWS
ARTICLE I
POLICIES AND OBJECTIVES
Section 1. N!e. The organization of members of the USPF Law
students shall oficially be known as the USPF LEX !"LE
#"$%&!'%T!#&( otherwise known as LEX( hereinafter referred to i
this onstitution as the organization)
Section ". O#$ecti%e&. The LEX e*ists for the +rimary +ur+oses,
-./To create a s+irit of unity among all the students of the ollege
of Law through union0oriented acti1ities2
-3/To de1elo+ the learning e*+erience of law student through
mastery in academic and non0academic skills and disci+line
which are essential in the bar e*aminations and in other
academic acti1ities2
-4/To encourage and u+hold sound( honest +ractices in the
+ursuit of academic e*cellence2
-5/To inculcate in the members the im+ortance of
+artici+ation in the continuing eforts of the ollege of Law to
im+ro1e and u+date the legal education +rogram and
curriculum of the ollege)
-6/To inculcate in the members the im+ortance of
+artici+ation in the continuing eforts of the ollege of Law to
im+ro1e and u+date the legal education +rogram and
curriculum of the ollege2
-7/To contribute to the ad1ancement of the members by
initiating and im+ro1ing ways together with the faculty in
order to +roduce bar to+notchers from the ollege)

Section '. I(e)&. The LEX shall be a non0sectarian( non0+artisan
and non0+ro8t organization) %s a non0+ro8t organization( no +art of
its income or net earnings shall be distributed or shall inure to the
bene8t of any oficers) %ny net +roceeds of the organization may
obtain as in incident of its o+eration or from the im+lementation
of any +ro9ect shall be de1oted to the furtherance of the
+ur+oses of which the organization has been created)
ARTICLE II
*E*BERSHIP

FOUNDATION
Section 1. Co!+o&ition. The membershi+ in the Le* ircle is
com+osed of the following,
-./%cti1e :ember) % bona8de law student who are currently and
oficially enrolled in the USPF ollege of Law) ross0enrollees
from other Law schools are dis;uali8ed)
-3/%lumna<%lumnus) :embers who graduated from the Uni1ersity)

Section ". E,-)it.. Le* ircle shall not( in any manner(
discriminate against +ersons or restrict in its membershi+ by
reason( age( citizenshi+( disability( gender +reference( creed(
religious belief( +olitical con1iction( and cultural and ethnic origin)

Section '. Ri/0t& n( P1i%i)e/e&. % member in good standing shall
en9oy the following,
-./To 1ote during election( +lebiscites and any other instance
re;uiring the 1ote of the members2
-3/To be a++ointed and elected to any ofice of the ircle( +ro1ided
he meets the ;uali8cations set forth2
-4/To ha1e full access to all records of the organization2
-5/To 1oice grie1ances or suggestions through channels as
may be established by the #ficers2
-6/To en9oy the +rograms( ser1ices and +ri1ileges which the LEX
may ofer2
-7/To attend and +artici+ate in the LEX assemblies( trainings
and acti1ities from in and out of cam+us2

Section 5) Fiscal "es+onsibility) The membershi+ runs for the entire
school year or until graduation)
ARTICLE III
2OVERN*ENT
A. E)ecti%e
Section .) om+osition) The following shall be the ofices to be
held by elected oficials,
.) President

3) =ice0President
4) Secretary0Treasurer
5) lass "e+resentati1es
Section ". Ten-1e o3 O4ice. The President( =ice0President and
Secretary Treasurer shall hold a term of . school year after they
are elected into ofice or until their successors are duly elected and
;uali8ed( unless sooner terminated for 9ust and 1alid cause)
Section '. 5-)i6ction. %ll #ficers must satisfy the following
;uali8cations,
.) andidates for LEX ircle #ficers must be a bona8de
member of the LEX ircle with good standing2
3) andidates for President and =ice0President may be limited
to the !ncoming Third >ears2
4) andidates must not be a graduating student the semester
following his election2
5) ?uestions of fact regarding the ;uali8cation of the elected
oficer must be raised on a motion within thirty -4@/ days
following the election to the #:ELE en banc)
#therwise( no motion will be entertained2
Section 7. D-tie& n( Re&+on&i#i)itie&. The #ficers shall
ha1e their corres+onding duties and res+onsibilities)
-./ President
a) Ae shall e*ercise full +owers of the E*ecuti1e by su+er1ising
o1er and o1erseeing the afairs and acti1ities of the LEX2
b) Ae shall be the oficial LEX ircle "e+resentati1e in all
ceremonies( afairs( +roceedings and transactions in and out
of cam+us acti1ities2
c) Ae shall o1ersee the transitional meeting for incoming
administration2
-3/ =ice President
a) Ae shall +erform the duties and res+onsibilities of the
President in acting ca+acity in the absence of the President2
b) Ae shall o1ersee the archi1al +rocess for all rele1ant
materials for subse;uent administration2

c) Ae shall +reside o1er meetings with the organization2
-4/ Secretary0Treasurer
a) Ae shall kee+ and maintain records of the minutes of the LEX
and re+orts the same2
b) Ae shall kee+ and maintain the 8nancial records of the LEX2
c) Ae shall be res+onsible for the collection and management of
the LEX Fund)
d) Ae shall be res+onsible for the creation and im+lementation
of +rograms to increase the LEX Fund)
e) Ae shall co0ordinate with other ministers on matters
+ertaining to budget and resource allocation)
f) %t the end of e1ery LEX ircle %cti1ity( he shall submit in
writing to the President a 8nancial re+ort and li;uidation)
-5/ lass "e+resentati1es
a) Ae shall re+resent the res+ecti1e le1el and section of
his class in the #ficersB meetings2
b) Ae shall take charge in the dissemination of information
to the class he re+resents and ser1es as liaison oficer
between their res+ecti1e classes and the LEX #ficers2
B. A++ointi%e
Section 1. *ini&t1ie&) &o later than . week after assuming ofice(
the President shall a++oint :inisters for the following ofices to
+erform their res+ecti1e functions)
.) "esearch and Publication
a) Ae shall be in charge of the collection and distribution of
new laws( Su+reme ourt irculars( Curis+rudence( etc) to
the LEX :embershi+
b) !n coordination with the President and other oficers and
ministers( he shall disseminate information regarding
!m+ortant School dates such as but not limited to2 E*am
Schedules( School Aolidays( :eetings( LEX ircle Social
%cti1ities( etc)
c) Ae shall be res+onsible for the creation and maintenance
of a LEX ircular which shall be a semestral +ublication
for all members)

3) Dar0o+s
a) Ae shall su+er1ise the selection and +re+aration of the
LEX =olunteers for the Dar #+erations)
b) Ae shall conduct seminars and trainings necessary for a
successful Dar #+erations)
c) %fter e1ery Dar #+erations( he shall submit a re+ort in
writing on the +erformance of the Dar #+s team to the
President)
4) Social %cti1ities
a) Ae shall be res+onsible for the +re+aration and
im+lementation of LEX ircle Social %cti1ities including
but not limited to, %c;uaintance Party( "ecognition of &ew
Lawyers( Freshmen #rientation( hristmas Party( etc)
b) %fter e1ery LEX ircle Social %cti1ity( he shall submit a
re+ort in writing on the successes and failures of the
acti1ity to the President)
Section ". 5-)i6ction&. %ll Dona8de members of the LEX ircle in
good standing may be a++ointed to ofice) Each :inister may also
a++oint his own de+uties as he sees 8t and necessary)
Section '. Te1! o3 O4ice. The :inisters term of ofice shall be .
school year following their a++ointment)
Section 7. Ot0e1 *ini&t1ie&. The President may a++oint other
ministers as he sees 8t and necessary)
ARTICLE IV
ELECTION
Section 1. Dte o3 E)ection. The %nnual election for the Le* ircle
#ficers e*cluding the lass "e+resentati1es( shall be e1ery 3
nd
Saturday of February)
The Election for lass re+resentati1es shall be done e1ery 3
nd
Saturday of the start of e1ery Semester)
Section ". The #ficers shall be deemed elected to ofice u+on
attaining the ma9ority 1ote of the 1otes cast)
FOUNDATION
Section '. A&&-!+tion o3 O4ice. There shall be a transition +eriod
of . week after the election of the new President( =ice0President and
Secretary0Treasurer before they are to assume their ofice) Euring
this +eriod( the outgoing oficers shall turn0o1er all 8nances(
acti1ities( documents( etc) to the incoming set of oficers)
Euring this +eriod( the outgoing oficers shall retain their +ower and
authority and shall only lose said +owers and authority after the la+se
of the . week transition +eriod) Likewise( the incoming set of oficers
shall also only assume their oficial functions and +owers u+on the
la+se of the . week transition +eriod)
Section 7. E)ection o3 LE8 Ci1c)e O4ice1&. The electi1e members
shall be elected in the following manner,
-./Filing of erti8cate of andidacy -#/ shall be acce+ted by the
#:ELE from the time notice as mandated by the onstitution
and Dy Laws2
-3/The cam+aign +eriod of the andidates will be determined by
the #:ELE2
-4/Each member shall ha1e one 1ote) The #:ELE shall
distribute the ballots to the members at the time of elections
and collect them +rior to the counting of the 1otes2
-5/=oting shall take +lace by secret ballot at the electoral meeting2
-6/%bsentee ballots will not be entertained2
-7/The candidates shall be elected into ofice u+on attaining ma9ority
1ote of the 1otes cast2
-F/The 1otes will be tallied by the #:ELE with the +resence of the
Faculty %d1isor or his re+resentati1e2
-G/The election of the lass "e+resentati1es shall be elected in ofice
within their res+ecti1e class le1el < section under the su+er1ision of
an !ncoming #ficer of the LEX ircle and a member of the
#:ELE on the 8rst semester2
Section 9. Re-E)ection. There shall be no limit as to the number of
TE":S of #FF!E that a +erson may hold for as long as he ;uali8es
for said ofice) The !ncumbent #ficers may run for "e0election
without resigning from their res+ecti1e ofices( but may not use the
resources of the LEX ircle for +ur+oses of their cam+aign)
ARTICLE V
FOUNDATION
RESI2NATION: DIS5UALIFICATION AND VACANCY
Section 1. Re&i/ntion n( Di&,-)i6ction. %n oficer may
resign or be dis;uali8ed of his +ost( in any of the following,
-./ "esignation) !f he belie1es he cannot carry on the duties and
function of his ofice2
-3/ Eis;uali8cation) !f based on the grounds +ro1ided for in Section 4
of %rticle !!!2
Section ". Vcnc.. !n case of a 1acancy in the ofice of the
President( the =ice0President shall assume the ofice of the President)
The ofice of the =ice0President shall be occu+ied by a :inister
a++ointed by the President) !f the #fice of the =ice0President is
likewise 1acant along with that of the President( the Secretary0
Treasurer shall assume the ofice of the President and shall a++oint a
minister to the ofice of the =ice0President and Secretary0Treasurer)
!n case of =acancy in the #fice of the =ice0President or Secretary0
Treasurer( or both( the President shall a++oint a :inster to each
1acant ofice)
Each a++ointee shall only ser1e the une*+ired term of the oficer he
was a++ointed to re+lace)
Section '. There shall be a =acancy in the following instances,
a) Hhen an #ficer "esigns his electi1e ofice)
b) Hhen an #ficer is later dis;uali8ed from his electi1e ofice)
c) Hhen an #ficer fails to enroll or ceases to attend classes during
his term of ofice)
ARTICLE VI
CO*ELEC
Section 1. %t the end of e1ery .

Semester( on the Saturday
following the scheduled Semi0Final E*ams( the President shall
recommend at least . andidate and the Presiding #:ELE
hair+erson shall nominate at least . other candidate for #:ELE
hair+erson and the lass "e+resentati1es shall 1ote as to who shall
hold the ofice in a meeting called for the +ur+ose)

Section ". Co!+o&ition. The #:ELE hair+erson shall
a++oint his three -4/ :arshalls for the enforcement and

administration of all laws and regulations relati1e to the conduct
of and elections( +lebiscite( initiati1e( referendum( and recall2

Section '. Te1! o3 O4ice. The hair+erson and his :arshalls shall
ha1e a term of ofice of . year following his a++ointment)
Section 7. Po;e1& n( D-tie&. !t shall be the res+onsibility of the
#:ELE hair+erson to o1ersee the conduct of the Elections for the
LEX ircle( and he shall be 1ested with all +owers necessary to carry
out this res+onsibility)
The hair+erson shall ha1e 9urisdiction o1er election and
dis;uali8cation cases against LEX ircle #ficials and andidates) The
hair+erson and his :arshalls shall sit en banc to decide such cases)
ARTICLE VII
COA
Section 1. %t the end of e1ery .

Section 7. Po;e1& n( D-tie&. !t shall be the res+onsibility of the
#% hair+erson to re1iew the 8nancial statements and status of the
LEX ircle and gi1e a written re+ort to the Eean of the ollege of Law
and shall +ublish his 8ndings for the bene8t of the :embershi+)
The hair+erson shall ha1e 9urisdiction to re1iew all com+laints
regarding the 8nances of the LEX ircle)
FOUNDATION
ARTICLE VIII
A*END*ENT
This Dy0Laws may be modi8ed( altered( amended or re+ealed
through the following methods( to wit,
-./The LEX ircle #ficers shall re1iew the constitution annually
to ensure that it is in kee+ing with the needs and acti1ities of the
LEX ircle2
-3/%ny member or oficer may submit a +etition for amendment
to the President of the LEX and to be +resented to the
#ficers +rior to +resentation of the $eneral Dody2
-4/%ny amendment to all or any +ortion of this onstitution and
Dy Laws shall re;uire at least two0thirds -3<4/ 1ote of all the
members called for by the #:ELE in whate1er method
necessary)
ARTICLE I8
EFFECTIVITY
This onstitution and Dy0Laws shall take efect u+on rati8cation of the
members of the student body in an election called for its +ur+ose)
The +ro1ision of this onstitution and Dy Laws shall be construed
liberally so as to efectuate its a++arent intent)
