CONSULTANT

In work construction project civil or structural engineering, consultants used to be monitoring


and inspector for a construction project, to maintain quality of the material and keep
Specification contained in the contract agreement between the developer/client and the
contractor (bill of quantity). The developer will appoint a qualified consultant and for the
purpose of monitoring the process of starting construction until the project is delivered.
Consultant also reviewed the claims prior to the developer to make payments to the
contractor.
Generally, consultants are not involved directly in the Liquidated and Ascertained demages
(LAD). In clause (22.1,PAM contract 2006) has clarified that the LAD involves only between the
developer and the contractor. If the contractor fails to complete the construction within the
stipulated period, the contractor charged by a certain amount contained in (standart form of
contract). From the view of consultants LAD does not apply directly if a project is delayed, the
contractor may have the excuse certain reasons
There are processes before LAD imposed on the contractor, they have a chance to state the
evidence which will be submitted to the developer for consideration, it is called extention of
time (EOT). EOT process can be applied several times in the last certain provided by the
developer to the contractor to continue construction until the end. After a number of
conditions that cause the contractor fails to complete the project, LAD will be imposed on the
contractor, but the construction process must be completed by the same contractor.
LAD has calculation that there are in (stantdart form of contract) payment by the number of
days of delay from the LAD charged until the project is complete. The fee will be deducted from
the total project required by the contractor to the developer. Means the ending balance
amount payable by the developer to the contractor. This process only involves the consultant in
the LAD.
In conclusion, there are certain creteria before the LAD imposed on contractor, it there are
advantages and disadvantages in terms of contractor in the construction industry in Malaysia.
LAD is a win-win situation between the developer and the contractor, the developer has also
made a significant investment in the project and want a return of capital and wanted a
successful project, so as contractors for the project to be responsible in the building process.
