The laws and regulations concerning parking in Quebec are complex. The purpose of this guide
is to simplify the parking laws as they apply to all citizens.
The provincial Highway Safety Code as well as municipal regulations must be considered jointly
when studying parking regulations. Consequently, amongst other important information, this
guide offers an overview of said regulations. The following sections describe various scenarios
in reference to parking infractions such as parking in reserved spaces.

With regards to the term road vehicle, previously stated in section 1 H.S.C., section 4
of the same law states:
4. road vehiclemeans a motor vehicle that can be driven on a highway, other than a vehicle that runs only on rails, a power-assisted bicycle or an electrically propelled wheelchair;
a trailer, a semi-trailer or a detachable axle is defined as a road vehicle
In addition, Title VII: Road and Traffic Signs and Signals, and more specifically section
288 H.S.C., explains:
288. For the purposes of this Title, a limited access highway is a public highway that may
be entered or left only at the specifically provided entrances or exits.
In addition, for the purposes of this Title, a scooter other than a motorized scooter and an
adults tricycle shall be considered as bicycles.
Also, in regards to access to reserved parking spaces, the Socit de lassurance automobile du Qubec (hereafter S.A.A.Q.) may require the obtainment of an identification sticker and a certificate of issue granting such privilege.
This requirement is identified in sections 11 and 11.1 H.S.C.:
11.A handicapped person or a public institution may be authorized to use parking spaces
reserved for the exclusive use of handicapped persons and be given an identification sticker
and a certificate of issue to that effect.
The sticker and the certificate are issued upon payment of the fees prescribed by regulation.
Apublic institutionis a public institution within the meaning of the Act respecting health
services and social services (chapter S-4.2) or the Act respecting health services and social
services for Cree Native persons (chapter S-5) that owns a motor vehicle equipped with devices to secure wheelchairs against movement.

The Socit (S.A.A.Q.) is responsible for the application of this section according to the rules
established by agreement between the Socit and the Minister of Transport.
11.1.The holder of an identification sticker must inform the Socit of any change of address or of the destruction, loss or theft of the sticker or certificate of issue within 30 days.
The holder of an identification sticker must return the sticker and the certificate of issue to
the Socit if they are no longer required or if the holder no longer meets the eligibility requirements.

Municipal authority regarding parking regulations within municipal territorial limits
is established in paragraphs 7 and 8 of section 295 H.S.C., as follows:
295.The person responsible for the maintenance of a public highway may, by means of the
proper signs or signals:
(7)prohibit, restrict or otherwise regulate the stopping or parking of road vehicles;
(8)reserve parking spaces for handicapped persons.
Please refer to the last section of this guide for direct links to the various Quebec municipal bylaws. The H.S.C. outlines the significance of road signage. The authority and respect of road signs
placed on public highways, roads and private paths, including but not limited private shopping
centres, are an integral and essential part of road safety and security.

speed is 70km/h or more, unless there is a case of necessity
or unless authorized by signs or signals.

If the driver of a road vehicle halts his vehicle during nightfall on a roadway due to a case of necessity, the driver must
activate his parking lights or flashing emergency lights or
signal the presence of his vehicle by means of lamps, reflectors or flares visible from not less than 150 meters and used
in accordance with the norms prescribed by the applicable
regulations.

Section 386 H.S.C. lists possible parking infractions. This enumeration outlines the
most common violations and citations in regards to parking tickets:
386.EExcept in cases of necessity or where another provision of this Code permits it, no
person may stop a road vehicle
(1)on a sidewalk or the median strip of a roadway;
(2)less than 5 meters from a fire hydrant or a stop sign;
(3)less than 5 meters from a police or fire station, or less than 8 meters from such a building
and on the opposite side of the street;
(4) at an intersection, on a pedestrian crosswalk clearly identified as such and on a level
crossing or less than 5 meters therefrom;
(5)in a loading and unloading zone or a zone reserved exclusively for road vehicles assigned
to public transportation, and clearly identified as such;
(6)on an elevated lane, a bridge or a viaduct, or in a tunnel;
(7)on a limited access highway, at an entrance to or exit from such a highway or on an access
ramp;
(7.1)in a traffic lane reserved exclusively for certain vehicles;
(8)in front of a sidewalk ramp specially built for handicapped persons;
(9)at any place where parking is prohibited by a sign erected in accordance with this Code.
Please note that no grace period or time limitation is mentioned within this section. As such,
it is possible that a statement of offence be given within seconds of committing the infraction.
Therefore, a defence of temporary violation will not be accepted or successful. The person who
commits the infraction will be found guilty.

According to section 388 H.S.C. it is forbidden to park or stop your vehicle in a space
reserved for a handicapped person. Said section stipulates the following:
388.No person may stop a road vehicle in a parking space reserved for the exclusive use of
handicapped persons and identified by signs or signals in compliance with the standards
prescribed by the Minister of Transport, unless the vehicle bears:
(1)an identification sticker issued in accordance with section 11 in the name of the driver, of
a person accompanying the driver, or of the institution on whose behalf the person is acting;
the sticker must be hung from the rear-view mirror inside the road vehicle in such a manner
that the sticker is visible from the outside;
(2)(subparagraph repealed);
(3)a sticker, plate or permit displaying the international wheelchair symbol, issued by another administrative authority in Canada or a member country or associate member country
of the European Conference of Ministers of Transport.
Where the vehicle bears a sticker issued pursuant to subparagraph 1 of the first paragraph,
the driver or passenger must, on request, hand over to a peace officer, for examination, the
certificate of the S.A.A.Q. attesting the issue of the sticker.
In addition to public highways, this section applies on private roads open to public vehicular
traffic, as well as on land occupied by shopping centres and other land where public traffic
is allowed.

Although, one action encompasses the other, when stopping or parking a vehicle, the
driver is performing two distinct actions. The following table distinguishes amongst

B. PARKING WAS IN AN AREA REGULATED OR FORBIDDEN BY EITHER THE HIGHWAY
SAFETY CODE OR A MUNICIPAL REGULATION (E.G.: SECTIONS 380 TO 388 OF THE H.S.C.)

The prosecution must establish that the vehicle was parked in an area regulated or prohibited by
the H.S.C. or a municipal regulation (with a sign or without, subject to sections 380 to 388 of the
H.S.C.). It is necessary to analyse the municipalities obligations in reference to signage. Should
the municipality be non-compliant in the installation of the municipal signage, it is possible to
utilize this non-compliance as a defence giving rise to an acquittal.
The criteria required for the effectiveness of road signs has been established within
provincial legislature. As such, municipal authorities and the individuals responsible
for the maintenance and management of public roadways, must respect and follow
these criteria. Section 1.1 of the Traffic Control Manual states that signs must be:
Uniform and homogenous;
Able to capture the attention of the driver;
Unequivocally visible and readable;
Conforms to the dangers and circumstances pertaining to signage;
Section 1.13.3 of the Traffic Control Manual stipulates that:
Whether the purpose of a sign is to disseminate information, an indication or warnings, the
height of it measured from ground level to the base of the sign itself should be:
Between 2.1 meters and 2.5 meters in a rural area;
Between 2.1 meters and 3 meters in an urban area, unless the sign is installed on a traffic
light, in which case the minimum height is 1.8 meters;
A minimum of 2.2 meters must be respected in areas where pedestrian traffic is allowed;
Section 2.17 of the Traffic Control Manual, specifies the following:
The sign must be at a 45 degree angle to the axis of the road when the extent of the parking
zone is indicated by an arrow;
The sign must be at a 90-degree angle for all other types of signage;
The maximum distance between each sign in an urban area is 100 meters;
***It is the defendants responsibility to verify that the mandated maximum distance of 100 meters between each sign is respected at the site of the infraction.***

Please be advised that once the prosecution demonstrates that the signage respects the standards set out by the Minister of Transport of Quebec, the signage in question is presumed to
be sufficient, precise and unequivocal. Therefore, the burden of reversing this presumption lays
upon the defendant. In order to succeed in this reversal, the defendant must present evidence
demonstrating the opposite and thus proving that the signage was not sufficient, precise and
unequivocal; E.g.: by establishing that the regulation stipulated by the sign does not follow the
parking standards established by the provincial government.
Section 1.10.3 of the Traffic Control Manual demands that the sign which prohibits
parking respects the following conditions:
The background of the sign must be white;
There must be a red circular outline;
It must have a diagonal bar that crosses the red circle from the top left side to the bottom
right side, drawn at an angle of 45 degrees off the horizontal axis;
Everything displayed inside the circle is subject to prohibition;
Section 2.18 of the Traffic Control Manual identifies the signs regulation parking under category
P-150; these determine the areas where parking is allowed or prohibited.
The markings on P-150 signs must read:

P-150-1 to P-150-5 and P-150-8.

P-150-1 signs are placed along rural roads in areas where parking can either hinder traffic or
present a danger.

Furthermore, a sign which prohibits street parking during the winter period is categorised
as P-150-4. In order to respect the standards on signage, municipalities must install them at
the entrance of the municipalitys territory, and if possible at all other strategic points in order to inform motorists. A P-150-3 sign can be installed above a P-150-4 sign which indicate
the name of the municipality or borough where said winter parking regulations apply.

A P-150-8 sign is used in conjunction with parking regulation lights, in order to inform drivers that parking is prohibited when the lights are on.

If these zones are controlled by parking meters, the P-150-9 sign MUST be installed and be
accompanied by a P-150-P-2 sign.

Also note that P-150-P-1 signs must be installed below P-150 and P-160 signs indicating
spaces where vehicles violating signage can be towed.

The P-150-P-4 and P-150-P-5 signs are posted in order to indicate areas where vehicles displaying an appropriate permit are exempted from the regulations in effect. If either of these
two signs are posted, they must be installed below P-150 or P-160 signs.

With regards to signage regulating parking either because of roadwork, or other special events designated by the authorities, the Regulation respecting road signs stipulates as per sections 50 to 52 the following:
50.Roadwork signs contain messages announcing works on a public road or near it.
They indicate in particular the manoeuvres to be made and the lanes or places where traffic
is allowed, detoured or prohibited.
51. Although they have an orange background, roadwork signs indicating a mandatory
message must be observed just like regulatory signs.
They indicate speed limits and parking regulations.
52.Roadwork signs have an orange background and the shape of a square standing on one
corner. Some of them are square or rectangular.

Should there be a violation of parking regulations and should the prosecution be able

Sections 391 to 393 also apply to a road vehicle abandoned on a private road or on private land, where public access is not authorized,
if the owner of that road or land requests a peace officer to remove
the vehicle.

Also, section 576 of the H.S.C. stipulates that:
576.The person authorized by a municipal council to enforce the parking by-laws of a municipality may perform the actions that a peace officer is authorized to perform under this
chapter if the offence alleged under this Code is a parking infraction.
Consequently, parking enforcement officers do not have the authority to order a vehicle towed or
impounded for the aforementioned infractions. These officers are simply allowed to issue tickets
and warnings. In order to have a vehicle towed or impounded, the police authorities must be
ADVISED of any parking infraction.

V. METHODS OF DEFENCE
The following section discusses potential defences such as a defence of necessity and/or
impossibility. Again, also remember that other methods of defence may be presented such
as a defence of non-compliance of municipal regulations with provincial standards. Possession of a parking authorisation can also be presented as a valid defence in order to have your
ticket nullified.
A.THE NECESSITY DEFENCE
In order to successfully present this defence and persuade the Tribunal of the validity
of the defence, the circumstances surrounding the infraction must correspond with
the criteria set forth by the Supreme Court of Canada in the cases of Perka(1984) and
Latimer(2001), respectively. The following must be proven:
An imminent danger was present; that danger was real, absolute and unavoidable;
There were no other options in order to avoid this danger, thus making the violation involuntary;
The consequences of the infraction in question were less or equal to the danger avoided.

It is important to be vigilant, due to the fact that the court in the ruling of Montral (Ville
de) c. Cie commerciale Kar Wah lte, 2011 QCCM 21
(http://www.canlii.org/fr/qc/qccm/doc/2011/2011canlii2416/2011canlii2416.pdf)
stated that the presence of a sign forbidding truck traffic on a portion of a street implicitly
also forbids a truck from parking on that street. The defence in this case, which was based
on a lack of appropriate signage, was rejected, but in other cases it may be successful should
the vehicle in question not fall under the definition of a truck. Hence, the prohibition of truck
traffic encompassed the prohibition of truck parking on that same street.
In addition, you may also demonstrate that the prosecution has not successfully proved all
of the required elements for your conviction.
D. AUTHORISATIONS OBTAINED FOR PARKING
With regards to parking authorisations, it is necessary to look over sections 66 and 64 of the
Code of Penal Procedure (hereinafter C.P.P.).
Section 66 of the C.P.P. states:
66.Proof of the issue and content of any certificate, licence, permit or other authorization
required by an Act for the carrying on of an activity may be made by producing, before the
judge, either the authorization or an attestation signed by the person having the authority
to issue such authorization.
As a result, should a ticket be issued in regards to a parking infraction, the filing in
court of a parking authorisation will annul the ticket, as stipulated by section 64 of the
C.P.P.:
64. It is incumbent upon the defendant to establish that he has the benefit of an exception,
exemption, excuse or justification provided for by law.

c. All other forms of signs or stickers identifying a handicapped person by another administrative authority in Canada or the United States.
Note that once a sign is present with an arrow pointing towards the right, another sign with an
arrow pointing towards the left must be present to mark the limit of the zone reserved for handicapped persons. Non-compliance with this standard marks an absence of an essential component of the basis needed to charge the defendant with an infraction: the presence of appropriate
signage.
Moreover, markings on the ground delimitating the parking area are also required. The
marks on the ground should correspond to a zone painted in blue, with or without markings. However, it necessary to be advised that such markings are not designated in the standards of the Minister of Transport of Quebec. Thus, when faced with signs regulating parking for handicapped persons, the presence or absence of visible markings on the ground is
irrelevant and does not constitute a valid defence. This point was further reinforced in the
case Qubec (Ville de) c. Caron, 2009 QCCM 230 (http://www.canlii.org/fr/qc/qccm/doc/2
009/2009canlii57643/2009canlii57643.pdf), whereby judgement was rendered stating that a
defendant cannot successfully claim the invalidity of the accusation against him by arguing
that the marks on the ground are covered by water or snow.

VII. CONCLUSION
Although there are multiple levels of governmental authorities, signage rules and regulations must comply with the following requirements: SUFFICIENCY, CLARITY, CAUTION,
PRECISION and PRESENTATION.
Basic principle: The owner of a road vehicle registered with the S.A.A.Q. can be declared
guilty of any infraction in the H.S.C. or of a municipal regulation related to parking, committed with his or her vehicle, unless the owner can prove that at the time of the infraction, the
vehicle was in the possession of a third party without the owners consent, as described by
section 592 of the H.S.C.
IMPORTANT:
Be alert: the presence of road signs at the entrance of a city or municipality is considered
sufficient to forbid or restrict parking.
The use of hazard lights while parking in an illegal or metered space, albeit for a short period of time, is not a viable defence unless the requirements of section 387 of the H.S.C. are
also satisfied.
When parked in a driveway, should the front or rear of a vehicle bumper extend onto or
block part of the sidewalk, there is cause for violation of a regulation.
It is wise to keep the parking stub as additional proof of payment.

it, without having left the designated parking area is not permitted as a way of avoiding the
120-minute parking limit.
STOPPED ON A SIDEWALK: The expression stopping a vehicle does not necessarily entail
the said vehicle being completely stopped on the sidewalk; to be considered as stopped
on the sidewalk, the vehicle can actually be parked, with all four wheels, on private property,
but if the back or front extends out onto the sidewalk it is considered illegal.
PARKING METER: The parking meter did not accept $2 coins.
USING HAZARD LIGHTS: The use of hazard lights while parked illegally, even for a short
time, while facing the opposite direction as traffic, does not constitute a valid defence.
STOPPING IN AN AREA RESERVED EXCLUSIVELY FOR THE USE OF CERTAIN TYPES
OF VEHICLES: When the signs do not indicate specific hours of parking, for the entire day
parking is prohibited. If the signs arent on the meter itself but attached to a pole, it is the

PARKING RESERVED FOR THE EXCLUSIVE USE OF HANDICAPPED PERSONS:
Driving a handicapped person is not a valid defence. Section 388 in fine implies that aside
from public roadways, the law likewise applies to private parking.
A handicapped person cannot use a designated space unless the vehicle is equipped with
a sticker/sign and a license plate is issued by the appropriate authority. Additionally, if the

Les municipalits ont le pouvoir de rglementer le stationnement lgard de leurs
limites territoriales et cette attribution de pouvoir est prvue aux paragraphes 7 et 8
de larticle 295 C.S.R.:
295.La personne responsable de lentretien dun chemin public peut, au moyen dune signalisation approprie:
7interdire, restreindre ou autrement rgir limmobilisation ou le stationnement des vhicules routiers;
8rserver des espaces de stationnement aux personnes handicapes.

muni:
1 dune vignette didentification dlivre conformment larticle 11 au nom du conducteur, dune personne qui laccompagne ou de ltablissement pour lequel il agit; la vignette doit tre suspendue au rtroviseur intrieur du vhicule, de manire ce quelle soit
visible de lextrieur;

roulant dlivr par une autre autorit administrative au Canada ou par un pays membre ou
associ de la Confrence europenne des ministres des transports.
Dans le cas o le vhicule est muni dune vignette dlivre conformment au paragraphe 1
du premier alina, le conducteur ou son passager doit, sur demande dun agent de la paix,
remettre pour examen le certificat de la Socit attestant la dlivrance de la vignette.
En outre des chemins publics, le prsent article sapplique sur les chemins privs ouverts la
circulation publique des vhicules routiers ainsi que sur les terrains de centres commerciaux
et autres terrains o le public est autoris circuler.

La poursuite doit tablir que le vhicule est stationn dans un endroit rglement ou interdit par
une disposition du Code de la scurit routire ou par un rglement municipal (avec prsence de
panneau de signalisation ou absence, en vertu des dispositions des articles 380 388 C.S.R.). Ainsi, il est ncessaire danalyser les obligations en matire de signalisation imputables aux autorits municipales. En cas dinobservation par celles-ci, il convient de soulever ces manquements
pour obtenir lacquittement.
Le lgislateur provincial a labor les critres essentiels afin daccrotre lefficacit de
la signalisation de prescription. Ces critres doivent guider les autorits municipales
et les personnes responsables de la gestion et de lentretien des chemins publics. La
norme 1.1 du Manuel de signalisation routire exige une signalisation:
Uniforme et homogne;
Qui capte lattention du conducteur;
Visible et lisible sans quivoque;
Conforme aux dangers et aux faits signaler
Larticle 1.13.3 du Manuel de signalisation routire du Qubec prvoit que:
La hauteur dun panneau de signalisation de prescription, de danger ou dindication, mesure depuis le niveau de la chausse la ligne de rive jusqu larrte infrieure de ce panneau
ou panonceau de signalisation :
Entre 2,1 mtres et 2,5 mtres de haut en milieu rural;
Entre 2,1 mtres et 3 mtres de haut en zone urbaine; sauf si le panneau est install sur un
feu de circulation o la hauteur minimale est de 1,8 mtres.
Un minimum de 2,2 mtres de hauteur doit tre respect aux endroits o la circulation
pitonnire est autorise;
Larticle 2.17 du manuel de signalisation routire du Qubec mentionne quant lui
que:
Le panneau doit tre install 45 degrs par rapport laxe du chemin lorsque ltendue
de laire de stationnement interdit est indique par une flche;
Le panneau doit tre install 90 degrs par rapport laxe du chemin pour tous les autres
types de panneau;

*** Il appartient donc au dfendeur de vrifier si la distance prvue de 100 mtres entre chaque panneau est respecte au lieu de linfraction reproche.***
Il faut noter que lorsque la poursuite dmontre quune signalisation de prescription respecte les
normes labores par le Ministre des Transports, la signalisation cite est prsume tre adquate, prcise et sans quivoque. Par consquent, le dfendeur devra renverser cette prsomption par une preuve contraire; par exemple en tablissant que le rglement ne respecte pas les
normes gouvernementales tablies pour le stationnement.
La norme 1.10.3 du Manuel de signalisation routire exige que le panneau qui interdit
le stationnement respecte ces exigences:
Un panneau sur fond blanc;
Constitu dune couronne rouge;
Dune barre diagonale qui part du ct suprieur gauche et aboutit au ct infrieur droit
en faisant un angle de 45 degrs avec lhorizontale
Tout ce qui figure lintrieure de la couronne fait lobjet dune interdiction;
La norme 2.18 du Manuel de signalisation routire identifie les panneaux rglementant le stationnement sous la cote P-150; ceux-ci dterminent les emplacements o le stationnement est
autoris ou interdit.
Les inscriptions sur les panneaux P-150 doivent tre:

Les panneaux qui indiquent les emplacements o le stationnement est interdit sont identifis sous les cotes P-150-1 P-150-5, et P-150-8.

pourrait nuire la circulation ou prsenter un danger.

hivernale est identifi sous la cote P-150-4. Afin de respecter les normes sur la signalisation,
les municipalits doivent les installer aux entres de leur territoire et si possible, tout autre
endroit stratgique afin de sensibiliser les automobilistes. Un panonceau du type P-150-3
peut tre install au-dessus du panneau P-150-4 pour indiquer le nom de la municipalit ou
de larrondissement o sappliquent les interdictions de stationnement hivernal.

Lorsquun agent de la paix procde au remisage dun vhicule abandonn, il doit effectuer les recherches raisonnables en vue de retrouver le propritaire du vhicule et en aviser le Ministre du Revenu.
Si le propritaire du vhicule abandonn na pas t retrouv
lexpiration dun dlai de 30 jours de la date de remisage, ce vhicule
est confi la gestion du Ministre du Revenu qui peut en disposer
librement. Dans ce cas, le Ministre du Revenu est tenu au paiement
des frais usuels de remisage.

576.La personne autorise par un conseil municipal appliquer les rglements dune municipalit relatifs au stationnement peut accomplir, lorsque linfraction reproche au prsent
code est relative au stationnement, les actes quun agent de la paix est autoris accomplir
en vertu du prsent chapitre.
Ainsi, les agents de stationnement nont pas le pouvoir de faire remorquer ou remiser un vhicule
automobile pour les infractions ci-hautes mentionnes puisque leur pouvoir est limit au chapitre des constats dinfractions et davertissements. Ces derniers devront communiquer avec les
autorits policires afin de DNONCER une immobilisation illgale.

V. MOYENS DE DFENSE
Il y a quelques dfenses possibles face une infraction de stationnement notamment, la
dfense de ncessit et la dfense dimpossibilit. Linobservation de rglementation provinciale en matire de signalisation routire par la municipalit est un autre moyen de dfense
mais nest pas aussi rpandu. Les dtenteurs des vignettes autorisant le stationnement doivent prsenter ces dernires aux autorits concernes afin de faire supprimer ladite contravention.
A. LA DFENSE DE NCESSIT
Afin de soulever judicieusement cette dfense et de persuader le Tribunal du bienfond de celle-ci, les circonstances entourant la commission de linfraction reproche
doivent rpondre aux critres dtermins par la Cour Suprme du Canada dans les arrts Perka et Latimer, rendus respectivement en 1984 et 2001. Il faut donc dmontrer
ce qui suit:
Prsence dun danger imminent; un danger rel, absolu et invincible;
Aucune autre possibilit relle de sortir de cette situation litigieuse; rendant ainsi le geste
involontaire;
Les consquences de linfraction reproche sont moindres ou gales celles du danger
vit;

LA DFENSE DIMPOSSIBILIT
Semblablement, la dfense dimpossibilit exige que les circonstances entourant la commission de linfraction reproche rpondent deux conditions, soit lextriorit et lirrsistibilit.
Extriorit : Il y a extriorit lorsquil sagit dune circonstance trangre la volont du
dfendeur, et celle-ci lempche de respecter la loi pleinement.
Irrsistibilit : Il y a irrsistibilit lorsquon peut infrer que toute personne place dans les
mmes circonstances ne pourrait respecter la loi et donc, agir autrement.
Par consquent, il est important de comprendre que cette impossibilit nest pas une impossibilit relative la personne du conducteur mais plutt une impossibilit absolue tel un accident
majeur, les forces de la nature; communment appels cas de force majeure en droit civil. De
ce fait, toute dfense de type commodit comme par exemple, le fait davoir stationn un vhicule illgalement en raison de limpossibilit de trouver un espace de stationnement nest pas
synonyme dimpossibilit de respecter la loi.
MOYENS LGAUX
Lnumration suivante nest pas exhaustive. titre dexemple, il est possible dinvoquer le
manquement de la municipalit de respecter les exigences du Manuel de la signalisation
adopt par le Ministre des Transports ou davoir ignor les prescriptions du C.S.R.
De plus, larticle 389 C.S.R. nonce une dfense aux infractions cites larticle 386
C.S.R.:
389.Malgr les interdictions prvues larticle 386 et dans la mesure o cette manuvre
peut tre effectue sans danger, le conducteur dun vhicule routier qui transporte une
personne handicape peut immobiliser son vhicule pour permettre cette personne dy
monter ou den descendre.

Cependant, il est ncessaire dagir de manire vigilante puisque la cour a statue dans la
dcision Montral (Ville de) c. Cie commerciale Kar Wah lte, 2011 QCCM 21
(http://www.canlii.org/fr/qc/qccm/doc/2011/2011canlii2416/2011canlii2416.pdf)
que la prsence dun panneau interdisant la circulation sur une portion de rue pour des camions interdit implicitement le stationnement pour les camions. Donc, en ce qui concerne
cette situation, la cour a rejete la dfense fonde sur labsence de signalisation malgr le
fait quil est thoriquement possible de lallguer.
Ainsi, il est commode de dmontrer que la poursuite na pas runi les lments ncessaires
une condamnation.
D. AUTORISATIONS OBTENUES POUR LE STATIONNEMENT
En ce qui concerne les autorisations obtenues pour poser une action sans encourir de sanctions, il convient de faire tat des articles 66 et 64 du Code de procdure pnale (C.P.P.).
Larticle 66 du C.P.P. prvoit:
La preuve de la dlivrance et du contenu dun certificat, dune licence, dun permis ou de
toute autre autorisation requise par une loi peut tre faite par le dpt de cette autorisation
devant le juge ou dune attestation signe par lautorit comptente pour dlivrer cette
autorisation.
Par consquent, si un constat pour une infraction au stationnement est mis et quune
autorisation officielle telle un permis, a t assigne, il est ncessaire den faire la dmonstration devant le Tribunal tel que prvu par les dispositions de larticle 64 du
C.P.P.:
Il incombe au dfendeur dtablir quil bnficie dune exception, dune exemption, dune
excuse ou dune justification prvue par la loi.

E. STATIONNEMENT DBARCADRE
Veuillez consulter ce sujet, le rglement de votre ville concernant la circulation dans les
rues de la Cit. titre dexemple, larticle 47 du rglement 721 de la ville de Qubec par
rapport la circulation dans les rues de la Cit nonce une restriction lgard de la dure
du stationnement et ce, une priode de 10 minutes pour laisser monter ou descendre
quelque personne ou pour le chargement ou le dchargement de marchandises. Larticle 1
de ce mme rglement dfinit vhicule de commerce comme un vhicule routier identifi au nom dune entreprise et utilis principalement pour le transport dun bien de ladite
entreprise.
F. STATIONNEMENT PERSONNES HANDICAPES
Les restrictions relatives au stationnement dans les espaces prvus pour les personnes
handicapes lintrieur des limites des Cits et Villes manent de rglements. Veuillez
consulter les rglements relatifs la circulation dans les rues afin dtre sensibilis aux rgles en vigueur. Toutefois, les municipalits qui dsirent rglementer le stationnement ont
lobligation dinstaller des panneaux prescriptifs visibles qui rpondent aux normes de signalisation prescrites par le Ministre des Transports qui ont t labors prcdemment.
En gnral, ces rglements prvoient que:
Nul ne peut immobiliser un vhicule dans un espace de stationnement rserv lusage exclusif des personnes handicapes moins que ce vhicule ne soit muni de lune des vignettes ou
plaques suivantes:
a. Une vignette didentification dlivre par la Socit de lassurance automobile du Qubec,
conformment larticle 11 C.S.R.;
b. Une vignette amovible dlivre par lOffice des personnes handicapes du Qubec (ciaprs Office) conformment larticle 30.1 de la Loi assurant lexercice des droits des
personnes handicapes (http://www2.publicationsduquebec.gouv.qc.ca/dynamicSearch/telecharge.php?type=2&file=/E_20_1/E20_1.html) qui doit tre suspendue au rtroviseur intrieur de manire ce quelle soit visible de lextrieur uniquement lorsque le vhicule transportant le titulaire de la vignette est stationn et la personne handicape doit avoir en sa
possession, lorsque la vignette amovible est suspendue au rtroviseur, le certificat dlivr
par lOffice attestant quelle est titulaire de la vignette amovible;

c. De toute forme de vignette ou de plaque identifiant une personne handicape par une
autre autorit administrative au Canada ou aux tats-Unis;
noter que lorsquun panneau comporte une flche pointant vers la droite, un autre panneau
avec une flche pointant vers la gauche doit tre install pour marquer la limite de la zone de stationnement rserve aux personnes handicapes. Par consquent, le non-respect de cette norme
constitue un dfaut qui dnote labsence dun lment constitutif de linfraction reproche au
dfendeur; soit une signalisation inapproprie.
De plus, il existe des rgles impratives en matire de marquage au sol. Ainsi, les marques
au sol doivent correspondre une zone peinture en bleue avec ou sans inscription. Cela ne
fait pas partie des normes de signalisation du Ministre des Transports. Ainsi, sil y a un panneau rglementant le stationnement pour personnes handicapes, le fait que les marques
de peinture au sol soient visibles ou non, ne constitue pas une dfense cette infraction.
Par consquent, un dfendeur ne pourrait invoquer linvalidit de son constat du fait que les
marques au sol sont couvertes par une accumulation deau ou de neige.

VII. CONCLUSION
tous les niveaux, le lgislateur a le devoir dinstaller une signalisation assujettie aux exigences de SUFFISANCE, de CLART, de CIRCONSPECTION, de PRCISION et de PRSENTATION.
Principe de base: Le propritaire dun vhicule routier dont le nom est inscrit dans le registre de la Socit de lassurance automobile du Qubec, peut tre dclar coupable de
toute infraction au Code de la scurit routire ou tout rglement municipal relatif au
stationnement, commise avec un vhicule routier, lexception du propritaire qui prouve
que lors de linfraction, ce vhicule tait en la possession dun tiers sans son consentement
tel que prescrit par larticle 592 du C.S.R..
ATTENTION:
Les signalisations aux entres des diverses villes ou aux endroits stratgiques, sont considres comme suffisantes pour interdire ou restreindre le stationnement.
Le fait de stationner un vhicule dans un espace interdit ou payant et dactionner les feux
de dtresse et ce, mme pour une courte priode de temps, ne constitue pas une dfense
un stationnement illgal sauf, si les exigences de larticle 387 C.S.R. sont respectes.
Si les pare-chocs avant ou arrire dun vhicule routier est stationn dans une entre prive
et empite sur le trottoir, il y a contravention la rglementation.
Suite au paiement dun espace de stationnement, il est prfrable de conserver le reu de
ce paiement. Ce reu pourra ainsi servir de preuve lors dattribution damende.

A t reconnu coupable le dfendeur qui sest rendu lUniversit afin daller chercher sa

secteur, des stationnements payants sont amnags moins de 5 mtre de distance des

Le dfendeur tait stationn moins de 5 mtres dune borne fontaine dans un espace
prvu par parcomtre et a pay pour lutilisation de cette espace de stationnement marque au sol. La borne fontaine tait cache par la neige. Le juge a retenu lapplication de

BORNES FONTAINES: Mme si la rglementation municipale prvoit le droit de stationner pour une priode de 2 heures un endroit, cette rglementation na pas prsance sur

ENDROIT INTERDIT: Stationnant dans un endroit interdit par une signalisation conforme,
le dfendeur a plaid limpossibilit dagir autrement car il est plus laborieux dutiliser un
terrain de stationnement larrire du bar.
STATIONNEMENT 120 MINUTES: Il nest pas permis de dplacer son vhicule de quelques
centimtres pour ensuite le replacer au mme endroit sans toutefois quitter la place de stationnement cest rendre la signalisation inoprant et contourner le loi.
IMMOBILIS SUR UN TROTTOIR: Lexpression immobiliser un vhicule ne ncessite pas
que ledit vhicule soit entirement immobilis sur le trottoir; est considr comme immobilis sur le trottoir, le vhicule dont les quatre roues sont situes dans une entre prive
mais dont larrire empite sur le trottoir.
PARCOMTRE: Le parcomtre nacceptait pas les pices de 2$.
FEUX DE DTRESSE EN FONCTION: Le fait dactionner les feux de dtresse sur un vhicule stationn sur une courte priode de temps, en sens contraire de la circulation ne constitue pas une dfense.
IMMOBILISER SON VHICULE ROUTIER DANS UNE ZONE RSERVE EXCLUSIVEMENT LUSAGE DE CERTAINS VHICULES: Quand les affiches nindiquent pas dheures
de stationnement, toute la journe est interdite au stationnement. Si les affiches ne sont
