JOINT AFFIDAVIT OF WITNESSES

We, BARANGAY KAGAWADS LUIS D. BONA and JUAN C.
FOLIENTE, JR., both of legal age, both married, both residents of
Topas Sogod, Nabua, Camarines Sur, after being sworn to in
accordance with law hereby depose and say that:
1. That we are newly elected Barangay Kagawads of
Barangay Topas Sogod, Nabua, Camarines Sur and we
assumed office on December 1, 2013;
2. That on December 2, 2013 at approximately 8:30 A.M. the
barangay council and the Barangay Council had our first
session with the agenda as follows:
a. Flag Ceremony every Monday;
b. Oath taking on December 8, 2013 at 8:00 PM at Fortuno
Civic Center;
c. Contribution of PhP100 pesos for snacks for the said
oath taking;
d. Duties and ranking by Zone;
e. Session to be conducted every first and third Monday of
the month;
f. Different Committees for the barangay; and,
g. Appointment of the Barangay Secretary
3. During the course of the barangay session all of the
agenda were discussed and the appointment of the
Barangay Secretary, Mrs. Janine Oco, was confirmed
unanimously by the Sangguniang Barangay;
4. The discussion on the appointment of the Barangay
Treasurer was to be discussed by the Sangguniang
Barangay the next preceding Monday or December 9,
2013;
5. That we have not heard, been invited to or attended
another barangay session after the barangay session on
December 2, 2013 at 8:30 A.M.;

6. That we are likewise not privy to any resolution dated

December 2, 2013 opposing the appointment of Mrs.
Lorna L. Foliente as the new Barangay Treasurer of Topas
Sogod under Resolution number 01; Series of 2013 signed
by several Barangay Kagawad, as follows:

7. That based on my own personal knowledge, the

aforementioned Barangay Kagawads had not conducted a
barangay session on December 2, 2013;
8. That the said resolution is spurious or fake;
9. Further, there was no session that was conducted on
December 2, 2013 other than the scheduled barangay
session;
10. As elected Barangay Kagawads, we are aware that a
resolution cannot be made without a scheduled barangay
session being held, we are aware that a barangay session
must be conducted in the presence of the presiding officer
who is the barangay captain, we are aware that a
barangay session cannot be made twice in a single day as
provided in the local government code of 1991, finally no
motion could have been made by Barangay Kagawad
Annaliza R. Paraiso and duly seconded by Eugenio L.
Cuarto, Sr. without a regular barangay session where
such resolution could have been made;
11. We will just relay other information in the proper forum.
12. We attest to the veracity of the contents of the
testimony in this joint affidavit.
