New Mexico Human Rights Bureau:

Human Rights

The Human Rights Bureau is a neutral agency


created to enforce the New Mexico Human
Rights Act. The Human Rights Bureau accepts
and investigates claims of discrimination The
New Mexico Human Rights Bureau enforces the
provisions of the Human Rights Act of 1969 (HRA).
Additionally, the Human Rights Bureau has a work
sharing agreement with the Equal Employment
Opportunity Commission (EEOC) to enforce the
provisions of federal law under Title VII of the
Civil Rights Act of 1964, as amended, the Age
Discrimination in Employment Act of 1967 (ADEA)
and the Americans with Disabilities Act of 1990
(ADA). The Human Right Bureau accept complaints
under the New Mexico Fair Pay for Women Act.
The New Mexico Human Rights Bureau is an
unbiased investigative agency and is not an
advocate for either the complainant or the
respondent. The Human Rights Bureau staff can
answer questions concerning discrimination,
but we cannot give legal advice.

Discrimination is against the law


The New Mexico Human Rights
Act Prohibits Discrimination in the
Following Areas:



employment,
housing,
access to credit, and
public accommodations.

Prohibited discriminatory bases


include:










race,
color,
national origin,
ancestry,
religion,
sex,
age (40 years of age +),
physical or mental handicap or serious
medical condition,
sexual orientation
gender identity, and
spousal affiliation.

Discrimination can occur in


actions such as:




failure to hire,
demotion,
discharge,
harassment, and
refusal to rent/lease housing.

What to do if you feel you have been discriminated against based on one or more of
the protected categories:

Call our office at (800) 566-9471 (toll-free in New


Mexico) or (505) 827-6838 and speak with an
intake officer. You may also submit a request by
mail, fax or e-mail to have an intake officer
contact you. You will typically be contacted within
two business days from receipt of your request.

The intake officer will help you determine if your


case is actionable and will assist you in preparing
a complaint. Until you formally file a charge with
our Bureau, your call is completely confidential.

You may talk with us even if you are not certain


you want to file a complain For example, to
discuss a potential problem in your workplace.
You may also talk with us if you are an employer.
For example, if you are concerned about a
situation among your employees

Important Things to Know:

The Human Rights Bureau also offers training


and educational sessions to employer groups,
employees, or any other interested groups about
preventing discrimination in the workplace and
the Human Rights Act. These services are
provided free of charge. The sessions are
conducted at your workplace or other location
convenient for you, typically last 6090 minutes
and can be customized to your organizations
needs. If you are interested in receiving training,

If your case is determined to be within our


jurisdiction, you may file a formal charge of
discrimination against the alleged violator.

You must file your complaint within 300


days of the most recent alleged violation.
We do not have jurisdiction over alleged
violations that occurred beyond that time
period.

Our office can assist you with the process


of filing a complaint and completing the
necessary steps, but we are a neutral
entity charged with conducting non-biased
investigations, so we cannot advocate for
you during the investigation or the
resolution.

Our Process:

The Bureau accepts complaints of


discrimination and investigates those
complaints to determine whether there is
evidence to show that discrimination
occurred.

The investigation is a thorough, non-biased


process through which the facts of the case
are established.

If it is determined that there is no probable


cause for a finding of discrimination, the
case is dismissed and may be appealed to
district court. If there is a finding of
probable cause, the case is set for a
hearing before the Human Rights
Commission. If the commission finds for the
complainant, actual damages and attorneys
fees may be awarded.
