El Tribunal Constitucional peruano


y los derechos fundamentales de las personas jurdicas
RESUMEN
A partir de un anlisis de las decisiones judiciales del Tribunal Constitucional de Per y de
otras disposiciones normativas de este pas, el autor discute en torno al reconocimiento
de la titularidad de los derechos fundamentales de las personas jurdicas. En defensa de
esta ltima, el texto desarrolla un esquema argumentativo a partir de cuatro ejes principales: la cuestin de los derechos innominados, los derechos y la relacin entre las personas naturales y jurdicas, el enfoque constitucional de los derechos fundamentales de las
personas jurdicas y las posturas del Tribunal Constitucional peruano al respecto.

ZUSAMMENFASSUNG
Ausgehend von den Entscheidungen des Verfassungsgerichts von Peru und anderen
Rechtsvorschriften des Landes befasst sich der Autor mit der Anerkennung der Grundrechttrgerschaft von juristischen Personen. Zu ihrer Verteidigung entwickelt der Beitrag
ein auf vier Grundlagen beruhendes Argumentationsschema: die Frage der unbenannten
Rechte, die Rechte und das Verhltnis zwischen natrlichen und juristischen Personen,
der Verfassungsansatz hinsichtlich der Grundrechte von juristischen Personen und die in
dieser Frage vom peruanischen Verfassungsgericht vertretenen Auffassungen.

Starting with an analysis of the judicial decisions of the Constitutional Court of Peru
and other legal regulations of that country, the author discusses the recognition of

lines of argument: the issue of unnamed rights, the relationship between individuals and
legal entities regarding rights, the constitutional approach to the fundamental rights of
legal entities and the Peruvian Constitutional Courts stance on this matter.
