FACTS:

2.TheAppellantthroughhisRTIapplicationdated18092013hadsoughtforinformationin
relationtonewsitemProbemedicallapsethatkilledformerCJIViz,
1) IsittruethatformerCJIJusticeMNVenkatachaliahisamongst34eminentcitizenshaving
demanded through his letter addressed to P.M to probe into the medical lapse which
allegedlykilledtheformerCJIJusticeJSVerma.

2) Is it true that Smt Pushpa Verma, Wife of former CJI has also written a letter dated

06.07.2013toPMOdemandingaprobeintothemedicallapsewhichallegedlykilledthe

3.RTIapplicationoftheappellantwastranferredVideletterdated20092013,tothePIOs
of other Departments. PIO, Directorate of Health Service to whom, the Petition of the
appellantwastransferred,repliedon10.12.2013givinginformationinrespectofPoints2&3
and for other points, the PIO stated that the information was not available with the
Directorate.

4.Beingunsatisfiedwiththeinformationprovided,theappellantpreferredFirstAppealon
14122013.TheFAAreplyisnotavailableonthefile.Claimingnonfurnishingofinformation
sought,theappellanthasapproachedtheCommissioninSecondAppeal.

5.Theappellantreferredtothedemandmadeby34eminentcitizenstothePrimeMinister
forprobingmedicallapsesthatallegedlyresultedinthedeathofformerChiefJusticeofIndia
JSVerma.EarlierwifeoftheformerCJIhadalsowrittenasimilarlettertothePrimeMinister.
Suchlettersfromeminentcitizensfromallwalksoflifeondeathofadevotedandhonest
juristwhospentispostretirementlifeinarentedhouseisindeedamatterofseriousconcern.
Whilethosehavingoccupiedhighpostsinlegislativesystemgetalltypesofgovernment
providedfacilitiesinlcudingthegovernmentbunglows,secretarialassistanceandhealthcare,
therearenosuchpostretirementfacilitiesforevenretiredChiefJusticeofofthenation.
DECISION
5. Boththepartiesmadetheirsubmissions. TheappellantrepresentedthathisRTI
applicationpertainsnotonlytotheDirectorateofHealthServices,GNCTDbutalsotothe
UnionMinistryofHealthandFamilyWelfareandDelhiMedicalCouncil.Healsosubmitted
that his RTI application was originally addressed to the Prime Ministers Office, who
transferredittotheUnionMinistryofHealthandFamilyWelfare,whointurntransferreditto
theDirectorateofHealthServices,GovtofNCTofDelhi. TheDirectoratehasgiventhe
informationforthepointspertainedtothem,andfortheresttheytransferredtheapplication
totheDelhiMedicalCouncil.

6. TheCommisison,therefore,directsthePIOsofUnionMinistryofHealthandFamily
WelfaretosupplyinformationforpointsNos.4to9oftheRTIapplicationandDelhiMedical
Council,forpointNo.3,alongwiththerelateddocuments,totheappellant,freeofcosts,
within15daysfromthedateofreceiptofthisorder.Theappealisdisposedof.
