GreenwasteFacility
Facilitythatacceptsgarden,wood,andotherorganicwastetoreprocessintocompost,woodchips,
orotherproducts,includingtheuseofpowerdrivenprocessingequipment.Facilitieswhich
receivegreenwaste(garden,wood,orotherorganicwaste)forshipmenttoanotherfacilityfor
reprocessingorcompostingareincludedinthistypeoffacility.Agreenwastefacilitydoesnot
includethechippingandgrindingofconstructionanddemolitiondebris.
HogFarm
Anyplacewheretwoormoreheadofswinearemaintained,raised,fed,orfattened.
HomeOccupation
Auseconductedinadwellingunitthatisclearlyincidentalandsubordinatetotheuseofthedwellingfor

PurposeandIntent
Thischapterisadoptedtoimplementthegoals,objectives,andpoliciesofthecountysgeneralplan
relatingtoopenspace,agriculture,conservation,andairquality.
Applicability
Thischapterappliestourbanagricultureinresidentialandnonresidentialzones,asaddressedinthe
ZoningDistrictsandLandUsetablescontainedinthiscode.
A.Maintenance.Urbanagricultureusesshallbemaintainedinanorderlymanner,includinglitter
removal,irrigation,weeding,pruning,pestcontrolandremovalofdeadordiseasedplant
materials.
B.Equipment:Useofmechanizedfarmequipmentisgenerallyprohibitedinresidentialdistricts
provided,however,thatduringtheinitialpreparationofthelandheavyequipmentmaybeusedto
preparethelandforagricultureuse.Landscapingequipmentdesignedforhouseholduseshallbe
permitted.Equipment,whennotinuse,shallbeenclosedorotherwisescreenedfromsight.
C.Structurestosupporturbanagriculture,suchasstoragetoolsheds,greenhouses,produce
stands,andinstructionalspacearepermitted,subjecttothezoningdistrictregulations.
D.Animals:Themaintenanceofthefollowingdomesticanimalsisallowedtosupporturban
agriculturesubjecttotheregulationscontainedinthissection:
1. Animals(exceptchickens,ducks,andfish)allowedbythispartmustbekeptinan
areaseparatefromwhereanyplantsaregrown,andthatareintendedforsale.
2. Egglayingchickens,egglayingducks,rabbits,andsimilaranimalsareallowed
subjecttothefollowingrestrictions:
a. Residentiallyzonedparcelsmayhaveoneoftheseanimalsforevery800
sq/ft.
b. Whentheseanimalsarekeptonimprovedresidentialparcels,theanimals
mustbekeptintherearyardonly.
c. Nonresidentiallyzonedparcelsmayhaveoneoftheseanimalsforevery400
sq/ft.
d. Anystructureforkeepingtheanimalmustbeatleast20feetfroma
neighboringresidentialstructure.

8. SanitationandNuisances:Farmanimalsshallbekeptonlyinconditionsthatlimit
odorsandnoiseandtheattractionofinsectsandrodentssoasnottocausea
nuisancetooccupantsofnearbybuildingsorpropertiesandnottocausehealth
hazards.Furthermore,farmanimalsshallnotbekeptinamannerthatisinjurious
orunhealthfultotheanimalsbeingkeptontheproperty.
9. ProcessingofAnimals.Chickens,ducks,rabbitsandsimilarsmallanimalsmaybe
processedonsiteonlyinsideagarageorotherenclosureandonlyforusebythe
occupantsoftheresidence.
E.Urbanagriculturestandsallowedunder3.4.12onthesiteofanurbanagricultureuseshall
complywiththefollowingstandards:
1. UrbanAgricultureStandsshallbeoperatedbythepropertyownerorlessee.
2. Productssoldshallbelimitedtoshelleggsandcropsthatarelocallygrownnonpotentially
hazardousprepackagedfoodproductsfromanapprovedsourcethatweregrownor
producedbyanotherurbanagricultureorcottagefoodoperationandagriculturalandfood
preparationrelateditems.
3. Nonpotentiallyhazardousprepackagedfoodproductsfromanapprovedsourcethatwere
grownorproducedbyanotherurbanagricultureorcottagefoodoperationshallbelimited
toafive(5)squarefootstorageandsalesarea.
4. Agriculturalandfoodpreparationrelateditemsshallbelimitedto25percentofthetotal
storageandsalesareaoftheUrbanAgricultureStand.
5. ThereshallbenomorethanoneUrbanAgricultureStandperparcel.
6. Onesignshallbeallowedprovidedthat:
a. Thesignshallbeaportablesign,andmaybeanAframe.
b. Thesign,includingsupports,shallfitintoanareaofnotmorethanfourfeetin
height,threefeetinwidth,andthreefeetindepth.
11. AnUrbanAgricultureStandmayoperateonlybetweenthehoursof8:00a.m.and7:00
p.m.
12. UrbanAgricultureStandsshallbetemporary,andshallbedismantledandremovedduring
nonoperatinghours.
13. Urbanagriculturestandsnotlargerthan240squarefeetareallowedbyright.
14. Urbanagriculturestandslargerthan240squarefeetshallbesubjecttotheapprovalofa
ZoningAdministratorConditionalUsePermit.
15. ParkingRequirements
a. UrbanAgricultureStandsshallnotbesubjecttothedevelopmentstandardsfor
offstreetparkingoutlinedelsewhereinthisCode.
b. Parkingfortwocarsshallbeprovidedeitheronstreetorinanoffstreetparking
facilityaccessedbyanapproveddriveway.
F.Trash:Trashreceptaclesshallbescreenedfromthestreetandadjacentpropertiesbyutilizing
landscaping,fencingorstoragewithinstructures.Alltrashshallberemovedfromthesiteweekly.
Systemsshallbemaintainedtobefreeofpestsandodors.

G.Compost:Compostsystemsshallbemaintainedtobefreeofpestsandodors.Compost
systemsmaynotbelocatedwithin20feetofaresidentialbuildingonanadjacentparcelwithout
permissionfromresidentialbuildingsowner.
H.Fencing:
1. Fencesarepermittedasregulatedintheunderlyingzoningdistrict.
2. Notwithstandingsection5.2.5,DevelopmentStandardsforWallsandFences,the
development,improvement,oruseofalotforurbanagricultureshallnotrequire
theprovisionofasolidwoodfenceormasonrywallalongpropertylinesadjacent
toResidentialorAgriculturalResidentialZones.
I.Nonconforminguses:Urbanagricultureusesthatexistedpriortoenactmentofthisordinance
areconsideredtohavebeenlegallyestablished.Iftheydonotmeetthecurrentregulations,they
arenonconforming,andchangestosize,operation,orotheraspectsareregulatedby1.9,
Nonconformance.
FurtherInformationonOnsiteSales
Asdetailedabove,theregulationofonsitesaleswouldoccurthroughtheusestandardsonurban
agriculturestands.
Thisisanevenstrongerpossibilitynowbecauseofabillpassedlastlegislativesession.AB1990
authorizedacommunityfoodproduceroragleanertosellorprovidewholeuncutfruits,vegetables,or
unrefrigeratedshelleggs,directlytothepublicortoarestaurant.Thisissoonlyifthecommunityfood
producermeetsspecifiedrequirements,includingthattheproduceislabeledwiththenameandaddressof
thecommunityfoodproducerandthateggproductionislimitedto15dozeneggspermonth.Thislaw
alsoempowershealthofficerstoregulateproblemsellers.

TheStatehasjurisdictionoverpesticides,enforcedviathecountyagriculturalcommissioner.See

AcommunitygardensponsoredbytheSanFranciscoRecreationandParksDepartmentwithasigned
CommunityGardenPlotAgreementor
Agardenestablishedfordemonstrationorotherinstructionalprogrammingpurposes.
SanFrancisco:newgardensgreaterthan1,000squarefeetneedtocomplywithexistingwaterefficiency
regulationsandsubmitinformationtothePUCregardingintendedwateruse(perSFUAAGuide,page
