ANTHONY ERFORT'S WILL

ANTHONY ERFORT IN THE NAME OF GOD AMEN:

I Anthony Erfort of Hempfield Township in the County of Lancaster and


the Province of Pennsylvania

being old and weak of Body but sound

memory and Understanding (God be thanked) Do on this twenty eight day of


January in the year one thousand seven hundred and eightythree make acknowledge

and declare this my last will and Testament in manner following that is to say.

First it is my will that my Funeral Expenses and all my just Debts shall be paid
by my here after named Executors out of my Estate.

Item it is my will and I give and bequeath unto my beloved wife Ann Maria the
full third parts of all my Estate.

Item it is my will and I give & bequeath unto my beloved wife Ann Marie the full
third parts of all my estate and a Right to live in this my dwelling House as
well as she can during her life if she remains my widow.
Item

I further order that my son John Erfort his Heirs Executors or Adminis

trators or any foreman of this my Plantation shall give and deliver unto my said

wife for her yearly support during her Life if she remains my widow yearly and
every year eight bushels of wheat eight bushels of rye one Row of Apple trees
in the Orchard with the Fruit of the same and of the Kitchen Garden four steps

across the hearth at the front part of it.

Keep her cow & three sheep in summer

in Pasture and in winter keep them in fodder & stable with his own.

Ten pounds

of hastled Hemp a fat Hog of at least one hundred Pounds weight.


Item

it is my will and I give & bequeath unto my said Son John Erfort and to

his Heirs and assigns for ever this my plantation where ever I now live to
gether with all the Buildings on the same containing about seventy acres more
or less as by a certain warrant for the same may appear at and for the sum of

one hundred Pounds Lawful money of Pennsylvania in which said sum of one hundred
Pounds my said son John Erfort shall have his share like my other children and

the remainder he shall pay to his brothers and sisters in manner following that
is to say to the children of my deceased Daughter Mary Schwaryder the sum of Four

Pounds lawful money of Pennsylvania in one year after my decease which said sum

shall be the full share of the children of my said Daughter Mary of all my Estate
real & personal land to the children of my deceased Daughter Gertraut Smith the
sum of six Pounds Lawful money of Pennsylvania in two years after my decease
which said sum shall be the full share of the children of my said Daughter out

of all my Estate and to the children of my deceased Daughter Margaret Leonard


the sum of six Pounds five shillings & ten Pence Lawful money of Pennsylvania

in three years after my decease which said sum shall be the full share of the
children of my said Daughter Margaret out of all my Estate

and there after yearly and every year to each of my children one after the other
according to their age the sum of Six Pounds five shillings & ten Pence until
the said sum is paid.

Item it is my will and I give my eldest son the sum of five shillings which
shall be in full for his second shares out of all my Estates.

Item it is my will and I order that if my deceased daughter's child named


Margaret Leonard should die under the age of Eighteen years then her said share
of inheritance shall fall back to and amongst my above mentioned children in
equal shares and further if my said son John Erfort should incline to sell said
Plantation then he shall offer the same to his brothers & sisters and let them

have it for an equilable Price but if they cannot or will not purchase same then
he may sell it to any person as well as he can.

Item I call to remembrance that I have received some Time ago of the widow
Weller the sum of Eighteen Pounds good Pennsylvania money which was bequeathed

to my children Therefor it is my will that if the children of my said daughter


Gertraut Smith should demand their share out of the said Eighteen Pounds with
interest then if the personal Estate is not sufficent to make it up it shall
be taken out of the sum of six Pounds which I have herein before bequeathed
to them and pay the share coming to the said children out of the said Eighteen
Pounds & Interest therewith.

Item it is my will that all my children which I have all named viz Anna Maria

Werner John Dewalt Erfort Catherine Laybly John Erfort Barbara Springer Henry
Erfort Jacob Erfort and Frederick Erfort shall be all equal shares of all my
Estate and none more than the other excepting what I have given to my eldest
son for his second share and what I now will give unto my son John Erfort
aforehand.

Item I give unto my said Son John Erfort a Certain Bible & a wind mill beforehand

Item it is my will and I ordain name in all & appoint my beloved wife Anna Maria

and my said son John Erfort Executors of this my last will and Testament making
hereby null and void all other will or wills by me herebefore made declaring
this and no other to be my last Will and Testament.

In Witness whereof I Anthony Erfort have hereto set my Bond and Seal on
the Day and year first above mentioned Signed sealed pronounced and declared
by the said Anthony Erfort as his last Will and Testament in the presence of us
Note

By a mistake the third of my wife was wrote twice whereas it was meant but

once and should be so done before it was sealed and declared.
