or its content may give rise to civil and/or criminal action.
Your use of the Website and services (including the Competition (as defined below) and
tools are governed by the following terms and conditions (Terms and Conditions) as
applicable to the Website including the applicable policies which are incorporated herein
by way of reference. If you use (including, to register and/or compete and/or surf) the
Website, you shall be subject to the policies that are applicable to the Website for such
transaction. By mere use of the Website, you shall be contracting with www.gasjeans.com
(Gas Jeans) and these terms and conditions including the policies constitute your
binding obligations, with Gas Jeans.
For the purpose of these Terms and Conditions, wherever the context so
requires "you" or "User" shall mean any natural or legal person who has agreed to
become a user of the Website by either providing the required registration data while
registering on the Website using computer systems or simply using the Website. Gas
Jeans allows the User to surf the Website and/or compete in the GAS FREE FOR 30
SECONDS RUSH AND WIN competition (the Competition) only by registering on the
Website. The term "we", "us", "our" shall mean Gas Jeans.
When you use any of the services provided by us through the Website, including but not
limited to surfing or registering for the Competition or actually taking part in the
Competition), you will be subject to the rules, guidelines, policies, terms, and conditions
applicable to such service, and they shall be deemed to be incorporated into this Terms
and Conditions and shall be considered as part and parcel of this Terms and Conditions.
Notwithstanding anything to the contrary herein, we reserve the right, at our sole
discretion, to change, modify, add or remove portions of these Terms and Conditions, at
any time without any prior written notice to you. It is your responsibility to review these
Terms and Conditions periodically on the Website for updates / changes. Your continued
use of the Website following the posting of changes will mean that you accept and agree
to the revisions. As long as you comply with these Terms and Conditions, we grant you a
personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.
ACCESSING, BROWSING OR OTHERWISE USING THE WEBSITE INDICATES YOUR
AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS AND
CONDITIONS, SO PLEASE READ THE TERMS AND CONDITIONS CAREFULLY
BEFORE PROCEEDING. By impliedly or expressly accepting these Terms and
Conditions, you also accept and agree to be bound by Gas Jeans policies
((including but not limited to privacy policy) as amended from time to time. As
mentioned above, the following Terms and Conditions also apply to this

Competition. By entering this Competition you accept these Terms and

Conditions. If you do not wish to abide by these Terms and Conditions please
do not enter this Competition.
It is your responsibility as a Competition entrant to certify that you have fully read and
accepted these Terms and Conditions and to familiarise yourself with any amendments
that might be made during the course of the Competition. By participating in the
Competition you agree that you have read, understood and are bound by the Terms and
Conditions set out herein, regardless of how you entered the Competition.

1.

Entry and entrants

1.2

Use of the Website (including entry into the Competition) is available only to
persons who can form legally binding contracts under Indian Contract Act, 1872,
and are residents of India (Individuals resident in the state of Tamil Nadu or
accessing the Competition from the state of Tamil Nadu are not allowed
to participate in the Competition and should not make any attempt to
participate in the Competition). Persons who are "incompetent to contract"
within the meaning of the Indian Contract Act, 1872, including minors, undischarged insolvents etc. are not eligible to use the Website and take part in the
Competition. If you are a minor, i.e. under the age of 18 years, you shall not
register as a User of the Website and shall not use the website or take part in the
Competition. Gas Jeans reserves the right to terminate your registration and / or
refuse to provide you with access to the Website if it is brought to Gas Jeans
notice or if it is discovered that you are under the age of 18 years. Employees
(and their immediate families) of Gas Jeans and/or its affiliated or sister
companies, and agencies associated with this promotion are ineligible to enter. No
Purchase is necessary. A purchase, even if permitted under applicable law, will not
increase your chances of winning a prize. If you are in any jurisdiction that
restricts your entry into the Competition for any reason whatsoever or which
restricts the ability to enter any competition for any reason, please do not enter
this Competition.

1.3

Gas Jeans reserves the right to require proof of the entrants' or the winner's age
and/or evidence to verify their identity at any time during or after the
Competition, and may use any appropriate means that are available to conduct
checks of any of the details thus provided.

1.4

The Competition Period is from 15:30:00 hrs Indian Standard Time ("IST") on 13
November 2014 (Competition Start) to 15:30:30 hrs IST on 13 November
2014 ("Competition End"). The registration and on-line training period for the
Competition shall be open from 11:00:00 hrs IST on 16 October 2014 to 15:00:00
hrs IST on 13 November 2014. Any entries received after 15:00:00 hrs IST
on 13 November 2014 will be discounted/void. For the sake of clarity, all
dates and times shall be as at Mumbai, India. The winners will be chosen by way
of the process set out below at the Competition End from all eligible entries
received during the Competition Period, on the date and time indicated in clause
2.6.

1.5

To enter the Competition, visit the Gas Jeans Website, and enter the
30years.gasjeans.com/in area from 11:00:00 hrs IST on 16 October 2014 to
15:00:00 hrs IST on 13 November 2014, and follow the prompts to complete the
Competition entry form. To enter, you must provide your first name, last name, full
postal address, zip code / postal code, country, gender, a valid mobile phone
number, date of birth and a valid email address. Only one entry per individual will
be accepted - all others will be void. Please note once again that individuals
resident in the state of Tamil Nadu or accessing the Competition from
the state of Tamil Nadu are not allowed to participate in the Competition

and should not make any attempt to participate in the Competition.

1.6

In the event of a dispute as to the identity of an entrant, Gas Jeans reserves the
right, at its sole discretion, to determine the identity of the entrant.

1.7

In the event that any entrant does not, or is unable to, comply with and meet
these Terms and Conditions, Gas Jeans shall be entitled at its sole discretion to
disqualify such entrant, without, to the maximum extent permitted by law, any
further liability to such entrant. Any entrant must comply with any directions
given to him or her by Gas Jeans including but not limited to those required by all
relevant laws, rules and regulations.

1.8

Entries must not be submitted by third parties. Bulk entries cannot be accepted.

1.9

Any entries which are not in accordance with these Terms and Conditions, or that
are not received by Gas Jeans by 15:00:00 hrs IST on 13 November 2014 will be
discounted / void.

1.10

In the event of any error, mistake, misinterpretation or disagreement

(technological, human or otherwise) regarding the correctness or acceptability of
any entries, the decision of Gas Jeans shall be final, and no correspondence will be
entered into.

2.

The Prizes and the Competition

2.2

Winner Selection: At the end of the Competition, the prizes below will be awarded
to the competitors who are the quickest to "acquire" on-line the Gas Jeans' item of
clothing or Accessory preselected by Gas Jeans as the Prizes pursuant to the "Rush
and Win" process as specified in clause 2.6:
The odds of winning any prize are dependent on the number of eligible entries
received during the Competition, and actual entrants who undertake the "Rush
and Win" process set out in clause 2.6 during the Competition Period. The total
retail value of the Prizes is INR 28.58 lakhs).
All Competition entrants who undertake the "Rush and Win" process set out in
clause 2.6 during the Competition Period and who do not win one of the Prizes will
be awarded a voucher for a 30% discount on a Gas Jeans' item of clothing or
accessory of the Fall Winter 2014 season, redeemable either by an on-line
purchase at www.jabong.com or a purchase from a participating retailer
(participating retailers are located in Schedule 1 hereto). The discount coupon will
be valid till 25 December 2014 (including 25 December 2014).
NO PURCHASE IS NECESSARY.

2.3

No cash equivalent, replacement or alternative prize will be given to any winner,

and each prize is non-transferable and non-exchangeable. However, in the event
of circumstances beyond its control Gas Jeans reserves the right to change or
amend a prize and/or to offer a substitute of comparable worth or cost, with
permission, if required, of the relevant regulatory authorities.

2.4

If a prize is unavailable, Gas Jeans, at its discretion, reserves the right to

substitute the prize with a prize of equal value and/or specification, subject to any
written directions, if required, from the relevant regulatory authorities.

2.5

If this promotion is disrupted in any way or is not capable of being conducted as

reasonably expected due to any reason beyond the reasonable control of Gas
Jeans, including but not limited to technical difficulties, unauthorised intervention

or fraud, Gas Jeans reserves the right, at its sole discretion, to the fullest extent
permitted by law: (a) to disqualify any entrant; or (b) subject to any written
directions from the relevant regulatory authorities, if required, to modify, suspend,
terminate or cancel the promotion, as appropriate.

2.6

Any cost associated with accessing the promotional website is the entrant's
responsibility and is dependent on the Internet service provider used.

2.7

"Rush and Win": Each registered entrant will be invited to undertake training
before participating in the Competition. There is no limit on the number of training
exercises that a registered entrant can undertake during the training period. The
training site will be available from 11:00:00 hrs IST on 16 October 2014 to
15:00:00 hrs IST on 13 November 2014. The Competition will commence at
15:30:00 hrs IST on 13 November 2014 and close at 15:30:30 hrs IST on 13
November 2014. Each entrant will need to access the 30years.gasjeans.com/in
page and enter their details. From the start of the countdown, each entrant should
select one of the on-line the Gas Jeans' item of clothing or Accessory preselected
by Gas Jeans as the Prizes they intend to "acquire" on-line, and shall have thirty
seconds within which to "acquire" one of the Prizes, completing all of the on-line
acquisition process. The obligatory steps are: selection of the Male or Female line
of clothing and of the product line comprising the Prizes, and once in the list of
Prizes, select the Prize. The confirmation of the acquisition shall occur once the
Prize product and size is confirmed by clicking on the "CHECK OUT icon. The time
of the click on the checkout icon is registered and the Prize item will no longer be
available to other entrants. To win a Prize the entrant must be the first to click on
the checkout icon before the Competition End and before any other user/entrant
clicks on the checkout icon for such Prize / product. The Competition winners will
be those who are quickest in completing the acquisition process described above
before the Competition End. Each entrant can only "acquire" one Prize.

2.8

The Competition administration, winner selection and verification will be

supervised by the Promoter.

2.9

The Competition winners will be notified about the Prize acquired by them within
24 hours of the Competition End by email to the email address submitted by the
participant in accordance with paragraph 1.4.

2.10

All prizes will be despatched to winners within 60 days of Gas Jeans receiving the
winner's email claiming their prize. All delivery costs will be borne by Gas Jeans. In
the event that a prize is not able to be delivered to the winner and returned to
Gas Jeans, the prize will be deemed to have been rejected and forfeited by the
winner and Gas Jeans may do whatever it deems fit with such prize.

2.11

All entrants that undertake the "Rush and Win" process during the Competition
Period set out in clause 2.6 but who do not win a prize, shall within 48 hours of the
Competition End be sent by email a Gas Jeans voucher for a 30% discount on a
Gas Jeans' item of clothing or accessory of the Fall Winter 2014 season,
redeemable either by an on-line purchase at www.jabong.com or a purchase from
a participating retailer (participating retailers are located in schedule 1
hereto).The discount coupon will be valid till 25 December 2014 (including 25
December 2014).

2.12

Gas Jeans' decision is final and no correspondence will be entered into.

2.13

The Competition administration and winner selection and verification will be

supervised by the Promoter.

2.14

No participant or winner shall have the right to contest any decision by the

Promoter concerning any aspect of the Competition or the interpretation of the

Terms and Conditions or the determination as to the qualification of entries. By
participating in this Competition, you agree to be bound by these Terms and
Conditions.

2.15

Notwithstanding anything else contained herein, the Promoter reserves the right,
at its sole discretion, to make any necessary modifications to the Competition,
subject to approval, if required, of the relevant regulatory authorities (or to
disqualify any individual implicated in any of the following actions, whether based
on reasonable suspicion or actual evidence), for reasons including but not limited
to: (a) infection by computer virus, bugs, tampering, unauthorized intervention,
improper actions by entrants, fraud, technical failures, or any other causes which,
in the Promoter's sole opinion, corrupt or affect the administration, security,
fairness, integrity or proper conduct of the Competition, (b) the Competition or
any website associated therewith (or any portion thereof) becomes corrupted or
does not allow the proper processing of entries per the Terms and Conditions, or
(c) the Competition is otherwise not capable of running as planned by the
Promoter. Only the prizes listed and the values listed in these Terms and
Conditions shall be awarded. To the extent permitted by law, by entering this
Competition, you explicitly agree to release and hold harmless the Promoter, its
respective affiliates, parent companies, subsidiaries, successors and their
respective, advertising, design, and production agencies and print production
agencies and all their respective shareholders, directors, officers and employees,
one and all, from any and all liability, actions, causes of action, damages, actual,
incidental or consequential, claims and demands whatsoever in law or equity,
including all "costs", which you now have or may acquire, by reason of any
personal injury, death, loss of or damage to property, or any reason, occurring
during or arising out of your participation in the Competition. To the extent
permitted by law, each prize winner waives the right to claim any liability
(including attorney's fees and costs) which might arise from redeeming, seeking
to redeem or travelling to/from redemption of any prize. The right to receive a
prize is non- assignable and non-transferable and no prize substitution, transfer or
exchange will be allowed.

2.16

Gas Jeans hereby disclaims any guarantees of exactness as to the finish and
appearance of the final Prizes as ordered by the User. The quality of any products,
services, information, or other material purchased or obtained by you through the
Website may not meet your expectations. Alterations to certain aspects of your
order such as the merchandise brand, size, color etc. may be required due to
limitations caused by availability of products, difference in size charts etc.

3.

Data Protection and Publicity

3.1

Entrants to the Competition consent to Gas Jeans using their name, likeness,
image and/or voice (including photograph, film and/or recording of the same) in
any media for an unlimited period without remuneration for the purpose of
promoting this promotion (including any outcome), and promoting any products
manufactured, distributed and/or supplied by Gas Jeans.

3.2

Information and personal data which is provided by entrants when they enter will
be collected, contained and managed by Gas Jeans and their suppliers and
contractors in order to successfully manage the Competition. Entry is conditional
on providing this information. Entrants' personal data may also be passed to
relevant regulatory bodies, the police or other authorities in the course of the
investigation of any complaints or suspected unlawful activity. The Promoter may,
for an indefinite period, unless otherwise advised, use the information for
promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the entrant. Collective, non-personal

data may also be used for the purpose of market research or in facilitating
reviews, developments and improvements to relevant services. Entrants should
direct any request to opt out, access, update or correct information to the
Promoter. All entries become the property of the Promoter 3.3 Any personal data
will only otherwise be used in accordance with Privacy Policy, which is stated
hereinafter.

4.

Liability

4.2

Nothing in these Terms and Conditions restricts or excludes your statutory rights
as a consumer.

4.3

Except for any liability that cannot by law be excluded, the Promoter (including its
respective officers, employees and agents) is not responsible for and excludes all
liability (including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of: (a) any technical difficulties or equipment malfunction
(whether or not under the Promoter's control); (b) any theft, unauthorised access
or third party interference; (c) any entry or prize claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due
to any reason beyond the reasonable control of the Promoter; (d) any variation in
prize value to that stated in these Terms and Conditions; (e) if a prize (or any
element of a prize) is cancelled for any reason beyond the reasonable control of
the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking of
and/or use/redemption of a prize.

4.4

To the extent permitted by law, Gas Jeans does not accept responsibility for any
fault, malfunction, damage, loss or disappointment suffered by any entrant which
could arise from participating in the Competition or of accepting any prize whether
due to any error, omission or other cause by Gas Jeans, its employees, agents or
others.

4.5

To the extent permitted by law, Gas Jeans is not responsible for any damage or
loss caused to an entrant where such damage or loss is not reasonably
foreseeable to the entrant or to Gas Jeans at the time the entrant agrees to these
Terms and Conditions (which occurs automatically when you enter the
Competition), including where the damage or loss results from Gas Jeans' breach
of these Terms and Conditions.

4.6

Gas Jeans does not promise that the services relating to the Competition will be
free from errors or omissions nor that they will be available uninterrupted and in a
fully operating condition. These services may be suspended temporarily and
without notice in the case of system failure, maintenance or repair or for reasons
reasonably beyond the control of the Promoter. To the extent permitted by law,
Gas Jeans will not be liable to you or to any other person in the event that all or
any part of the service relating to the Competition is discontinued, modified or
changed in any way. To the extent permitted by law, the Promoter and all
production agencies are not responsible for (i) any error, omission, interruption,
defect or delay in operation or transmission at any website, (ii) failure of any entry
to be received by the Promoter due to technical problems, human error or traffic
congestion on the internet or at any website, (iii) communications line, hardware
and/or software failures, (iv) damage to any computer (software or hardware)
resulting from participation in the Competition, (v) theft or destruction of,
tampering with, unauthorized access to, or alteration of entries and/or entry
information, or (vi) entries which are late, lost, stolen, damaged, incomplete,
and/or unintelligible (or any combination thereof). OTHER THAN AS REQUIRED
BY LAW, GAS JEANS MAKES NO WARRANTIES IN CONNECTION WITH THE
COMPETITION OR THE PRIZES. TO THE EXTENT PERMITTED BY LAW, GAS

JEANS EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING

WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE.

4.7

You agree to reimburse Gas Jeans in respect of any damages suffered by Gas
Jeans or any losses by Gas Jeans resulting from any claim made by a third party in
each case in respect of any matter arising from your use of the services relating to
the Competition in breach of these Terms and Conditions or from your violation of
any applicable law or regulation.

5.

Standard terms

5.2

These Terms and Conditions are available in English only and shall be exclusively
governed by and construed in accordance with the laws of India without reference
to conflict of laws principles. The Courts of Mumbai shall have exclusive
jurisdiction in the case of any dispute between the parties.

5.3

The Promoter and Data Controller in all jurisdictions is GROTTO S.p.A. with its
registered office at Via P.te dei Granatieri, 4 - 36010 Chiuppano (VI), Italy, VAT
Number A01516660246 (telephone (+39 0445 894000) (collectively the
Promoter and/or Gas Jeans).

6.

Additional Terms

6.2

Nothing in these Terms and Conditions limits, excludes or modifies or purports to

limit, exclude or modify the statutory consumer guarantees as provided under any
applicable jurisdiction (Non-Excludable Guarantees). Except for any liability
that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) excludes all
liability (including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the promotion

Links To Third Party Sites.

7.2

The Website may contain links to other websites (Linked Sites). The Linked
Sites are not under the control of Gas Jeans or the Website and Gas Jeans is not
responsible for the contents of any Linked Site, including without limitation any
link contained in a Linked Site, or any changes or updates to a Linked Site. Gas
Jeans is not responsible for any form of transmission, whatsoever, received by you
from any Linked Site. Gas Jeans is providing these links to you only as a
convenience, and the inclusion of any link does not imply endorsement by Gas
Jeans or the Website of the Linked Sites or any association with its operators or
owners including the legal heirs or assigns thereof. The users are requested to
verify the accuracy of all information on their own before undertaking any reliance
on such information.

8.

Termination.

8.2

Gas Jeans may suspend or terminate your use of the Website or any service if it
believes, in its sole and absolute discretion that you have breached, violated,
abused, or unethically manipulated or exploited any term of these Terms and
Conditions or anyway otherwise acted unethically.

8.3

Notwithstanding Section 8.1 above, these Terms and Conditions will survive
indefinitely unless and until Gas Jeans chooses to terminate them.

8.4

If you or Gas Jeans terminates your use of the Website or any service, Gas Jeans
may delete any content or other materials relating to your use of the service and
Gas Jeans will have no liability to you or any third party for doing so.

9.

Severability

9.2

If any provision of the Terms and Conditions is determined to be invalid or

unenforceable in whole or in part, such invalidity or unenforceability shall attach
only to such provision or part of such provision and the remaining part of such
provision and all other provisions of these Terms and Conditions shall continue to
be in full force and effect.

10.

Report Abuse

10.2

As per these Terms and Conditions, users are solely responsible for every material
or content uploaded on to the Website. Users can be held legally liable for their
contents and may be held legally accountable if their contents or material include,
for example, defamatory comments or material protected by copyright,
trademark, etc. If you come across any abuse or violation of these Terms and
Conditions, please report to 30years@gasjeans.co.in.

Privacy Policy

By visiting the Website you agree to be bound by the terms and conditions of this Privacy
Policy. If you do not agree please do not use or access our Website.
By mere use of the Website, you expressly consent to our use and disclosure of your
personal information in accordance with this Privacy Policy.
This Privacy Policy is incorporated into and subject to the Terms and Conditions for use of
the Website. We will only keep your information for as long as we are either required to
by law or as is relevant for the purposes for which it was collected.
The data provided by the entrants in the Competition by way of completing the online
registration form shall be used:
a. to allow their participation in the Competition; and
b. with their prior consent, for promotional, sales and marketing purposes, which can
be used by both Grotto S.p.A. and other companies, including external specialised
firms which inform the public on promotional sales through interviews, letters,
telephone calls or the computerised calling systems pursuant to Article 130 of
D.Lgs. 196/2003 of the Republic of Italy, including, for example, e-mail, SMS, MMS
etc.
The data processing will be made by using computerised means. The data processing
company is: Grotto S.p.A., Via Ponte dei Granatieri n. 4, Chiuppano (VI).
We collect, store and process your data for processing your purchase on the Website and
any possible later claims, and to provide you with our services. We may collect your title,
name, gender, email address, postal address, delivery address (if different), telephone
number, mobile number, fax number, payment details, payment card details or bank
account details when you avail our services.
The data supply is a necessary requirement for participating in the Competition. We may
pass your information on to a third party in order to make delivery of the product to you
(for example to our courier or supplier). You authorise us to pass your information to such
third parties as may be required for delivery of the product to you.

We use third parties for personal data processing and for the carrying out of certain
activities. To be provided with the full list of the process managers, please contact Grotto

The user's data may be communicated to third parties in cases in which said
communication is obliged by law or is necessary for purposes required by law (for
verification of identity, or for prevention, detection, investigation, prosecution, and
punishment of offences) or by order of a court / judicial body, for which direct permission
of the interested party is not required; in these cases, the data may be made available to
third parties who will process them independently and solely for the above-mentioned
purposes.
You must only submit to us or our agent or the Website information which is accurate and
not misleading and you must keep it up to date and inform us of changes. Please review
and modify any information submitted to us wherever necessary by sending us an email
at 30years@gasjeans.co.in.
We shall not share any of your personal information with third parties without your
explicit consent. We do not sell or rent your personal information to third parties for their
marketing purposes without your explicit consent and we only use your information as
described in the Privacy Policy. If you object to your Information being transferred or used
please do not use the Website.
Under no circumstances do we rent, trade or share your personal information that we
have collected with any other company for their marketing purposes without your
consent. We reserve the right to communicate your personal information to any third
party that makes a legally-compliant request for its disclosure.
Hypothetical exclusion of permission
In compliance with Information Technology Act, 2000, we can process the user's personal
data without asking his/her permission when this is necessary to carry out an obligation
of the law or when it is necessary for carrying out those obligations taken on by the
contract.
