MERALCO TRANSMISSION LINES
Facts: : Residents of Makati and Pasay vs.
Meralco. The former claims that the electrical
lines to be placed by respondent would cause
injury to their health due to prolonged
exposure to electromagnetic radiation.
Ruling: Writ DENIED. There is no evidence
showing causal link between electromagnetic
field and illnesses. Furthermore, Meralco had
complied with ALL environmental standards
embodied in ECC.
West Tower vs. First Philippine Industrial
Corporation (FPIC)
Facts: An oil leak near the Magallanes flyover
in Makati was discovered, and later determined
to have been caused by holes in an FPIC
pipeline carrying fuel products from Batangas
to Manila. Thus, residents of the nearby West
Tower Condominium being affected by the
leakage of dangerous chemicals, soil and water
contamination, have filed for the application of
the writ against FPIC.
Ruling: The writ of Kalikasan was GRANTED.
There was ample evidence to show a lack of
diligence on the part of FPIC to maintain its
pipeline. Thus, pursuant to the writ, the court
ordered FPIC to cease and desist the pipeline
operation, to check structural integrity of
pipeline and the issuance of a Temporary
Environmental Protection Order.
