Terms and Conditions for Contestants participating in the Contest

"Premiumtime Stories"
1. General
a. The contest Premiumtime Stories (Contest) is organized by Deutsche
Lufthansa Aktiengesellschaft, Von-Gablenz-Strae 2-6, D-50679 Cologne
("Lufthansa").
b. In order to enter the Contest you must agree to the following Terms and
Conditions for Contestants.
2. Terms and Conditions for Contestants
a.

Only persons of age 18 and over who are situated in the countries
listed in Annex 1 to these terms and conditions (Contestants) may
enter the contest. Participation in the contest is possible via Instagram,
Twitter, Facebook or Iconosquare. In order to participate via
Instagram, Twitter or Facebook the Contestant needs a profile on one
of these platforms. The guidelines and terms and conditions of the
various providers apply in such cases.

b.

The Contest has nothing to do with Facebook and is in no way


sponsored, supported or organized by Facebook. Lufthansa (and not
Facebook) is recipient of the information provided. Lufthansa will use
the information provided solely for the purpose of the Contest and will
delete this information after completion of the Contest.

c.

Employees and the family and relatives of Lufthansa and its


subsidiaries and associated or involved companies in the Contest are
not eligible for participation.

d.

Participation in the Contest is free of charge. The chances of winning


and participation are independent of the purchase of goods or services.
The costs of the internet connection or the costs incurred by using the
services of a mobile telephony provider shall be borne by the
Contestant.

e.

The Contestant is responsible for the accuracy of the contact data


supplied. Personal data and the corresponding account data of third
party providers (Twitter, Instagram, Facebook) must be true and
accurate.


3. Prizes and organization of the contest
a. As prize Lufthansa is offering 3 x return intercontinental flights operated
by Lufthansa for 2 travelers in the Premium Economy Class to a Premium
Economy Class destination of the Contestants choice from/to Frankfurt a.M.
(subject to availability of PE N-Class flights, flights only, transfer to/from
airport, accommodation, meals, etc. are not included; must be a LH-operated
flight, no codeshare). Important: All travel must be completed by
30.09.2015. The winners will be notified of the separate terms and
conditions for the flight.
b. The Contest runs from 7 November 2014 until 4 December 2014.
c. In order to take part in the Contest Contestants must send in a photo of
how they spend their premiumtime during the time of the contest (photos
and all other content submitted by Contestants are further referred to as the
Content). There is no limitation on how much content each Contestant may
submit. The Content shall be sent solely under the following conditions:

via Iconosquare (http://iconosquare.com/contests/lufthansapremiumtime)


via the app on Lufthansa's Facebook fan page, following the upload
instructions and upload functions.
Direct Content uploads on the Lufthansa Facebook fan page are not
allowed to participate.
via Instagram with the hashtag #premiumtime
via Twitter with the hashtag #premiumtime and @Lufthansa

d. Only Content that has been correctly submitted and published on


Lufthansa's Iconosquare page are eligible for consideration in the Contest.
4. Processing the winning results
a. Lufthansa will carry out the Contest and have the winners drawn by a
panel of judges at the end of the Contest. Criteria for selecting the winning
Content are: visual appeal of the picture and the source of inspiration.
The winner will be notified by email or by a direct message on the third-party
provider such as Instagram, Twitter or Facebook on December 8, 2014 and
must confirm the prize within 2 weeks in writing via email. The winner will be
requested to provide an email address. Lufthansa will deliver by email with a
booking code and further booking procedures.
b. If it is not possible to deliver the prize, Lufthansa will be under no
obligation to make any further enquiries. The right to claim the prize also
lapses if it is not possible to deliver the prize within two weeks of the winner


first being notified of having won the prize for reasons for which the winner
can be held responsible. The Contestant's right to claim the prize also lapses
if the prize cannot be correctly delivered because faulty data has been
provided. If the prize cannot be delivered, the jury will select a second
winner and inform them about its win.
5. Data protection and security
a. The personal data requested (email address, address, last name, first
name, age) will be collected solely in order for Lufthansa to carry out the
Contest. The data will not be transmitted to additional third parties.
b. The Contestants' data will only be stored for the purpose of the Contest
and as long as the Contest lasts and will be deleted once it is over unless
there is a legal obligation to preserve the data.
c. Contestants may object to the use of the data and its storage at any time
by sending an email to socialmediateam@dlh.de. In this case all of the
Contestant's data will be deleted and the Contestant will be excluded from
the Contest.
6. Responsibility for the Content
a. By uploading the Content the Contestant declares that he has all rights to
the Content (including in particular image material and text), is not infringing
any third-party rights. The Contestant declares that he and any persons or
localities depicted, is/are in agreement with the publication of the Content
and all information provided is true. The Contestant shall indemnify
Lufthansa irrevocably and for an unlimited period of time from all third-party
claims as detailed in chapter 8.1.d of these Terms and Conditions for
Contestants.
b. The Contestant is solely responsible for all Content which the Contestant
uploads or publishes. Content which the Contestant has not created himself
or for which he does not have adequate authorisation may not be uploaded
and published as detailed in the below paragraphs.
c. In entering the Contest the Contestant undertakes to comply with
statutory or official requirements, to respect any conflicting rights of third
parties (particularly copyright, trademark rights or personal rights) and to
observe these Terms and Conditions for Contestants. When publishing
Content the following is particularly prohibited:
The publication of personal information about third parties such as name,
address, telephone number, occupation or email address
The publication of correspondence by email or letter or of business secrets


The linking and/or publication of material or contents that are immoral,
pornographic, liable to corrupt young people or that glorify violence
and that promote or glorify hate, violence or racial discrimination
Any violation of applicable laws or calls to break the law or creating links to
any posts to this effect
The publication of untrue assertions, insults or abusive criticism or the use
of vulgar or obscene language and a disrespectful, provocative and
aggressive attitude towards other members or third parties.
d. Lufthansa reserves the right to block any Content that is not in accordance
with these Terms and Conditions at any time without prior announcement,
not to keep them online and not to pass them on. However, this shall not
entail any obligation for Lufthansa to verify the accuracy, completeness or
legality of the Content posted by the Contestants.
e. All Content shall be the sole responsibility of the person who has posted
them into the network or who has transmitted them via the network and
they are not the responsibility of Lufthansa.
f. Lufthansa disassociates itself from the links on this website and the
associated Content of third parties and is not therefore responsible for such
Content. The terms and conditions of use of the third party providers shall
apply.
7. Intellectual Property Rights and Rights of Use
a. By uploading Content, the Contestant grants Lufthansa a perpetual, nonexclusive, transferable, free of charge, worldwide license to use, copy, quote
and depict in public the Content for commercial, advertising or other
purposes in association with Lufthansa. At the same time the Contestant
warrants that he is entitled to grant such a license. The granting of the
license cannot be revoked by the Contestant.
b. The Contestant promises to neither imitate nor duplicate the Content nor
to sell or disseminate them or to make them available to third parties.
c. Furthermore, the contestant grants the Lufthansa the non-exclusive right
to publish the contestant's profile unless the contestant has made this profile
invisible.
d. Lufthansa is furthermore entitled to alter the formatting or the
presentation of the Content so as to enable their user-friendly and smooth
use and provision. Furthermore, Lufthansa shall have the right to carry out
quality checks and to make technical and legal analyses.


e. By uploading the Content the Contestant is in agreement with and gives
the Lufthansa the right to use and publish the Content on other platforms of
the Lufthansa as well as to make them available to further users.
8. Liability
a.

Lufthansa and its legal representatives and vicarious agents shall only
be liable for damage suffered by the Contestant if such damage has
been caused with intent or through gross negligence by Lufthansa, its
legal representatives or its vicarious agents. This limitation of liability
shall not apply to damage caused by injury to life, limb or health.
Furthermore, it shall not apply in the case of a breach of fundamental
contractual obligations. In such a case Lufthansa's liability in terms of
the amount and on the merits shall be limited to damage that was
typical and foreseeable at the time when the use agreement was
formed. A fundamental contractual obligation is an obligation that
makes the proper performance of the contract at all possible and that
the other contracting party may regularly rely on being fulfilled.

b.

Lufthansa cannot guarantee that the promotion will be available at all


times. Lufthansa may also withdraw the Contest at any time. Lufthansa
excludes any liability for disadvantages or damage due to the Contest
not being available or being withdrawn.

c.

Lufthansa may in no way be held responsible for losses or damage


arising in connection with the contest or a transmission error or any
other difficulties, particularly of a technical nature (e.g. overloading),
or due to losses of data.

d.

In entering the Contest the Contestant indemnifies Lufthansa against


all claims, including claims for damages, that other users or other third
parties assert against Lufthansa due to their rights being violated by
the Content posted by the Contestant. This shall not affect any further
rights and claims for damages that Lufthansa may have.

9. Miscellaneous
a. It is not possible for the prize to be paid out in cash, exchanged for other
material assets and/or transferred to another person. In the unlikely event
that the prize should be unavailable, the Lufthansa reserves the right to
replace it at its own discretion by one of equivalent or higher value.
b. Lufthansa may amend these Terms and Conditions for Contestants at any
time. This shall particularly be the case if it cannot be guaranteed that the
contest will be properly carried out.


c. Lufthansa reserves the right to discontinue or cancel the competition at
any time and without advance notice if proper implementation of the
competition can no longer be guaranteed.
d. If individual provisions of these Terms and Conditions for Contestants
should be or become invalid, this shall not affect the validity of their
remaining provisions.
e. The Contest shall be governed solely by German law.

II. TERMS AND CONDITIONS FOR CONTESTANTS FROM USA AND
CANADA OFFICIAL RULES AND REGULATIONS FOR THE U.S. AND
CANADA
1. NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not
increase your chances of winning. This contest (Contest) is subject to
all federal, state and local laws and regulations. Void outside the United
States, Canada, in Puerto Rico, in Quebec and where prohibited by law.
2. ELIGIBILITY: All individuals who are legal U.S. or Canadian residents,
excluding Quebec, 18 years of age or older at the time of entry are eligible to
enter the Contest. Employees, representatives and agents of Deutsche
Lufthansa AG, (Sponsor), and their respective subsidiaries and/or affiliates,
members of their households (whether related or not) and their immediate
families (spouses, parents, siblings, children and each of their respective
spouses), Contest Judges, and anyone involved in the promotion,
development and handling of this Contest and any persons domiciled with
any of the above are not eligible.
3. CONTEST PERIOD: The Contest will begin at 10:00:00 a.m. Eastern
Standard Time ("EST") on November 7, 2014 and will end at 11:59:59 p.m.
EST on December 4, 2014. Entries will be accepted starting at 10:00:00 am
Eastern Standard Time ("EST") on November 7, 2014 and will end at


11:59:59 pm EST on December 4, 2014 (the Entry Period). An independent
judge will then review the finalists beginning at 12:00:01 a.m. Eastern
Standard Time (EST) on December 5, 2014 and will end at 11:59:59 p.m.
December 7, 2014 (the Judging Period).
4. PRIZES/ODDS: Three (3) Grand Prize winners will receive two (2)
Premium Economy Class return tickets on a Lufthansa operated flight to a
Premium Economy Class destination of the Grand Prize winners choice
from/to Frankfurt a.M. (subject to availability of PE N-Class flights).
Applicable taxes, fees, airport charges, and carrier surcharges, including the
September 11 Security Fee of up to $10 per flight segment are included in
the Grand Prize. The approximate retail value of the Grand Prize is US $
3.800,00 total; actual value may vary depending upon winners selection of
travel itineraries.
Grand prize tickets are subject to availability at time of booking and all travel
must be completed by 30.09.2015. Winner must specify date of travel at
time of booking and blackout periods will apply. Air travel arrangements
must be made through Lufthansa only and winner must provide all
information a minimum of twenty-one (21) days prior to their preferred
departure date. Reservations may only be made within 90 days of departure
date. Confirmation of requested travel date will be given 14 days prior to
departure and will be subject to availability at time of booking. Once booked,
travel arrangements may not be changed. The selected entrant and his/her
traveling companions must have the same origin and destination and must
travel together at all times. The Prize winner and their travel companion will
be responsible for all expenses not specifically stated as part of the Grand
Prize, including but not limited to, local transportation including air or ground
transportation to/from the winners home to a Lufthansa Gateway airport,
overnight accommodation prior to or following the travel dates in order to
accommodate flight connections, income taxes, insurance, passport and visa
costs, gratuities, meals, beverages, incidentals and any items of a personal
nature that are not referenced above. Cancellation insurance is not part of
the Grand Prize, but is recommended (must be arranged privately by
winner). In the event of denied boarding, no compensation due by Lufthansa
for costs directly or indirectly incurred. No mileage credit applicable. Winner
is responsible for procuring adequate documentation for European travel.
Prize must be accepted as awarded with no substitution. Grand Prize is nontransferable and cannot be redeemed for cash or credit, in whole or in part,
for any destination.
5. HOW TO ENTER AND WIN: During the entry period eligible participants

By successfully uploading a photo as directed, you will receive one (1) entry
into the Contest. There is no limitation on the number of entries which may
be submitted during the entry period.
By entering this Contest you acknowledge that you have read and
understood and agree to be bound by these Rules and Regulations.
In the event that the Winner is a Canadian resident, he or she must correctly
answer, without assistance of any kind, whether mechanical or otherwise, a
timed mathematical skill-testing question to be administered by Sponsor at
the same time the entrant accepts the terms and conditions. In the event
that the potential Winner cannot successfully complete the skill-testing
question within the time specified by the Sponsor, then this will result in the
disqualification of the entry.
6. ENTRY CONTENT AND PARAMETERS. The Sponsor will review all submitted
Entries and reserves the right in their sole and absolute discretion to reject,
disqualify and/or remove any Entry that violates these Official Rules or is
otherwise inappropriate without any notification or warning.
All of the Rules and Regulations as described herein apply to the format of
the Entry submission. By submitting an Entry, the Entrant understands and
grants to the Sponsor permission for his/her Entry and other Entrant
information to be posted on Facebook, Twitter, Instagram and Iconosquare
throughout the world for viewing by visitors to the Website and used in
accordance with the Official Rules. Sponsor reserves the right to post sample
photos it has created in connection with the Contest on Facebook, Twitter,
Instagram and Iconosquare. Sponsor does not guarantee the posting of any
Entry.
All Entries must comply with the following minimum guidelines to be eligible:

Photo cannot contain content that is irrelevant to the purpose of the


Contest.
Photo cannot be profane, pornographic, sexually explicit or suggestive or
contain nudity.
Photo cannot be violent or promote firearms/weapons.
Photo cannot promote illegal drugs or tobacco.
Photo cannot defame, misrepresent or contain disparaging remarks about
people, brands or companies.
Photo cannot be obscene or offensive, endorse any form of hate or hate
group or be derogatory to any ethic, racial, gender, religious, professional
or age group.
Photo cannot explicitly promote or endorse copyrighted names, likenesses
or other indicia identifying any person, living or dead, without permission.
Photo cannot communicate messages or images inconsistent with the
positive images and/or goodwill to which Sponsor and Facebook wish to
associate.
Photo cannot depict illegal activity and cannot itself be in violation of any
law.
Photo cannot in any way reference persons or organizations without
written permission from any person or organization whose name is used.

Entries must be the sole, original work of the entrants. Modifying, enhancing
or altering a third party's pre-existing work does not qualify as an original
work. In such an event, the entries will be disqualified from the Contest. All
entries become the property of the Sponsor. Entrants and winner
acknowledge and agree that their entries become the property of the
Sponsor, which thereby has the right to edit, adapt, modify, reproduce,
promote and otherwise use entries in any way they see fit. Any entry not in
compliance with the above and which does not meet the requirements of
these Official Rules will be disqualified. By entering, you agree to waive any
rights you may have to the entry submitted. If there are other people
depicted in your entry, you must make them aware you are entering the
photo in the Contest and they must provide their consent. Sponsor may
require that consent in writing, in our sole discretion.
In addition to the above, each Entrant submitting a photo to the Contest
agrees to the following intellectual property permissions:

Specific Permissions Granted to Lufthansa


I do hereby declare and warrant that I am the copyright owner of the photo
or other material (hereafter referred to as the Photo or Intellectual
Property) which I am hereby submitting to Lufthansa.


I hereby grant a non-exclusive license to this Intellectual Property (the IP
License) to Lufthansa and its agents to reproduce the photo, and I represent
that I have the legal right and authority to grant such IP License.
I understand the copyright laws pertaining to the ownership and
reproduction of Intellectual Property, and I am also aware that large
monetary penalties may be assessed against me for illegally copying photos
or Intellectual Property without the written permission of the copyright
owner. I agree to indemnify and hold harmless Lufthansa, and their agents
from any and all liabilities, damages and expenses (including reasonable
attorneys fees) that may occur as a result of my submission of these photos,
including any and all claims by any third parties claiming ownership or
interest in the Intellectual Property submitted.
I understand that this IP License that I have granted is a perpetual license
with no termination date.
By legally granting such IP License, I verify that I have read and agree to the
Rules and Regulations.
Proof of sending will not be deemed to be proof of receipt. No other form of
entry will be accepted. Any person who attempts to participate with multiple
e-mail addresses or Facebook accounts, under multiple identities, or uses
any device or artifice to enter multiple times in violation of the preceding
entry limitation will be disqualified. Any use of robotic, automatic, macro,
programmed, or like (online) entry methods will void all such entries by such
methods and result in disqualification of any entrant using such methods.

7. CONTEST JUDGING: The Contest Entries will be judged by the Contest


Judge, an independent judge, from the entertainment and marketing
industry, appointed by the Sponsor, who shall use criteria set forth herein to
determine one (1) Grand Prize Winner.
Entries will be graded based on the following pre-determined set of criteria:
a) visual appeal of the photo b) source of inspiration. Decisions of the
Contest Judge are final and binding. Status as a Grand Prize Winner will be
subject to verification of eligibility and compliance with these Official Rules.
8. GRAND PRIZE WINNER NOTIFICATION & ANNOUNCEMENT Grand Prize
winner will be notified by email within two (2) business days of
determination. In the notice, an Independent Agent will provide all necessary
documentation that the winner must execute before being entitled to redeem
their prize, including an Affidavit of Eligibility, a Liability Waiver and where
allowable, a Publicity Release (collectively, the Release Documents), which


must be signed and returned within Five (5) days of notification. If the Grand
Prize winner does not respond within Five (5) days of notification or if the
selected winner does not comply with the Contest Rules and Regulations,
that entrant forfeits any right to the Grand Prize and an alternate winner will
be selected by the judging panel.
The selected entrant may be requested to provide Lufthansa with proof that
he/she is the authorized account holder of the Twitter account, Facebook
account or Instagram account, phone number or e-mail address associated
with the winning entry and will be required to furnish proof of eligibility
(including, without limitation, proof of United States residency, and age of
Entrant and Dependant Child) as a condition of receiving the Prize. In a
dispute, the authorized account holder of email address will be declared the
winner of the online Contest.
The Grand Prize Winner will be announced on, December 8, 2014 and their
Entry, along with their name, will be posted on the Promotion Site for an
indefinite period of time.
9. PRIZE CONDITIONS AND LIMITATIONS: Prizes are not transferable or
assignable. No substitution or cash redemption allowed except by Sponsor,
who may substitute a prize of equal or greater value at its sole discretion if
advertised prizes become unavailable. Winners are responsible for all federal,
state, local and income taxes associated with winning prizes and reporting of
other expenses related to the use, acceptance and possession of prizes.
Winners of a prize valued at $600 or more will be required to furnish
his/her social security number for the sole purpose of preparation of
any tax forms as required by law. An IRS 1099 Form will be filed on
behalf of the winner for the retail value of any prize of $600 or more.
10. Lufthansa is not responsible for failure for any reason whatsoever of the
selected entrant to receive notification. Arrangements for the fulfillment of
the Prize will be handled by Lufthansa. Lufthansa reserves the right in their
sole discretion to substitute any and all part of the Prize with a Prize of
comparable value.
11. In order to be eligible to win any of the offered Prizes, the selected
entrant must authorize Lufthansa to announce and publish his/her name and
location in any publicity. In addition, the selected entrant will be required to
sign a declaration of compliance with the Contest Rules and Regulations and
one or more releases to obtain the Prize.
12. Lufthansa is not responsible for any injury or damage to entrants or any
other persons computer system, property or anything stored on or related
thereto as a result of participation in, or connection with, this Contest and
entrant hereby releases Lufthansa from all liability in connection with the


Contest and any Prize won. The selected entrants must, in order to be
eligible to win the Prizes, sign a discharge of liability form acknowledging
non-responsibility of Lufthansa in respect to injuries, accidents, loss, or
misfortune relating to the drawing and/or the awarding of the Prizes. Failure
to comply with all the Contest rules or to sign and return any of the release
forms will result in disqualification and selection of an alternate random
winner. A selected entrant will be declared a winner only after meeting all of
the above terms and conditions.
13. Lufthansa is not responsible for error, omission, interruption, deletion,
delay in operation or transmission or unauthorized access to or alterations of
the Contest, or for technical, equipment, network, electronic, computer,
hardware or software malfunction or inaccurate transmission of or failure to
receive entry by Lufthansa, even if it affects ability to enter or entry into this
Contest. Lufthansa is also not responsible for lost, stolen, misdirected,
delayed, destroyed or illegible entries. All submissions become the property
of Lufthansa and will not be returned.
14. The decisions of Lufthansa for the winners will be final and binding. By
participating, entrants agree that they have read, understood and agree to
these Contest Rules and Regulations and release Lufthansa from all liability
in connection with the game and/or any Prize. All Prizes are subject to all
applicable Federal, State and Municipal taxes which are the responsibility of
the winner.
15. Lufthansa reserves the right to amend or terminate all or any portion of
this Contest at any time without prior notification. Lufthansa reserves the
right to substitute a Prize of equal or greater value in the event of nonavailability of the Prize for any reason. Void where prohibited.
16. GOVERNING LAW: This Contest shall be governed by the laws of the
State of New York, USA (without regard to principles of conflict of laws), with
venue and jurisdiction Nassau County, NY and all claims must be resolved in
the courts located in Nassau County, NY, except as required by law.
17. The Grand Prize may not be combined with or applied to other
certificates, promotions or special offers, including, but not limited to;
upgrades, government fares, tour/travel packages, group,
convention/company meetings fares, bereavement, companion fares, senior
citizen discounts, corporate agreements, student fares, child fares, travel
industry discounts, internet fares, frequent flyer programs or any
unpublished programs.
19. SPONSOR: Deutsche Lufthansa Aktiengesellschaft, Von-Gablenz- Strae
2-6, D-50679 Cologne (hereinafter called Lufthansa or organizer).
