Summary of the Facts: For Possession of Illegal Drugs

(Statement of the Accused)

On the afternoon of June 17, 2010, accused, with his friend went to
Barangay Sta. Rita in Paoay, Ilocos Norte to bet in a derby cockpit in
the village. At two in the afternoon, he and his friend is about to go
home when a group of PAIDSOTG hinder their motorcycle (wave type)
along the way and announced a search. Suddenly, the team PAIDSOTG
showed

brown

leather

wallet

with

grams

of

shabu

inside

it,

alleging that it came from the accused pocket.

The exact words, according to the accused, the PAIDSOTG said bagim
daytoy la, wallet mo daytoy, and then opened the wallet with shabu
in a plastic bag.
The members of the PAIDSOTG immediately apprehended the accused. His
friend successfully flew away upon search. Accused was brought into
the

custody

of

Police

in

Paoay.

According

to

the

accused,

upon

reaching the precinct, the chief of police hand-in the officers a two
thousand (P2, 000) pesos that would be used as mark money for the
by-bust operation. The officers immediately took it and marked it as
mark money.
Accused said he never used wallet at all, that, he does not possessed
any wallet at the time of the operation and he does not own the wallet
where the shabu was found. He does not even saw the wallet in his
entire life.

His exact words are: Diak agus-usar ti wallet maam. Haan ko nga bagi
daydiay, ket nu idik la a makita daydiay nga wallet. Diak pulos agususar ti wallet.
Accused, now in the custody of Batac City Jail is 28 years old, single
and

native

of

Paoay,

Ilocos

Norte.

He

has

been

previously

apprehended of the possession of Illegal drug paraphernalia in roads

of Badoc, Ilocos Norte by virtue of a check point. Accused said, he
came from a drinking session in a friends house that day and rode a
single motor (wave type) with a friend going home when they saw a
check point coming their way. Being the driver, he turned his way back
fearing that the police officers might search something from them. On
their way, accused and his friend disposed some drug paraphernalia;
however,

police

officers

having

malicious

action

as

ground

are

coming their way for apprehension. When they were apprehended, police
officers found a tube on the accused pocket.
The

accused

statements

were

concise

and

with

precision.

He

never

manifested signs of nervousness and unlikely mannerisms. He is very

relaxed in talking and does not show a bit pressure in answering the
questions.
During the interview, questions were kept repeated but the accused
gave in the same answers and statements.
