26.2 Classification, Labelling and Preventive Safety Data Sheet for Chemicals
26.2.1 Chemical used in the workplace must be classified depending on the hazards to workers safety and health, in accordance
with the criteria established by GHS.
26.2.1.2 The classification of dangerous substances shall be based on a harmonized classification list or on the performance
of tests required by the classification process.
26.2.1.2.1 In the absence of a national harmonized classification list of dangerous substances, an international list
may be used.
26.2.1.3 Aspects concerning the classification must meet the provisions in the current official technical standard (3).
26.2.2 The preventive labeling of a chemical classified as hazardous to workers health and safety must use procedures defined by
GHS.
26.2.2.1 Preventive labeling is a set of elements with written, printed or graphic information, related to a chemical, which
must be affixed, imprinted or attached to the package containing such chemical.
26.2.2.2 Preventive labeling should contain the following elements:
a) Chemical identification and composition;
b) Pictogram(s) of danger;
c) Word of warning;
d) Sentence(s) of danger;
e) Sentence(s) of precaution;
f) Additional information.
26.2.2.3 Preventive labeling must comply with the provisions in the current official technical standard (4).
26.2.2.4 Chemicals not classified as hazardous to workers health and safety as in GHS must have a simplified preventive
labeling that contains, at a minimum, the name, the statement that it is not classified as a hazardous product and
precautionary recommendations.
26.2.3 The manufacturer or, if imported, the supplier in the domestic market must prepare and make available the SDS of the
chemical for every dangerous chemical product.
26.2.3.1 The format and content of the chemicals SDS must follow the established by GHS.
26.2.3.1.1 In the case of mixture, there shall be explicit in the SDS the name and concentration, or concentration
range, of the substances that:
a) are dangerous to workers health, if present in concentrations equal to or greater than the cut-off
values/concentration limits established by GHS for each danger class/category; and
b) have established occupational exposure limit.
26.2.3.2 The aspects relating to the SDS should meet the provisions in the current official technical standard (5).
26.2.3.3 The provisions of section 26.2.3 also apply to chemicals not classified as dangerous, but whose uses give rise to
risks to workers health and safety.
26.2.3.4 The employer must ensure workers' access to SDS for chemicals used in the workplace.
26.2.4 Workers should receive training:
a) to understand chemicals preventive labeling and SDS.
b) about the dangers, risks, preventive measures for safe use, and procedures for action in emergency situations with the
chemical.
