LEAVE & LICENSE AGREEMENT

THIS LEAVE AND LICENSE AGREEMENT is made on 1st-Feb-2015


BETWEEN MR. MAHESH L RAMPALLI , Adult ,aged about 28 years inhabitant
of Mumbai Residing at : Bldg No 22, Room No. 346 ,Kannamwar Nagar No.1
,Vikhroli (E) , Mumbai 400 083 (Mobile - 9773454324).Hereinafter called and
referred to as the THE LICENSOR/OWNER (Which expression shall mean and
include his legal heirs,executors, administrators and assigns) of the ONE PART,
AND MR. KIRAN P ,Adult, aged about 30 years, Indian Inhabitant of Puthezhath
House, Karamuck Kandassanka Davu P.O,Thrissur ,Kerala - 680613 (Mobile No .
7738828962 ) works for VVF India Ltd (Sion) hereinafter called and referred to as
the LICENSEE of the SECOND PART.
WHEREAS the Licensor is the lawful Owner of Bldg No. 22 ,Room No .
346,Kannamwar Nagar No.1,Vikhroli (E) ,Mumbai 400 083(Hereinafter referred
to as the SAID ROOM PREMISES)
AND WHEREAS the Licensee approached the Licensor and made a request to
allow him to use and occupy the said premise on LEAVE AND LICENSE basis
from 1st Feb 2015 to 31st Jan 2016 (Both days inclusive in the terms and
conditions hereinafter mentioned)
AND WHEREAS the Licensor considering the need and request of the Licensee
agreed to allow and permit to the Licensee to use and occupy the room
premises temporarily for a period of 11 months on the basis popularly known as
Leave and License Basis on the terms and conditions mutually agreed upon by
and between the parties herein as under
THE TERMS AND CONDITIONS ARE AS FOLLOWS :
1) That the Licensor shall at these execution allow and permit to the Licensee
and grant him License to use and occupy the said room premises for the
propose temporarily for the period of Eleven (11) Months from 1st Feb
2015 to 31st Jan 2016 on Leave and License basis.
2) The Licensee has /have paid a sum of Rs.75,000/-(Rupees One Lakh Only)
as and by way of Security deposit for the due performance of the terms
and conditions of this agreement and refundable without interest to the
Licensee at the expiry of this agreement after deducting the dues if any
payable by the Licensee in the afore said terms which amount of security
deposit the Licensor both hereby acknowledges to have received from the
Licensee in the afore said terms.
3) The Licensee do hereby agree and assure: a) That the Licensees herein
shall pay the electricity charges, from time to time as and when same
become due and payable and shall handover the paid bills to the Licensor:
b)To take reasonable care of all singular the said premises and shall
indemnify the Licensor from and against any damage or loss, other than
by ordinary use and occupation thereof.

4) The Licensee shall pay the monthly compensation mutually agreed and
fixed at Rs.15,000/- (Rupees Fifteen Thousand Only ) for period 1 st Feb
2015 to 31st Jan 2016 towards the use and occupation in respect of the
said premises on or before the 30th of each calendar month.
5) That the Licensee shall not use and occupy the said room premises for the
purpose other than he is hereby allowed and permitted and also the
Licensee shall not use the said premises for any unlawful act and
purposes.
6) That the Licensee shall not claim any right and interest whatsoever by way
of tenancy or sub-tenancy in respect of the said premises and /or any part
and portion thereof and he the Licensee shall only use and occupy the
same as a Licensee for the said purpose for the period mentioned herein
and /or at the will of the Licensor.
7) That the Licensee shall not change the user of said premises by raising
high and extending the size of said premises and he shall not cause any
nuisances and noise at the said premises which may disturb the peaceful
living of the neighbouring people.
8) That the Licensee shall not detain and / or with him the possession of the
said room premises even or a day at the expiry of this agreement and in
case of such detention the Licensee shall be liable for all that loss and
damages thereby caused to the Licensor
9) It is also agreed by and between the parties that either of the parties shall
have right to terminate the agreement by giving Two Months Notice in
oral/writing to the other party.
IN WITNESS WHERE OF the parties hereto have hereunto set and
subscribed their respective hands and signs the day and year first
hereinabove written
