MANILA,PhilippinesTheBureauofInternalRevenue(BIR)isnowafterestatetax
delinquentsinordertoaddresstaxleakagesfromthesector.
SpeakingtoreportersatanewsconferenceattheDepartmentofJustice(DOJ)onThursday,
BIRCommissionerKimHenaressaidthereisaneedtorunafterthosewhodonotpaytheir
estatetaxes,stressingthatsince2005,annualcollectionsfromestatetaxhasbeenhittingan
averageofmerelyP850millionnationwide.
"There'sreallysomethingamiss...that'stheonethingthathasalwayscaughttheattentionof
theSecretaryofFinance(CesarPurisima)since2005.Yunangnakapagtataka,naparang
hindigumagalawdoon,naparangmayisangstopper.'Pagumabotsiyadoon(P850million),
hindinasiyagumagalaw,"Henaressaid.
"Ifyousay[since]2005,thevalueofpropertiesandmoneyhasbasicallydoubledsosiguro
namanreasonably,kungmagdoublekarinsaestatetax,it'sareasonableestimate,"she
added.
TheBIRfiled2estatetaxevasioncasestodaywiththeDOJoneagainstseveralheirsof
anestateinPangasinan,andanotheragainsttheheirofacouplewhoownslandinRoxas
Blvd.,PasayCity.
CasevsVinluanestateheirs
Acriminalcomplaintfor2countsoftaxevasion,1countoffailuretofileCapitalGains
Tax(CGT)return,1countoffailuretofileDocumentaryStampTax(DST)return,and1count
offailuretofileestatetaxreturnwasfiledbytheBIRagainsttheheirsofacertainGavino
VinluanofPangasinan.
Therespondentsare:PilarGonzales,PuritaCanto,FedericoVinluan,RamonVinluan,
SalvadorVinluan,ConchitaCalvo,HernandoVinluan,GavinoVinluan,HeremiasVinluan,
SocorroGabionza,IsraelVinluanandEstrellaSantiago.
TheywerefoundliabletopayCGTamountingtoP7.40million,andDSTamountingtoP1.86

million,inclusiveofsurchargesandinterests.ThisbringstheirtotaltaxliabilitytoP9.26
million.
Atty.MelvinCastro,DeputyRegistrarofDeedsofLingayen,Pangasinanwasalsoincludedin
thechargeforallegedviolationofSec.258(E)oftheNationalInternalRevenueCode(NIRC)
forallowingthetransferofownershipofthesubjectparcelsoflandwithoutaCertificate
AuthorizingRegistration(CAR)fromtheBIRcertifyingthatsuchtransferhasbeenreported
andthattheCGThasbeenpaid.
BasedonaninvestigationconductedbytheBIR,thelateGavinoVinluandiedonFebruary4,
1949,leavingbehind25propertiesandlandholdings.However,theBIRclaimsnoestatetax
returnwasfiledfollowinghisdeath.
Vinluan'sheirsexecuteda"DeedofExtrajudicialPartitionamongHeirswithSale"onAugust
28,2009conveying2parcelsoflandinBgy.Bolo,Labrador,Pangasinanwithatotalareaof
358,966squaremeters.TheBIRallegedthatnoCGTandDSTreturnswerelikewisefiled
andnotaxpaid,thus,noCARwasissuedbythebureau.
HenaressaidthatdespitethenonpaymentoftaxesandnonissuanceofaCAR,respondent
Castrosignedtheannotationonthesubjectdeedandmadeitappearthatthedeedwas
includedintheDayBookofRegistrationofDocumentswhen,infact,theentryallegedly
referstoacompletelyunrelatedBarangayCertification.
Castro'ssignaturewasusedasbasisbytheOfficeoftheProvincialAssessorofPangasinan
intransferringthepropertiesthroughtheissuanceofnewtaxdeclarationsinthebuyers'
names.
Casevs.Ongsiakoheir
TheBIRfiledaseparatecaseagainstacertainJuanMiguelOngsiakoofDasmarinasVillage,
MakatiCityallegedlybecauseofhisparticipationinthesale/transferofownershipofaparcel
oflandbelongingtotheestateofhisfather,OscarOngsiakodesignedtoevadethepayment
ofthecorrespondingestatetax.
RespondentOngsiakowaschargedwith1countofwillfulattempttoevadeordefeat
paymentofestatetax,1countofwillfulattempttoevadeordefeatpaymentofDST,and1
counteachforwillfulfailuretofileestatetaxreturnandDSTreturn,andfailuretopaytax.He
wasalsochargedwith1countofwillfulattempttoevadeordefeatpaymentofCGT,and1
countofwillfulfailuretofileCGTreturn,andfailuretopaythecorrespondingtax.
TheBIRplacedhisestatetaxliabilityatP3.65million,CGTayP5.11million,andDSTat
P1.30million.
HenaresbaredthatownershipofthesubjectparceloflandwastransferredtoOngsiakoby
theRegisterofDeedsofPasayCitywithoutanyCARwhichwouldsupposedlyprovethatthe
requiredCGTandDSTreturnshadbeenfiledandthecorrespondingtaxespaid.
HenaressaidthesaleofthesubjectlandtoOngsiakofromhismother,Nori,whodiedin
2008,was"partofaschemetotransfertheassetsofOscarOngsiakotohisheirwithoutfiling
therequiredestatetaxreturnandwithoutpayingtheestatetaxdue.This,Henaressaid,is
alsopartofaschemetoavoiddiscoveryofthedeathofOscarOngsiako.

Meantime,RobertGuillermowasalsochargedinhiscapacityasRegistrarofDeedsofPasay
City.TheBIRsaidGuillermo"turnedablindeyeandissuedthenewtitlewithoutindicating
theCARserialnumbertodecreaseprobabilityoffrauddetection."
ThecasesagainsttheVinluanheirsandOngsiakoarethe77thand78thfiledbytheBIR
underitsRunAfterTaxEvaders(RATE)programundertheAquinoadministration.
