scholars are trying to complicate by
un-necessarily raising hue and cry.
And let them beware who, ... and
soon they shall roust in the Blaze.

The Quranic Mode of Training


Reminds each one of us that we
have to die one day and it is quite
possible that we may leave behind
young children. How would we like
our children to be treated? The very
same way we must treat those
orphans who helpless today. Each
one of us must fear Allah-SWT ,
knowing that He-SWT is the
Mightiest of all and can put us
through such trials. Therefore, one
must act very wisely and kindly in
such a situation. Remember that
whoever usurps the wealth of
orphans fills his belly with fire and
shall be soon condemned to Hell.

Some scholars consider this a


figurative expression but this is not
so. In fact the human activity earns
twofold results simultaneously i.e.
the mundane and the eternal. In this
case the worldly result of such
usurpation is that the hunger is
satiated, but the eternal
consequence is that the belly is
being filled up with fire. The Holy
Prophet-SW said that some people
would be resurrected in such a state
that flames and smoke would be
seen emitting from their mouths,
ears and noses. Although one fails to
see this fire here with the visible eye,
but it does have an impact. Such a
person is never peaceful and happy
in this world, and is condemned to
torture and misfortune in the
Hereafter.
May Allaah-SWT protect us
against such misfortunes, and give
us the strength to refrain from
actions that lead to His-SWT
annoyance!n

ere is a point to ponder for


those scholars or religious
leaders who, for worldly
gains and pleasures, are exploiting
the masaajid, religious schools and
sermons etc. What a wistful situation
it would be, that such leaders and
scholars would be doomed to ill fate
for earning unlawfully; while many of
their followers who learnt from their
sermons, and practised
righteousness would be duly
rewarded in the Hereafter. May
Allaah-SWT protect us from being
disgraced in the Hereafter and may
He-SWT bless us with His-SWT
Favour and Grace!
To males shall be portion of... and
speak to them a word of kindness.

The Law of Inheritance


Although wealth is not at all unimportant yet it is not so valuable that
for its acquisition the rights of others
be ignored. Like in the pre-Islamic
days, women and minors were not
considered as heirs at all. Only the
grown up male children would get
something, otherwise the entire
inheritance was taken away by other
heirs. Another practice was to
exempt items like horses, swords,
armours and similar things from
division amongst heirs. Islam solved
this matter beautifully. Shares were
specified for male and female
whether they be young or old, in the
estate left behind by their parents or
close relatives. Each and every

belonging of the deceased must be


portioned amongst the heirs, be it big
or small. These portions are
determined by Allah-SWT . The
recipient's acceptance is not a
prerequisite, since the heirs become
the lawful owners automatically.
They may, however, give away their
parts of the share as gift or distribute
the same amongst those they
please. Inheritance emanates firstly
from parents and secondly from
other relatives, whether by marriage
or blood. The Laws of Inheritance
clearly declare that being merely a
relative does not necessarily make
anyone a legal heir, but being an
aqrab i.e. a near kindred, does.
When a deceased is succeeded by a
near relative, a distant relative would
not inherit anything. Those who
share the same-level of nearness to
the deceased are all heirs. They will
receive their shares as defined by
Allaah-SWT.If this was not the case
and all relatives were to be heirs, all
mankind would be heirs to one
another as all have a common father,
that is, Prophet Aadam-AS
Hadhrat Amir M'uawiyah-RAU
once received a message from a
person who claimed to be his brother
and wanted his share from the State
ruled by him. The Amir called the
claimant and enquired how he was
his brother? The person said that
wwe were both sons of Prophet
Aadam-AS'. Hadhrat Amir
M'uawiyah-RAU gave him half a

dirham. Surprised, he protested


against being awarded this farthing
out of such a big State. The Amir
advised him to leave quietly, lest the
other brothers came to know of it as
then he would not even get this. This
would have been the state of affairs,
had the law not been specific that in
the presence of near relatives,
di s t a nt r e l a ti o n s a r e o f n o
consequence. This rule applies to a
grandson also. A grandson does not
inherit anything from his grandfather
whether his father is alive or not.
Again, being needy does not make
anyone eligible for receiving
inheritance since it is very difficult to
prove who is more deserving than
the other. Secondly, the one who is
needy today might be well off
tomorrow and vice-versa.
The following Ayah caters for this
aspect by suggesting that those
relatives who are not legal heirs but
are present at the occasion of
division of inheritance, particularly
the orphans and the needy, should
be given something as a gesture of
kindness and should be treated with
dignity, and spoken to kindly. If
paternal uncles and aunts give
something to their orphan nephew
from their respective shares they will
receive great blessings and rewards
from Allaah-SWT.The nephew will
not only get a moral support but will
also he financially helped. In fact he
might end up getting more than
others. Above all, Allaah-SWT is the

Another '60 Minutes' hit job


on Social Security

Republicans in their ongoing
war on Social Security. In the fall of
2013, it was Sen. Tom Coburn's (ROK) attack on Social Security
disability, in which the news magazine
presented an entire segment without
talking to one single disabled person
or disability advocate and declared
that the program was "a secret
welfare system ... ravaged by waste
and fraud." In that case, the program
previewed sham report Coburn was
releasing. This weekend, they did it
again, previewing a Senate hearing
on the Social Security
Administration's massive database,
the "Death Master File," touting the
possibilities for fraud and abuse if
someone was either incorrectly
reported dead or the converse, died
and didn't show up on the file.

that reporter Scott Pelley and 60
Minutes bungled in this story, errors
that were compounded in the Senate
hearing it previewed. Among them the
basic starting point that this isn't the
f a u lt o f t h e S oc i al Se c ur i t y
Administration, at all.
Numerous studies by its own
inspector general and the
Government Accountability Office
suggest that for the Social Security
Administration to verify every report it
receives of 2.8 million American
deaths per year would be a Herculean
job.
Why? Because those reports
arrive from thousands of sources of
varying reliability across the country-funeral directors, family members,
banks, Medicare and Veterans Affairs
offices, post offices. Social Security
considers the most reliable source to
be electronic death records from the
states, but only 35 states submit
these to the agency. []
"60 Minutes" wrung its hands over
the nation's inability to compile totally
accurate data on deaths. Pelley
illustrated the issue by visiting
Alabama's Vital Records Vault, "a
place so secure that you need a key
and a fingerprint to get inside....But
once in here, the technology
becomes pretty 19th century." He
brandished a folder crammed with old
papers. "These are death certificates
from 1912, for example," he said in
dismay.
Egads! What were those 1912
people thinking, relying on paper to
report deaths?!?!? Did Pelley have
any idea how maybe the Social

possibly fund taking all those records
from 1912, for example, and digitizing
them? Of course not. As it turns out,
the actual waste, fraud, and abuse
occurring because of the difficulties in
keeping track of dead people in the
actual Social Security system of
payments is pretty insignificant in the
scheme of things, and in fact "the
problem of improper payments by
government agencies has absolutely
nothing to do with the Death Master
List. Beryl H. Davis of the GAO
testified that her agency identified
$124.7 billion in improper payments
for fiscal 2014. Of that, the Social
Security Administration accounted for
$3 billion."
Solutions from either 60 Minutes
or the Senate panel having this
hearing weren't at all the focus. For
example, many of the problems
reported were because of credit
agencies relying solely on this file that
the SSA explicitly "does not
guarantee the veracity of." Private
companies using this file should be
required to verify the information
before wrecking someone's credit
rating. Or perhaps Congress could
restore funding to the SSA, which it
has drastically cut, to give the Agency
the capacity to keep the list more
accurate. But neither 60 Minutes nor
the Republican Senate is interested in
accuracy or in keeping Social
Security strong.

of it as a project akin to German artist
Gunter Demnigs placement of
Stolpersteine, or stumbling stones.
Demnig has laid over 27,000 small
stones into sidewalks around Europe,
each inscribed with the words Here
lived and the name of someone
murdered during World War II
because of that persons religion,
politics, ethnicity or sexual
orientation. Demnig says he began
the project after encountering a
woman living near his home in
Cologne who insisted that there had
been no Roma in that area: She just
didnt know that they had been her
neighbors. Demnig decided to bring
the names of those dead home. His
efforts to fulfill what the French call the
duty of memory represent a small,
powerfully transformative linkage of
the horrors of the Holocaust to
presently lurking potentialities, as
new waves of fascism and neoNazism erupt across Europe.
At home in the United States,

there is similar forgetfulness about


important aspects of our own history.
Despite current popular conceptions,
for example, most lynchings did not
involve anonymous perpetrators and
anonymous victims melting into the
Southern Gothic obscurity of
moonless midnight swamps. As the
EJI report reminds us, lynchings were
more often horrific spectacles
extralegal yet entirely publicwith
photographers, refreshment vendors
and children drinking lemonade, with
illustrated postcards made and sent
openly in the mail and triumphal
distributions to the onlookers of ears,
penises and other charred body parts.
(My 99-year-old father still feels the
terror that shook him when his
parents read the newspapers aloud.
There was one almost every week,
he recalls.) Our American stumbling
stones might well be labeled Here
died to remind us that this history is
real, is part of us, whether were white,
black, a recent immigrant or
indigenous. It lives among our

families and in our neighborhoods; we


will be haunted by its shape until we
stop to name it, see it and bring it
home at last.
One of the women interviewed by
the EJI described her grandfathers
deathbed confession that he had
been part of a mob that had lynched
an innocent black man. My
grandfather carried this guilt all of his
life. Of course he never had to
answer for what he did. I wish I
knew the name of that lynched man, if
only so I could find out what happened
to the family that he left behind. The
ignorance among white people of my
generation (Im 48)is near total.
Nobody talks about it. Ever. But
knowing the traumatic landscape
from which we arise does not make
our polity weaker or less loved. To the
contrary, reminding ourselves of
collective sorrow is a gesture of
respect. We pause for the blood
spilled here and here and here.
We account and ask forgiveness. We
see.n

Our short historical memory is no accident.

he planet is aflame with the


killing of messengers. We can
barely keep score of the
assaults on memory: from Mosul to
Moscow to Dresden to Dhaka, the
destruction proceeds apaceof
ancient monuments, scientific
archives and schools, of journalists as
well as journalism itself. We, the
witnesses, expend a great deal of
breath and ink promising to never
forget. Yet both globally and locally,
in ways large and small, there is huge
resistance to even the smallest
reminders of injury: no one wants to
talk about trauma or privilege as the
invisible distributors of public costs
and private benefits today. No one
wants to bring it home.
In the United States, there has
emerged an alarming trend of
officially sanctioned oblivion. The
most jaw-dropping example was
Wisconsin Governor Scott Walkers
attempted removal of the words
search for truth from the 100-yearold mission statement of the state
university system. Walker also made
news when a BBC moderator asked
him if he believed in evolution. Ill
punt on that one, he said. I am going
to leave that up to you. Leaving it up
to you is also what Rand Paul would
do with public-health programs like
measles vaccinations: Parents own
the children, he un-reasoned. The

North Carolina recently eliminated the
C e n t e r o n P o ve r t y, Wo r k &
Op portuni ty; th e Center for
Biodiversity; and the Institute for Civic
Engagement and Social Change.
(Also targeted, but hanging on for

now, are the Carolina Womens


Center, the UNC Center for Civil
Rights and the UNC Institute on
Aging.) Legislators in Arizona have
actually banned outright Latin
American studies from public-school
curriculums. And the Kansas Board of
Regents has reserved the right to
fire any employee in the system,
including tenured professors, if they
publish anything on social media that
is improper, impairs harmony
.among co-workers or is contrary to
the best interests of the employer. In
Oklahoma, State Representative Dan
Fisher pushed a bill through the
legislature to slash public funding for
Advanced Placement history classes,
fearing that they are neither positive
nor Christian enough. His objection
was not that the curriculum was
inaccurate, but that the facts were
such a drag. (He wants AP history to
be inspiringall about American
except ional ism! An d the Ten
Commandments! Or, as Rudolph
Giuliani instructed President Obama:

Im happy for him to give a speech


where he talks about whats good
about America and doesnt include all
the criticism.
Recently, the Equal Justice
Initiative issued a real downer of a
report. The EJI has documented
lynchings around the country from
1877 through the 1950s, revealing a
higher number of these murders
(nearly 4,000) than have been
counted before now, even with the
study limited to only twelve states.
(The study focused on the Deep
South, in other words, and did not
extend to areas like Arizona, Ohio,
New Mexico, Michigan and California,
where African-Americans, Mexicans,
Chinese, Jews and Indians were also
lynched without consequence.

In Quest of Peace in Karachi

he process of restoring peace


in Karachi has begun.
The
writ of the state is being
established. But a lot needs to be
done to ensure that the state actions
remain above board and the drive
against anti-social elements is carried
out across the board.
A couple of things need to be kept
in mind:
1. Karachi being the commercial
hub, by and large, abhors extremism
in all its forms. So, if peace has to
return to Karachi, actions against antisocial elements of MQM would not
suffice. Religious and sectarian
extremism will have to eliminated at
all costs.
2. War against Taliban remains
unfinished, at least in Karachi. This
war cannot be left unfinished; and
3. The rule of law will have to be
established as a democratic norm
and once for all.
Obtaining such noble objectives
isn't possible if one organ of the state
show a lesser amount of commitment
towards achieving them. Political
parties are very essential part of the
democratic system. All political
parties believe in the National Action
Plan (against terrorism) evolved after
the December 16 mayhem at an army
public school in Peshawar.
Now, political parties cannot
disown this plan. Regardless of where
the terrorists are found and
irrespective of their cast and colour,
they cannot be spared for any political
expediency.
If this point sinks into
the heart and minds of our politicians,
they would hardly doubt the efficacy
of anti-terrorists campaign in Karachi.
But it is equally important for our law
enforcement agencies to avoid
becoming part of the situations that

can be widely perceived media trial of


a particular political entity, be it MQM
or any other party. That is very
important because Pakist an's
democratic system is still in early
stages of evolution. And, this early
stage of evolution requires very
careful handling of everything that
can have a direct bearing on the
future of democracy.
In Pakistan's context, allowing
democracy to mature requires
patience on the part of the judiciary,
armed forces and electronic and print
media. The judicial activism of the
former CJ Justice Iftekhar Chaudhry
had its own merits and demerits. Now,
superior judiciary has learnt a lesson
or two from their past and is moving
more carefully in the judicial matters
that have far-reaching political
fallouts.
Army, under former COAS Gen
Kayani had a different approach but
under Gen Raheel Sharif, a paradigm
shift is visible in the army's strategy
vis--vis terrorism.
As part of this strategy, criminal
elements are being flushed out of
everywhere-and political parties are

no exception!
So, going forward, Karachi's
peace will be compromised if MQM,
or any other political party for that
matter, tries to play victim in the
ongoing drive against terrorists and
hardcore criminals. People of
Karachi, all of them except those with
a criminal bent of mind, are genuinely
interested in restoration of peace and
order in Karachi. That is why, even if a
political party makes an attempt to
distort facts about the anti-criminal
operation, it won't be able to gather
any support.
In coming months, however,
ran ge rs' spe cif i c act i ons f o r
restoration of law and order in Karachi
would determine the quality of peace
that people of Pakistan want to see in
the commercial hub of the country.
Much would also depend on how the
provincial government of Sindh, run
by PPP, behaves. Hopefully, Mr.
Zardari won't mind when law
enforcement agencies move towards
Bilawal House, while still keeping the
Nine Zero in focus!n

believe their are many wise men in the
U.S. think-tank so they are not going
to take that risk. This was said by
Nazila Fathi, Iranian journalist and
author, speaking at Siena college in
Loudonville. Ms. Fathi, who from
2001 to 2009 was based in Tehran as

freedom, but they lost their personal
freedom after the revolution. She
stated that when Imam Khomeini
established power he eliminated

Alex Patel agrees to demolish


Central Avenue motels

LBANY, NY - Alex Patel,


owner of the Skylane and BluBell motels on Central
Avenue, accepted a deal to knock
down both motels in return for up to
$750,000 in fines and potential jail
time being dismissed.
Patels decision came more than a
year after both motels were shut
down by the town over what officials
claimed were hundreds of code
violations. Times Unin Staff writer
Keshia Clukey reported, she was in
Town Court for the case.
Its a positive outcome for
everyone, said Colonie Town
Supervisor Paula Mahan. Its been a
lot of frustration for a lot of different
people for a long time, but I think with
patience and working together and
looking at all options, I think weve

come to a very good resolution.


The case against him was
adjourned for six months while he
complies with the terms of the
agreement, said Town Attorney
Michael Maggiulli.
Patel must immediately apply for
demolition permits and pursuant
applications. Pending weather, the
possible need for asbestos removal
and working with National Grid, both
motels need to be demolished within
90 days or all charges automatically
will come back, Maggiulli said.

Colonie approves
law limiting
some motel stays

LBANY, NY - Guests will be


limited to 28-day stays in some
Colonie motels unless they
can prove they have permanent
ho usin g else whe re or get a
humanitarian exception.
The Town Board approved new
rules regulating motels with 60 or
fewer rooms. If the motels do not have
kitchenettes or dining facilities, most
patrons will have to leave after four
weeks.
Albany County Legislator Tim
Nichols passionately argued against
the law at the Town Board meeting,
saying it unfairly targeted the working
poor and would require children to be
forced out of school.n
