SB RESOLUTION NO. 014-2015

AUTHORIZING THE GRANT OF FRANCHISE FOR CALENDAR YEAR 2015 TO THOSE
FRANCHISE HOLDERS WHO RENEWED THEIR FRANCHISES IN THE YEAR 2014 BUT
FAILED TO REGISTER THEIR TRICYCLE UNITS AT THE LAND TRANSPORTATION OFFICE
LAST YEAR.

WHEREAS,

the participation of the GUIFTODA in crafting policies affecting the tricycle sector
had made it easy for the Local Government Unit of Guinobatan to encourage the
tricycle drivers and operators to help address various issues and problems
confronting traffic management in the municipality of Guinobatan;

WHEREAS,

due to extreme financial constraint suffered by some members of the GUIFTODA,

they were able to secure MTOP last 2014 but failed to register their tricycle for hire
at the Land Transportation Office;

WHEREAS,

these operators are members of the GUIFTODA, a recognize partner of the Local
Government in delivering public service particularly the delivery of transport
services to our constituents;

WHEREAS,

to terminate their franchises for above reason is equivalent to termination of their

source of income which is essential for their daily survival especially today that
many of them belong below poverty line;

WHEREAS,

in the spirit of social justice where President Magsaysay once said, Those who
have less in life should have more in law, this honorable body acts in their favor
for now but with a stern warning that this grant is being exercised with caution as
situations like this should not be repeated as tricycle operation being a public
conveyance must be operated with an extraordinary degree of diligence of a good
father of a family, hence, operating tricycle units without LTO license is illegal and

put the safety of our passengers at risk, which this honorable body must above all
take into account and guard against;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,

as it is hereby resolved by the Sangguniang Bayan in session assembled, to grant

as it hereby grants for humanitarian reason the renewal for 2015 of tricycle
franchises of franchise holders who renewed their MTOPs last 2014, but failed to
renew the registration of their tricycle units at the LTO in the same year.

RESOLVED FURTHER, that those concerned tricycle operators are given only 30 days from the
passage of this resolution to avail this privilege, otherwise, their franchises shall be
finally withdrawn and cancelled by the Sangguniang Bayan;
RESOLVED FINALLY, that a copy of this resolution be furnished the Municipal Mayor, Chief of
Police, the Chairman of the GTFRC and the GUIFTODA President for their
information and Guidance.
APPROVED UNANIMOUSLY, on motion of Hon. Councilor Rolando P. Palabrica duly seconded by
body this 26th day of January, 2015 during their 4 th Regular Session.
