Part C - Conditions of Tender

1.

Any conditions appended by the tenderer, which are at variance with the conditions set out below, shall invalidate the
tender.

2.

The sub-contract
The sub-contract to be entered into between the Main Contractor and the Sub Contractor shall be in terms equivalent to
those of the Standard Form of Sub-Contract dated 2006 issued under the sanction of the Pertubuhan Akitek-Akitek
Malaysia.
2.1

The terms, in so far as they apply to the sub-contract works, of the PAM Standard Form of (main) Contract which the
applicable non-Standard particulars are given in item 12 of these Conditions.

Payments
Payments by the Main Contractor to the Sub Contractor shall be in accordance with clause 27.2 (vii) and (viii), 27.3, 27.6
and appendix Items under clause 30.2 and 30.4 of the main contract (see item 12.5 of these Conditions for details of 30.2
and 30.4.

The Sub Contractor shall execute his work in conformity with a programme

No variation shall vitiate the sub-contract. All properly authorized variation shall, unless otherwise agreed, be valued by the
surveyor (or if none, then by the architect) in accordance with the following principles:
5.1

The prices in this tender shall determine the variation of extra work of a similar character executed under similar
conditions as work priced therein.

5.2

The prices in this tender shall be used as a basis for determining the value of extra work, which is not of a similar
character executed under similar conditions, so far as is reasonable, failing which a fair valuation shall be made.

Where extra work cannot properly be measured and valued the Sub Contractor shall be allowed day-work prices:

At the rates contained in the schedule of day-work prices (if any) annexed to the specification or bills of
quantities on which the Sub Contractors estimate is based: or, if no such schedule is annexed.
At rates considered fair and reasonable by the architect and/or quantity surveyor

The price in the Sub Contractors accepted tender shall determine the valuation of items omitted, provided that if
omissions substantially vary the conditions under which any remaining items of work are carried out prices for such
remaining items shall be valued under principle 5.2 above.

Unloading, etc.

Unloading and distributing the Sub Contractors materials and plant shall be the responsibility of the Sub Contractor and is
deemed to be included in his tender. The Main Contractor will however perform this service on receipt of the Sub
Contractors written order to this effect undertaking to reimburse the Main Contractors reasonable charges for so doing
(see item 17 of these Conditions).

7.

Storage area
The Main Contractor shall provide free use of a suitable storage area for the Sub Contractors materials, plant, etc. The
Sub Contractors tender shall include for any enclosure and protection he requires for this storage area.

8.

Water
Adequate water shall be provided by the Main Contractor

9.

Casing and protection


The Sub Contractor shall be responsible for the protection of his work during execution, but the Main Contractor shall
responsible for necessary casing and protection after the Sub Contractors work has been executed.

10.

Safety, health and welfare


The Main Contractor shall provide suitable safety, health and welfare measures and amenities (including latrines,
messrooms, etc.) all in compliance with the current Statutory Regulations The Sub Contractor shall co-operate in
maintaining these standards

11.

Insurance against fire


The Main Contractor or the building owner shall bear the sole risk of loss of damage by fire, etc., as defined under clause
20.0 of the main contract (see item 12.4 of these Conditions).

17. Scaffolding, plant and hoisting

Additional facilities and services


The additional facilities and services described opposite
shall be provided free of charge by the Main Contractor.
