MUNICIPAL ORDINANCE NO. 07 2008


AN ORDINANCE AMENDING RULE IX, SECTION 6, FIRST PARAGRAPH AND
PARAGRAPH (A), SECTION 8; RULE X, PARAGRAPHS (A) TO (G), DELETION OF
PAR. (C), (D) AND (E), AND ADDITION OF A PAR.; AND RULE XVIII, SECTION 2 OF
THE GUINOBATAN TRAFFIC CODE, AS AMENDED.

BE IT ORDAINED by the Sangguniang Bayan in session assembled that:


SECTION 1. That Rule IX, Section 6, is hereby amended to read as follows:
Section 6. The parking, loading and unloading zone established for trimobile
(motorized tricycle) are as follows and no other vehicle is allowed to park
therein:
a. Tricycles shall park, load and unload their passengers along A. Paulate
Street facing A. Mabini Street (Parada 9);

SECTION 2. That Section 8 of RULE IX is hereby amended to read as follows:
Section 8. Parking, loading and unloading zones for buses. No parking for buses
in front of booking offices and along Rizal Street. Buses are only allowed to
stop, load and unload passengers at designated zones.

SECTION 3. That Rule X, Paragraphs (a) to (g) (ONE WAY STREETS) are hereby amended to
read as follows:
a. A. Mabini Street traffic flow shall be in the direction of the Public Market only
from Corner G. Ocfemia Street to corner A. Ofracio Street and no parking for
10 wheeler trucks;
b. A. Paulate Street traffic flow shall be in the direction of Public Market only
from corner J. Rizal St. to corner A. Mabini St.;

f. Ofracio Street traffic flow shall be in the direction of J. Rizal St. only from
corner A. Mabini Street to corner J. Rizal Street;
g. Ola Street traffic flow shall be in the direction of A. Mabini St. only from
corner A. Mabini Street to corner J. Rizal Street.
h. M.H. Del Pilar St. traffic flow shall be in the direction of Gen. Simeon Ola
Road only from corner A. Paulate St. to corner Gen. Simeon Ola Road.
SECTION 4. Entry of ten-wheelers or trucks with more than ten wheels are strictly prohibited
on all municipal roads and streets of Guinobatan, Albay.
SECTION 5. RULE XVIII. Section 2 is hereby amended to read as follows:
The Guinobatan PNP and Traffic Enforcers are hereby authorized to
apprehend violators of the Traffic Code and to issue citation tickets to the
violator who shall pay the fine corresponding to the violation within 72 hours
from the citation to the Municipal Treasurer or his duly authorized
representative, who shall issue an official receipt. If apprehended during
holidays, the violator shall pay the fine to the Finance Officer of the
Guinobatan PNP who shall issue an official receipt.
Failure on the part of the violator to pay the fine within the prescribed
period will cause the elevation of his case (for violation of the Traffic Code) to
the appropriate courts of competent jurisdiction. Copies of the citation ticket
shall likewise be furnished the Land Transportation Office which shall take
appropriate action under existing or future agreements between the LGU
and that office.
The apprehending officer, whether PNP Officers or Local Traffic
Enforcers shall be entitled to a share of 20% of the total fine corresponding
to the violation or violations as the case may be. This incentive shall be
released to them on a quarterly basis.
SECTION 6. RULE XIX (FINAL PROVISIONS) Paragraph 2 is likewise amended to read as
follows:
(2). Proceeds of the fines. All fines collected or accruing to this Ordinance
shall go to a Traffic and Safety Trust Fund. 80% shall be expended for the
purchase of and maintenance of all equipment utilized or necessary in the
effective enforcement of Traffic Safety ordinances in this municipality, and
20% for the share of apprehending officers of the fines from the violators
they have apprehended to wit:

SECTION 7. Repealing, Modificatory and Amendatory Clause. Any other laws or provisions
of ordinances not consistent herewith are forthwith repealed, modified or amended accordingly.
SECTION 8. Separability Clause. If any provision of this ordinance or the application of such
provision to any person or circumstances is declared unconstitutional the remainder of the
ordinance or the application of such provision to other persons or circumstances shall not be
affected by such declaration.
SECTION 9. Effectivity. This Ordinance shall take effect upon its approval.
ENACTED this 28th day of April 2008.
