Dear Senator Donnelly:
I am responding to your March 12, 2015 letter regarding property at the former
Indiana Army Ammunition Plant. Your letter addressed a closed landfill site on the
property and a discussion of that subject you have scheduled on April 9.
Although I am not able to attend the April 9 discussion, the U.S. Army Corps of
Engineers Louisville District Commander, COL Christopher Beck, will attend and will be
able to discuss property conveyance matters. Mr. Kerry Dupaquier, the Army's onsite
Facility Manager, will attend representing the Army BRAC office and can address landfill
site matters.
The Army does not agree that the closed landfill site is unsuitable for conveyance
to the River Ridge Development Authority (RRDA) pursuant to the terms of the
Memorandum of Agreement (MOA) between the Army and RRDA. The Army properly
closed the landfill in accordance with the closure plan approved by the Indiana
Department of Environmental Management (IDEM). Post-closure requirements ,
including landfill cap maintenance, are performed by the RRDA, at Army expense,
pursuant to terms of RRDA's lease agreement with the Army. There is nothing on the
site or in the ongoing monitoring and maintenance activities indicating that the landfill
cap is not functioning as designed or is not protective of human health and the
environment. In this regard you may find the enclosed recent letters from IDEM useful.
The letter of March 27 approves the landfill maintenance workplan; the letter of March
31 affirms that the landfill remains in compliance with the RCRA Post Closure Permit
and all applicable regulations.
There is no need for this matter to impede RRDA's redevelopment efforts. The
MOA requires the Army to complete its environmental clea nup obligations under
applicable law, and to provide a deed to the RRDA that contains the environmental
covenants and warranties required under applicable law. The Army has met those
requirements for the landfill site parcel. The MOA further provides that when the Army
meets those requirements , the RRDA will accept the conveyance. The Army expects
the RRDA to fulfill its mutually-agreed obligation under the MOA to accept conveyance
of the landfill parcel without further delay.

IDEM has received your letter dated March 24, 2015 asking for clarification
regarding the current compliance status of the INAAP landfill.
The landfill is currently being monitored and maintained in compliance with all
applicable regulations in 40 CFR Parts 260 through 270 and 329 IAC 3.1, as outlined in
the RCRA Post Closure Permit issued February 14, 2014. The Permit requires
implementation of an ongoing ground water monitoring program and a landfill cap
inspection and maintenance plan. Improvements to the cover drainage have been
proposed and recently approved by IDEM staff (VFC#80020337).
