I.

SITUATION:

On October 15, 2013, a shooting incident has transpired at about 3:00


oclock in the afternoon in-front of PING GUERRERO Motorcycle Shop along
Malawis Stimson Avenue, Barangay Poblacion, Boliney, Abra, wherein one (1)
ELY PANTE y MALAQUI, 44 years old, married, businessman, a native of San
Nicolas, Ilocos Norte and a resident of Zone 4, Bangued, Abra; was allegedly shot
by still unidentified suspects riding in tandem on a HONDA TMX colored red
without plate number.
Initial investigation by Boliney MPS, Boliney, Abra disclosed that the victim
together with his helper BENNY BILANG y DALERE, 23 years old, married,
helper by calling, a native of Barit, Luba, Abra and a resident of Linasin, Zone 1,
Bangued, Abra were dismounting lubricants, motorcycle parts and motorcycle
tires from their Mitsubishi L-300 delivery van with plate number ABC-123 when
fired upon by the suspect several times at closed ranged. The victim sustained
multiple gunshot wounds on the upper different parts of his body
and
extremities and was rushed by the responding policemen to the Abra Provincial
Hospital but expired at about 6:05 PM of the same date while undergoing
treatment. The suspects fled towards west direction after the commission of the
crime. The SOCO team of Abra-PPO recovered at the crime scene a seven (7)
fired cartridge cases for caliber .45, one (1) fired bullet and one (1) fragment
jacket believed to be of same caliber.
SPO GLENN JOEL S. STIMSON , investigator-on-case, Boliney MPS revealed
that the victim is a silent big time businessman, a sole proprietor manager of his
own business engaged in a buy and sell of automobiles, dealer of motorcycle
parts and lubricants. Wherein, the victim had a several account of thousands of
uncollected debt from the various costumers in some Municipalities of Abra
particularly Bangued, Manabo, Bucay, La Paz, Villaviciosa and Pidigan and in
some municipalities of Ilocos Sur and Ilocos Norte.
Based on the statement of BENNY BILANG y DALERE, helper employee
of the victim, he averred that at about 3:00 PM of October 15, 2013, they were
unloading lubricants, motorcycle parts and motorcycle tires from their L-300 van
parked infront of PING GUERRERO Motorcycle Shop. He was inside in the
motorcycle shop, his employer [victim] was in front of the store near their parked
vehicle. At this point, a burst of fire sound off. Then, he saw his employer
(victim) was hit on his shoulder. When he looked at him thats the time he was
hit on his head then he fell down. The triggerman came closer to him and
pointed his firearm but he put down, instead he pointed to his employer (victim)
and fired once within approximately two (2) meters away, he looked at him then

sped off together with his driver. He further averred that an eye witness at close
range told that the suspect was a slim built, sporting straight hair, brown
complexion, standing about 53 to 55 in height, wearing white T-shirt while the
driver was darker complexion wearing black T-shirt. He revealed that his brother
(victim) are quarreling with his wife lately regarding the collections of money
from debtors which is supposed to be the job of the victim, however his wife was
allegedly collecting a cash debt without the knowledge of the victim. They had a
misunderstanding regarding the employment of workers on their business
because Mrs. PANTE (wife of the victim) insisted that her brothers and relatives
will only be their workers.However the victim didnt agree instead he fight for the
employment of his helper Benny. Benny revealed also that his employer (victim)
told to him that his wife named his business on her without the knowledge of the
latter which caused their misunderstanding. Moreover, Mrs. Elefante is jealous
accusing his husband (victim) that he has another woman. He further averred
that his employer (victim) has a lot of payments (debt) from costumers he failed
to collect.In fact, there was an auto supply along Naguirayan, Pidigan, Abra (not
mentioned) wherein, allegedly they had in default amounting to Two Hundred
Thousand Pesos(PHP200,000.00), and failed to pay to the latter despite a long
time. He also averred that before they went to Ping Guerrerro Motorcycle Shop
where the shooting incident occurred, his employer (victim) and Mrs. Pante
(victims wife) talked that after all their delivery they will go to the Jolibee to take
their dinner. However, while they are dismounting deliveries at Manabo, Abra at
around 1:30 PM, Mrs. Pante told the victim that she will go visit her friend in
Luzong, Manabo, Abra and that she will just wait for them to pick her up on their
way home after they made their deliveries in Boliney, Abra. He further averred
that, Mrs. Pante called him at 1:45 PM and gave instructions in Ilokano;

Boliney and if you are already approaching Boliney.
Several mug shots were shown to BENNY BILANG y DALERE by the
Boliney MPS to identify the suspect/s but hesitant to identify them due to the
fear that he might be the next target. The Boliney MPS, Abra-PPO was the first to
take cognizance of the case but the investigation turned cold and there was no
clear lead of the perpetrator/s. The case was handled by this Unit and was able
to obtain the statement of BENNY BILANG y DALERE during follow-up
investigation.

II.

MISSION:
1. Determination of the facts and circumstances surrounding the
shooting to death of the victim;
2. Establishment of a well-coordinated team from other investigative
agencies for the immediate identification of the perpetrators;
3. Building a strong and airtight criminal case against the suspect/s
supported within controvertible evidence

III.

EXECUTION:
a. Concept of Investigation:

The Chief, Boliney MPS shall assign a Case Manager and Case
Investigator that shall conduct the investigation to be augmented by personnel
of ABRA PPO Investigation Section, Intelligence Section of the ABRA PPO and PNP
Crime Laboratory Service, Abra Field Office. Through the assistance of DPDO,
Abra PPO, he shall directly supervise, assess and monitor the conduct of
investigation. He shall also assign Intelligence Officer for purposes of assisting
the investigation.

b. Tasks

1. Case Manager
a. Shall oversee and monitor the conduct of the investigation;
b. Lead the conduct of investigation and ensure the correctness
of investigative procedures;
c. Always inform the OIC, Boliney MPS as to the development of
the case;
d. Coordinate with Investigation Section, Abra PPO and SOCO
for case conference to ensure the smooth flow of
investigation;
e. Submit report on the result of action taken and status of the
case weekly basis to Regional Chief;
f. Consolidate all forensic results, testimonial documents and
other investigative reports;
g. Perform other tasks on orders of the OIC, Boliney MPS.
2. Case Investigator
a. Shall take the sworn statement of all possible witnesses
b. Coordinate with the investigators of ABRA PPO to ensure an
air-tight case if in case the suspect/s was identified.
c. Coordinate with the prosecutors for appropriate legal
guidance when needed.
d. Establish possible motives
e. Shall strictly observe the chain of custody of gathered
evidence;
f. Review all statements and if evidence gathered is strong
against the suspect/s, file appropriate charges.
g. Render report or updates on weekly basis on the status of
the case to the Case Manager
h. Perform other tasks as directed
3. Chief, Intelligence Section
a. Shall supervise and monitor the intelligence networking and
gathering information with evidentiary value relative to the
case
b. Assist the Case Manager in securing possible witnesses
c. Coordinate with territorial Intelligence Units as necessary
d. Perform other tasks as directed by the OIC, Boliney MPS
IV.

CONTINGENCY:

In the event that there are no witnesses to surface to identify the


suspect/s or to shed light relative to said shooting incident, the Case manager
and Case Investigator shall resort to forensic evidence through the help of Crime
Laboratory Office. The immediate re-evaluation of all collected and gathered
information shall be initiated through a case conference to undertake by the OIC,
Boliney MPS. Involvement of Community Investigative Service [CIS] and the
community in general shall be sought while a continuous gathering of
information must be initiated by the Case Manager and Case Investigator.

V.

ADMINISTRATION AND LOGISTICS

Admin matters:
The OIC, Boliney MPS who acts as the over-all Manager of the
investigation Team shall function as Admin Supervisor by assigning other
members of the Boliney MPS as tracker Team.
Logistics matters:
The OIC, Boliney MPS shall provide logistical requirements of the Case
Manager, itemized as follows to be expended for three [3] months.
a. Mobility expensesPhp15, 000.00
b. Food AllowancesPhp10, 000.00
c. Miscellaneous expenses [such as supplies & photocopying of
document]
Php10,000.00
Total: Php35,000.00
VI.

COMMAND AND COMMUNICATIONS:

The use of cellular phone, networking and other fastest means of


communication shall be applied.
VII.

EFFECTIVITY:
This shall take effect upon approval.

I. SITUATION:
On July 10, 2010 at about 6:30 PM along Rizal Street, Zone 7, Bangued,
Abra, one PO2 MarviFavorito Trinidad, 34 years, married, PNP member assigned at
Tineg PS and a resident of Zone 7, Bangued, Abra was shot by still unidentified
perpetrator/s. Initial investigation conducted disclosed that the victim was on his way
home on board his tricycle BAJAJ Kawasaki with plate number 1388 AY when shot by
the perpetrator/s on board a motorcycle. The victim sustained two (2) gunshot wounds
on his chest and on his left leg. He was taken to Abra Provincial Hospital for medical
treatment but was declared dead on arrival by his attending physician. A certain
BenedictoTenesaBalmaceda, 54 years old, married, Abreco employee and Barangay
Kagawad of Zone 5, Bangued, abra and Jervin Bello Bringas, 31 years old, married,
tricycle driver and a resident of Barangay Angad, Bangued, Abra were hit by a stray
bullet and shrapnel hitting their back and left hand, respectively and were taken to Abra
Provincial Hospital and Seares Clinic for medical treatment, respectively. Responding
personnel of Bangued PS processed the crime scene and recovered eight (8) cartridge
cases and fired bullets of Caliber .45.
On the sworn statement of BeneditoBalmaceda taken on July 14, 2012 at
Saint James Clinic, Bangued, Abra by SPO1 Robert Bringas, averred that on July 10,
2010 at about 6:30 PM, he went to Balderas Merchandize at Rizal Street, Zone 7 to buy
a case of Pop Cola and beer when he heard a successive gun detonation. After which,
he felt dizzy but after a few seconds recovered and drove his tricycle to St James Clinic
for medical treatment but later transferred to APH for further medication. He further said
that he did not recognize the perpetrator/s.
On the sworn statement of Jervin Bello Bringas, taken on July 14, 2010 at
Bangued PS by SPO1 MansuetoAgdalpen that on July 10, 2010 at about 6:30 PM,
while he was traversing Rizal Street going south direction when he heard successive
gun detonation and felt pain on his left hand. Also, he stated that he did not recognize
the perpetrator/s.
Bangued PS was the first to conduct investigation of the said incident but the
investigation turned cold and there was no clear lead of the perpetrator/s.
II. MISSION:
1. Determination of the facts and circumstances surrounding the shooting to
death of the victim;
2. Establishment of a well-coordinated team from other investigative agencies
for the immediate identification of the perpetrators;

3. Building a strong and airtight criminal case against the suspect/s supported
withincontrovertible evidence
III. EXECUTION:

The Provincial Officer shall assign a Case Manager and Case Investigator that
shall conduct the investigation to be augmented by personnel of Investigation Branch,
Provincial Intelligence Abra, PPO, PNP Crime Laboratory Service, Abra Field Office and
the Legal Officer of Abra PPO.
b. Tasks
1. Case Manager
a. Shall oversee and monitor the conduct of the investigation;
b. Lead the conduct of investigation and ensure the correctness of investigative
procedures;
c. Always inform the Regional Chief as to the development of the case;
d. Coordinate with Investigation Section, Abra PPO and SOCO for case
conference to ensure the smooth flow of investigation;
e. Submit report on the result of action taken and status of the case weekly
basis to Regional Chief;
f. Consolidate all forensic results, testimonial documents and other investigative
reports;
g. Perform other tasks on orders of the Regional Chief.
2. Case Investigator
a. Shall take the sworn statement of all possible witnesses
b. Coordinate with the investigators of BanguedPS to ensure an air-tight case if
in case the suspect/s was identified.
c. Coordinate with the prosecutors for appropriate legal guidance when needed.
d. Establish possible motives
e. Shall strictly observe the chain of custody of gathered evidence;
f. Review all statements and if evidence gathered is strong against the
suspect/s, file appropriate charges.
g. Render report or updates on weekly basis on the status of the case to the
Case Manager
h. Perform other tasks as directed
3. Chief, Intelligence Section
