DEED OF HEIRSHIP OF ESTATE AMONG HEIRS

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF HEIRSHIP OF ESTATE AMONG HEIRS made and
entered into by and among:
_______________________, married to Leonila Abuso,both of legal age,
both Filipinos, and residents of Tampi, San Jose, Negros Oriental; ________________ and __________________, all of legal age, all single, all
Filipinos and residents of Samboan, Cebu, hereinafter referred to as the
HEIRS,
W I T N E S S E T H:
That during the lifetime of _______________________, she was the
registered co- owner of a parcel of land, Lot No. 815 covered by Original
Certificate of Title No. 10773, situated in Tampi, San Jose, Negros
Oriental, which parcel of land is more particularly described and bounded as
follows:
A parcel of land (Lot No. 815 of the Cadastral Survey of
Ayuquitan), with the improvements thereon, situated in the
Municipality of Ayuquitan (now San Jose). Bounded on the N. by Lots
Nos. 673, 672 and 671; on the E. by Lot No. 667; and on the SW. by
Lots Nos. 667, 816, and 674. Containing an area of Five Thousand Four
Hundred Seventy Two (5,472) square meters, more or less.
That likewise during her lifetime, said _______________________, acquired
full ownership of the above mentioned lot by virtue of a public instrument
known as Extrajudicial Settlement and Partition Agreement executed
by Spouses ________________ and ____________ and __________, widow of the
late Evaristo Tano, under Doc. No. 77, Page No. 24, Book No. 1, Series of
1956 ratified before Notary Public Joaquin R. Hitosis;
That said _______________________, prior to her death on October 8,
1986 in the Municipality of San Jose, Negros Oriental, executed a public
instrument known as AFFIDAVIT where she adjudicated Lot No. 815 unto
her

That _______________________ died intestate on September 7, 1997 in
Samboan, Cebu and was survived by his three (3) children, namely:
___________________, they being his legitimate children and only heirs;
That it is to the best interest of the above named HEIRS who are all of
legal age to settle and adjudicate the estate of the decedents unto and
among themselves in the form and manner set forth by law, as follows:

NOW THEREFORE, for and in consideration of the premises and
invoking the provisions of Section 1, Rule 74 of the Revised Rules of Court,
the HEIRS above named, do by these presents, settle the estate of the
decedents above described extrajudicially and to the effect, do hereby
adjudicate the same unto themselves, subject however to the liabilities
imposed by Section 4, Rule 74 of the Revised Rules of Court, for a period of
two (2) years in favor of any possible heirs, creditors, and other persons

deprived of any lawful participation in the estate of the aforementioned

decedents.
