I am writing to request that the Duplin County Sheriffs Office be allowed to participate
in the Delegation of Authority Program pursuant to 287 (g) of the Immigration and
Naturalization Act. I believe this partnersh ip would enhance our ability to serve and
protect the citizens of Duplin County and Eastem NOl1h Carolina .

Establishment of an Identification Review Officer at our Duplin County Jail in


Kenansville, North Carolina. This is the central processing and pre-trial detention
facility for Duplin County.

Train (6) Sheriffs Deputies with tbe Duplin County Sheriffs Office who have
passed a security background acceptable to ICE.

Training facilities are available locally; however I would be willing to send the
respective personnel wherever necessary to allow tbem to complete the training.

I believe the pal1icipation of our office in the Delegation of Authority Program would be
mutually beneficial to both agencies. By entering a Memorandum of Understanding with
ICE we could assist in the identification of criminal illegal aliens who pose a threat to the
citizens of Duplin County.
I look forward to your speedy endorsement of this request and the implementation of this
program in D uplin County.

Thank you for your interest in the 287(g) delegation of immigration authority program. The
287(g) Program Management Office and the Office of the Assistant Secretary for U. S.
Immigration and Customs Enforcement (ICE) are in receipt of your request for training for the
Duplin County Sheriff's Office.

On February 20, 2007, the Program Manager for 287(g) Delegation of Authority at ICE
Headquarters forwarded your request to the Special Agent in Charge SAC Atlanta, and the
Field Officer Director of Detention and Removal, FOD Atlanta. Local representatives from
these two divisions will be in contact with you soon to conduct a preliminary assessment and
determine whether the 287(g) program is the appropriate application to address your local law
enforcement challenges.

SUBJECT: Duplin County Sheriffs Office Request for 287(g) Delegation of


Authority Training

On February 12,2007, U.S. Immigration and Customs Enforcement (ICE) Headquarters (HQ)
received a request for 287(g) Delegation of Authority training from the Duplin County
Sheriffs Office (DC SO) located in Kenansville, North Carolina. Sheriff Blake Wallace has
requested 287(g) Delegation of Authority training for an Identification Review Officer and 7
Sheriffs Deputies. In his letter, Sheriff Wallace states, " ... this partnership will enhance our
ability to serve and protect the citizens of Duplin County ... "

The SAC Atlanta is unable to support the DCSO request for 287(g) Delegation of Authority.
The SAC Atlanta area of operation (AOR) is currently supporting three 287(g) jail programs
and is obligated to support an additional two 287(g) jail programs after training. Additionally,
SAC Atlanta has obligated resources to support two 287(g) task forces within their AOR.

HQ Detention and Removal Operations (DRO) and the Atlanta Field Office completed an
overall assessment of this 287(g) request and determined the following long-term support
requirements needed.

• DCSO would be required to enter into an IGSA for detention and transportation to the
nearest "Over 72-hour" ICE facility capable of housing apprehended aliens.
• 01 supervision of the Jail components until DRO can fund and field the requested
SDDO or Annuitant to take over the Jail duties.
• Additional funding of $1 ,202,870 per year will be required for the two FTE' s needed to
address case management and removal requirements as well as the additional 17 beds
needed to support the estimated 180 cases produced by DCSO.

• Additional funding of $31,474 will be required for transportation costs associated with
the estimated 240 cases produced annually.
• The Atlanta Field Office would need an additional 1887 beds per year and
$ll6,780,213 to support all current and pending 287(g) programs for the Field Office.

Atlanta DRO currently does not have the capability to support the program if approved. There
are currently insufficient supervisory positions, support FTE's, and bed space available to
support additional 287(g) programs within the Atlanta Field Office. With Atlanta's four current
MONs, two approved programs and 18 pending requests the Atlanta Field Office would be
overwhelmed if additional programs were approved. Even if additional bed space was
identified, funding has not been provided to support it nor would those sites be available for
three to nine months depending on the facility. The DRO 287(g) program is tentatively
scheduled to receive 33 FTE's (nine DO's, five DA's and 19 lEA's) in FY08 to support 287(g)
in the field nationwide, however these 33 position are insufficient in number to support even
the six current and pending MONs in the Atlanta Field Office and they do nothing to address
the supervision requirements that are currently being covered by or. If these concerns are not
addressed and the program is approved, it is likely that the additional beds, costs and strain on
personnel will have a detrimental impact on DRO's ability to operate in an effective and
efficient manner, thereby increasing the probability of reverting to the "catch and release".

HQ DRO and the Atlanta FOD currently recommend that the Duplin County Sheriff's Office's
287(g) request be disapproved until sufficient resources are funded and in place to effectively
support the program.
