CONDITIONAL LICENSING AGREEMENT

This Conditional Licensing Agreement (Agreement) is made between the


Commonwealth of Pennsylvania, Pennsylvania Liquor Control Board

(Board), located at

Capital and Forster Streets, Harrisburg, Pennsylvania 17124 and XXXX applicant for Restaurant
Liquor License No. XXX (Business) for premises located at XXX. The Board and Business
stipulate to the following:

The Board and Business therefore agree that the following conditions be placed on
Restaurant Liquor License XXX while in use at XXXX

a. Business shall remain compliant with the Responsible Alcohol Management


provisions of the Liquor Code including, but not limited to:
1. New employee orientation;
2. Training for alcohol service personnel;
3. Manager/owner training;
4. Displaying of responsible alcohol service signage; and
5. A certification compliance inspection by a representative of the
Boards Bureau of Alcohol Education; and
new employees engaged in serving alcohol beverages or in admitting patrons to
the licensed premises shall become compliant within 90 days of commencement
of their employment.

b. Business shall maintain and enforce a written barred patrons list on the licensed
premises and shall work in collaboration with A Better Bellevue / BIGr and other
restaurant and bar owners in the area to compile a master barred patrons list.
Such list shall be made available upon request to law enforcement officials, as
well as authorized representatives of A Better Bellevue (ABB) and/or Bellevue
Initiative for Growth and Revitalization (BIGr).

c. Business shall maintain incident reports or other documentation (using a Boardpublished incident report form or similar form) indicating the date and substance
of all matters involving weapons or violence; involving ejection of a patron from
the licensed premises; involving a visibly intoxicated patron (as reasonably
adjudged by Business); or requiring involvement by local police to address any
problems at the licensed premises. Such documentation shall be maintained by
Business for a period of two (2) years from the date of said incident and shall be
made available upon request to law enforcement officials, as well as authorized
representatives of ABB and/or BIGr.

d. Business shall install and maintain surveillance cameras (surveilling, among other
areas, the public entrance(s) and exit(s) used by patrons) at the licensed premises.
These cameras shall be operational whenever the premises are open for business.
The tapes or recordings from these cameras shall be maintained by Business for at
least fourteen (14) days. The tapes or recordings shall be made available upon

request to law enforcement officials, as well as authorized representatives of ABB


and/or BIGr, and certain recordings will be downloaded and preserved for a
longer period of time if requested in a timely manner by such agencies.

e. Business shall not serve pitchers of drinks involving spirits or provide bottle
service with respect to spirits to individual or groups of patrons on premises. This
provision shall not apply to catered events and shall not preclude Business from
selling bottles of wine, beer and/or champagne to its patrons.

f. Live music or Disc Jockey shall be permitted on premises. Sound levels must be
kept within the guidelines of the Borough of Bellevue noise ordinance. Business
shall document all sound reducing measures taken at the licensed premises.
g. Business shall not have on premises any gambling of any kind to include video
poker and other such machines.
h. Business sale of take-out beer shall be restricted to cans, growlers and bottles of
brands normally priced above normal domestic premium beer prices (examples of
normal domestic premium beers are Budweiser, Coors Light, Yuengling, Miller
Lite). Business shall not sell 40 ounce or similar bottles of malt or brewed
beverages for take-out.
i. Business shall maintain regular kitchen hours with dedicated kitchen staff,
offering a complete restaurant menu, at a minimum from 11:00 am until 10:00 pm
on Tuesday through Saturday.

j. Business off premises advertisements shall not highlight drink prices or


discounts, but may mention happy hours or other daily specials permitted by law.
k. Business shall not sell alcoholic beverages for less than $2.50 per individual
serving.
l. Business shall install and maintain exterior lighting at all entrances and exits.
m. Business shall take random, periodic customer counts on Friday and Saturday
evenings and shall document or log instances where its occupancy reaches ninety
(90%) percent of its permitted occupancy level.
n. Business shall prohibit patrons or other non-employees or service personnel from
entering the premises after its regularly scheduled closing time.
o. Business shall discourage littering or loitering in front of its licensed premises and
shall install at least one (1) receptacle for cigarettes outside its premises at each
entrance.
p. Business will use an electronic identification scanning system in a commercially
reasonable manner (but shall not be required to scan identification of patrons
dining with families, patrons not consuming alcohol beverages, or regular patrons
whose identification has previously been scanned by Business).
q.

Business shall not expand its hours of operation beyond the original level
(8:00AM - 12:00PM Sunday, 8:00 AM - 1:00AM Monday through Thursday and
8:00AM - 2:00 AM Friday and Saturday) without the consent of ABB and BIGr
unless Business has established by clear and convincing audited evidence that

food sales revenue consistently constitutes at least twenty-five percent (25%) of


its revenue from the licensed business.

Business shall not permit patrons to leave the licensed premises with open
containers (glasses, bottles, cans) of alcohol beverages.

Business shall not conduct outdoor operations without the consent of ABB and
BIGr and must be in compliance with Borough of Bellevue ordinance.

Business shall clean its sidewalk at the conclusion of each operating day.
Business shall not handle glass, refuse or recyclable materials outside the
licensed premises in a manner that generates noise after 11 p.m. or before 6 a.m in
accordance with the Borough of Bellevue noise ordinance.

v. Business must remain compliant with Borough of Bellevue signage ordinance at


all times.

2.

Business understands that failure to adhere to this Agreement may result in citation(s)
by the Pennsylvania State Police, Bureau of Liquor Control Enforcement, and/or nonrenewal of this license and/or amusement permit by the Board.

Business further understands that these terms will remain in effect on the license at
the licensed premises unless and until a subsequent agreement is reached with the
Board rescinding these restrictions or until the license is transferred to a new owner or
for use at a new location.

In the event that any provision of this Agreement is determined to be legally invalid,
the affected provision shall be stricken from the Agreement and the remaining terms
of the Agreement and its enforceability shall remain unaffected hereby.

5.

ABB and BIGr reserve the right to inspect and audit any of the above provisions on a
semi annual or as needed basis.

IN WITNESS WHEREOF, the parties hereby have caused this Agreement to be executed
pursuant to due legal action authorizing same on date and year first written above. This
Agreement will not be fully executed and binding on the parties unless and until all
signatures are affixed hereto and unless and until the Board approves the underlying
application.
