RE: Freedom ofInformation Act Request

Dear FOIA Officer:

This letter constitutes a request under the Freedom of Information Act ("FOIA"), 5
U.S.C. § 552 et seq. I seek the disclosure of the following records)

l. All written agreements under INA§ 287(g), 8 U.S.C. § 1357, with a state or local
government or law enforcement agency that were signed after October 1, 2008.

2. All correspondence between ICE and state or local governments or law


enforcement agencies about the 287(g) program since January 1, 2007, including,
but not limited to: all letters of interest, requests for information, applications,
etc., and all responses thereto.

I am entitled to a waiver of all costs "because [the information sought] is likely to


contribute significantly to public understanding of the operations or activities of the government
and is not primarily in [my] commercial interest." 5 U.S.C. § 552(a)(4)(A)(iii). See also 6 C.F.R
§ 5.11(k) (records furnished without charge if the information is in the public interest, and
disclosure is not in commercial interest of institution).

I have no commercial interest in this matter. I will make all information I receive as a
result of this FOIA request available to the public at no cost. Disclosure in this case therefore
meets the statutory criteria, and a fee waiver would fulfil Congress's legislative intent in
amending ForA. See Judicial Watch, Inc. v. Rossotti, 326 F.3d 1309, 1312 (D.C. Cir. 2003)
("Congress amended FOIA to ensure that it be 'liberally construed in favor of waivers for
noncommercial Requestors. '" (citation omitted)). Alternately, I seek a reduction in duplication
fees.
