CHALLENGES OF THE ICC

This paper examines the Article 7 of the Rome statute which defined the crime against
humanity. This article introduces to the nature and operation of the international criminal
court with reference to the Rome statute and prosecuting of trafficking cases. Human
trafficking or trafficking in person is a serious crime and a grave violation of human rights.
So it has its felt in all the countries across the world.
Therefore, there is need to prosecute the trafficker through the universal body i.e.
International criminal court. This paper also discusses various convention and protocols
enforced by the UN for preventing trafficking, slavery, labour which formed the basis of the
Rome statute and ICC. The jurisdiction of the ICC and type of crime under each category of
crime against humanity (under article 7 of the Rome statute) are also discussed in this paper.
This paper also explains the application of the ICC in prosecuting cases such as human
trafficking, slavery, war crime etc. and describes each characteristics of Article 7 of the Rome
statute. It further describe the organized manner of trafficking which qualifies to be
systematic in nature and those type of trafficking which are committed in some countries with
the assistance of the government and policies of the that state.
This paper also examines the challenges and limitations of the ICC in prosecuting case
pertaining to crime against humanity and specifically in case of human trafficking. It further
describes the reason, limitation and challenges faced by ICC in prosecuting case such as
human trafficking and provide appropriate solutions overcome the challenges and limitation
faced by ICC
