Complainanthasstatedinherapplicationthatshegot
married with respondent no.1 Joginder Kumar on 13.02.2005
according to Hindu rites and ceremonies and 'twin' children
namely Lakshya & Deepika were born out of the wedlock on
30.12.2006 but since the day of marriage, she is being tortured
mentally and physically by the respondent no. 1 and other
respondents for demand of dowry. It is further alleged that
respondentno.1isinahabitofdrinkingandharassherthereafter
andrespondentno1pressurizesthecomplainanttoseekadivorce
so that he can marry his girlfriend and also threatened her to
commit suicide ifshedoesnot leave him.Complainant submits
thatsheisnotworkingandissolelydependentonherparentsfor
subsistenceofherself.
Respondentno.1appearedbeforethecourtandfiled
hisreplytotheapplicationundersection12ofPWDVActfiledby
thecomplainantwhereinhedeniedalltheallegationslevelledby
the complainant. In his detailed income affidavit, he has
mentionedthatheisdoingaprivatejobanddrawingasalaryofRs
14,000/ per month and he has a liability to maintain the twin
childrenwhoarelivingwithhim.

the respondent, there is no averment regarding the earning

liabletomaintainhiswifeKrishna&thetwochildren.So,keeping2
portions of the admitted income for himself, respondent no. 1
JoginderKumarisdirectedtopayaninterimmaintenanceofRs.
2,800/permonthforthecomplainantfromthedateoffilingof
applicationi.e.20.01.15tillthedateoffinaldisposal.
Respondentno.1isfurtherdirectedtoclearthearrears

certificatetotheeffectwhetherthepatientisfittotravel.So,court

has certain reservations regarding the medical certificate of

ChaitanyaKumarfiledbythecounselfortherespondent.
But,forthetimebeing,believingthemedicalailment
of resp no. 1 and the certificate of the doctor to be genuine,
applications for exemption of respondents no. 1 and 3 from
personal appearance is allowed for today. For the same reason,
