ThisEndUserLicenseAgreement(EULA)isalegalagreementbetweenyou,companyor
individual,andAmplifyCreations,developerofthesoftwareproductstatedabove.This
agreementshallreferhereaftertotheSoftwareasthePRODUCTandalsoappliestoall
otherformsofdataincludedintheproductpackage.
Byinstalling,copying,orotherwiseusingthePRODUCT,youagreetobeboundedbythe
termsofthisEULA.
IfyoudonotagreetothetermsofthisEULA,donotinstallorusethePRODUCT.
AmplifyCreationsgrantsyouthenonexclusiverighttouseanysuppliedlogo,imagesor
videos,forpromotionalreasons.Youmayedit,useorincorporateanypromotionalmediain
yourprojects,ifyouchooseto,aslongasthePRODUCTname,orthedevelopername
(AmplifyCreations),orweblink(www.amplify.pt)isvisible.Thisexcludesany3rdparty
mediaunrelatedtoAmplifyCreations,forexample,otherlicenseeswork.
Thisagreementdoesnotrepresentinanyformalegalpartnershipbetweenthetwoparties
involved.
1. License
a. AmplifyCreationsherebygrantsyou,individualorcompany,hereafterthe
USER,nontransferableandnonexclusiverightstoinstallthePRODUCTin
two(2)desktopcomputers(WORKSTATIONS),touseandderiveworks
from,forcommercialornoncommercialpurposes,tobedistributedatUSER
discretion.
b. WORKSTATIONS:Limitedexclusivelytoone(1)WindowsBasedMachine
andone(1)MacOSXbasedMachine.TheuseofTrialVersionsofthe
PRODUCTinconjunctionwithpurchasedversionsofthePRODUCTisnot
permitted,evenifindifferentworkstations.AmplifyCreationsprovidesbulk
licensingifrequired.
2. TermandTermination
a. ThisEULA,effectiveimmediatelyupontheconditionsstatedabove,shallnot
transfertoothermajorversionsofthePRODUCTorcometoanendwiththe
exceptionofSection2cand2d.
b. USERshallbeentitledtoanyupdatemadetothePRODUCT,thisexcludes
anymajorversionchange,read,newproduct.Asanexample,iftheUSER
purchasesversion1,allupdatesuptoversion1.9shallbefreeofcharge.
c. AmplifyCreationsmayterminatethisEULAifyoufailtocomplywiththeterms
andconditionsofthisEULAaftertheagreementisineffect.Insuchevent,you
mustdestroyallcopiesofthePRODUCTandyouwillnotbeentitledtoa
refund.

d. AmplifyCreationsreservestherighttoterminatethisagreementifthe
PRODUCTisusedorimplicatedinanypossibletypeofillegalactivities.
3. USERRights&Restrictions
a. USERmayinstall,remove,copy,executeandderiveworksfromthe
PRODUCTonanyWORKSTATIONbelongingtothecompanyorindividual
butnotsimultaneouslyonmorethantwo(2)WORKSTATIONSasstated
above.
b. USERmaynotdistribute,shareordiscloseanyinformationmarked
confidentialportrayingtothePRODUCT,freelyorpaid,toanyoutside,3rd
parties.
c. Reverseengineering,disassemblyofobjectcodeoranyalterationsofthe
PRODUCTnotpermittedintheUSERrightsisstrictlyforbidden.
4. Ownership
a. USERunderstandsthatthePRODUCTislicensedandnotsold,Amplify
CreationsretainsallrightsandownershipofthePRODUCTandanyrelated
mediaincluded/shared.
b. RightsofworkderivedfromthePRODUCTarethesoleproprietyofthe
USER.
c. AmplifyCreationsreservestherighttouseanymediamadepublicbythe
USERderivedfromtheuseofthePRODUCT.Strictlyforpromotional
purposes,USERownershipofthemediashallbeclearlystatedandweblinks
tooriginalworksshallbevisible,whereapplicable.
5. Support
a. FreelimitedsupportmaybeprovidedviaemailiftheUSERinquireadeersto
AmplifyCreationsSupportPolicy.Checkwww.amplify.pt/SupportPolicyfor
moreinformation.
b. Paidsupportshallbeprovidedwithoutanylimitations,unlessstatedinthe
PaidSupportAgreementthataccompaniesthePRODUCT,ifapplicable.
6. Warranty&Liability
a. AmplifyCreationstheAuthorofthisPRODUCTdisclaimsanywarrantyforthe
PRODUCT.ThePRODUCTandanyrelateddocumentationormediais
provided"asis"withoutanytypeofwarranty,eitherexpressorimplied,
including,withoutlimitation,theimpliedwarrantiesormerchantability,fitness
foraparticularpurpose,ornoninfringement.
b. Undernocircumstances,includingnegligence,willAmplifyCreationsand

otherpartiesinvolvedinthecreation,testing,marketinganddistributionofthe
PRODUCToraccompanyingcontent,beliabletoanyotherpartyforany
direct,incidentalorothertypeofunforeseeninfluenceoractionthatmayresult
inpunitiveconsequentialdamages,includingbutnotlimitedto,dataloss,
businessinterruption,lossofrevenue,lossofuse,softwaremalfunction,
hardwaredamageorinflictedbusinessdelays.AmplifyCreationsshallnotbe
liableunderanycircumstancesforanymisuseofthePRODUCTor
accompanyingcontentbytheUSER,3rdpartyCopyrightviolationincludedbut
notlimitedto.
7. RefundPolicy
a. AmplifyCreationsprovidesfullyfunctional,watermarkedtrialversionsofevery
product,withouttimelimitationsormissingcorefunctions,therefore,
licenseeswillnotbeentitledtoreimbursementofanyamountspaidforthe
PRODUCTafterthisEULAisineffect.
8. GoverningLaw
a. ThisAgreementshallbeexclusivelygovernedbythelawsofPortugal
pertainingto,butnotlimitedto,softwaredevelopmentanddistributionof
electronicgoods,amemberstateoftheEuropeanUnion.Incaseofadispute,
onlyacourtofthatcountryshallhavejurisdiction.
9. Remedies
a. IntheeventofLicenseebreachofthisAgreement,Licenseeshallpromptly
destroyallcopiesofthePRODUCT.AbreachbyLicenseewillirrevocably
harmAmplifyCreationsmakingitentitledtoinjunctiveand/orotherequitable
relief,inadditiontootherremediesaffordedbylaw.
10. Severability
a. IfanytermofthisAgreenmentisdeclaredunenforceableorvoidbyanycourt
ofcompetentjurisdiction,suchdecisionshallnotaffecttheremainingterms
stated.
11. Waiver
a. Failureofeitherpartytoenforcetherights,reservedorstatedinthis
document,ortotakeactionagainstanotherpartyintheeventofabreach,
shallnotbedeemedawaiverofsaidrights.
12. General
a. Legally,thisAgreementrepresentstheentireagreementbetweenAmplify
CreationsandLicenseeandsupersedesanyotherpriorcommunicationor
anyimpliedunderstanding.
