Brown, Willie Buchanan, and Jeanette Dickson, for a Verified Petition, respectfully shows to this Court and alleges: 1, That at all times hereinafter mentioned, the Petitioner Clifton M. Dixon, residing at 518 Washington Avenue, Albany New York 12203, City of Albany, County of County is a candidate of the Democratic Party and will be qualified to vote at the upcoming primary election to be held on September 10", 2015 for the Office of Albany County Legislator, 4" Legislative District, State of New York on the Democratic Party Line. 2. That at all times hereinafter mentioned, the Petitioner Louis W. Brown, residing at 1 Bleecker Terrace, Apt 116, Albany New York 12206, City of Albany, Countyof County is a registered voter of the Democratic Party and is qualified to vote at the upcoming primary election to be held on September 10", 2015 for the Office of Albany County Legislator, 4 Legislative District, State of New York on the Democratic Party Line. 3. That at all times hereinafter mentioned, the Petitioner Willie Buchanan, residing at 1 Bleecker Terrace, Apt 213, Albany New York 12206, City of Albany, County of County is a registered voter of the Democratic Party and is qualified to vote at the upcoming primary election to be held on September 10", 2015 for the Office of Albany County Legislator, 4" Legislative District, State of New York on the Democratic Party Line. 4, That at all times hereinafter mentioned, the Petitioner Jeanette Dickson, residing at 3 Bleecker Terrace, Apt 121, Albany New York 12206, City of Albany, County of County is a registered voter of the Democratic Party and is qualified to vote at the upcoming primary election to be held on September 10, 2015 for the Office of Albany County Legislator, 4" Legislative District, State of New York on the Democratic Party Line. 5. That at all of the times hereinafter mentioned, the Respondent Albany County Board of Elections was and is charged with the responsibility of the supervision of the conduct of official elections held in the Albany County 4" Legislative District, and all political subdivisions located within said district. Respondent Board is also charged by law with the responsibility for all ancillary proceedings related to the election, including the review and determination of objections and specifications of objections to such petitions. 6. That at all times hereinafter mentioned, the Respondents Norma J. Chapman,residing at 404 First Street Albany NY 12210, City of Albany, is named on the Democratic Designating Petition as Candidate for Albany County Legislator 4 District filed with the Albany County Board of Elections purporting to have the minimum threshold of valid signatures (Hereafter “Chapman Petition”). 7. That on July 9, 2015, at or about 2:30pm, Petitioner-Objector Dixon arrived at the Albany County Board of Elections and saw a host of Albany County Democratic endorsed Candidates, including Respondent Chapman were just finishing up having their petitions “clocked in” by the Democratic Deputy Commissioner Kathy Donovan who was placing a date stamp on the first and last page of every petition. 8. Once the Deputy Commissioner was finished Petitioner Dixon requested a copy of “all the designating petitions submitted for the 4" Legislative District but she informed him that not only had she had just received them and still had to file them all but other requests were before mine so I would have to come back. 9. Instead Petitioner Dixon decided wait until over almost an hour and a half until they were properly accounted for and finally received a copy of the Chapman petition at or about 4:05pm. (See Exhibit A) 10. That on July 9, 2015, at or about 4:32 there was a Designation petition filed with the Albany County Board of Elections duly nominating Clifton M. Dixon for Albany County 4" Legislative District for the Democratic Party (Hereafter “Dixon Petition”). 11. That after filing of said Chapman Petition, written General objections were timely filed with the Albany County Board of Elections by all the Petitioner-Objectors on July 13, 2015. (See Exhibit B)12, That after filing of said Dixon Petition, written General objections were purportedly filed with the Albany County Board of Elections by the Respondent- Objector Norma J. Chapman; on July 13, 2015 but lacks her required signature. (See Exhibit C) 13. Specifications of Objections were timely filed by Petitioner-Objectors Buchanan and Dickson in support of said General Objections on July 15, 2015. These specific objections are on file with a public agency, Respondent Albany County Board of Elections, and are hereby referred to, incorporated within, and made a part thereof, as though fully set forth herein. (See Exhibit D & E) 14, Specifications of Objections were timely filed by Petitioner-Objectors Dixon and Brown in support of said General Objections on July 20, 2015. These specific objections are on file with a public agency, Respondent Albany County Board of Elections, and are hereby referred to, incorporated within, and made a part thereof, as though fully set forth herein. (See Exhibit F) 15. On Friday, July 17, 2015, late in the forenoon, Petitioner Dixon asked Kathy Donovan the Deputy Commissioner, who all Democratic Petition, Objections and other related documents are filed exclusively with if any Specific Objections had been received and she told me “No!” 16. On Monday, July 20, 2015, at or about 4:58pm (just before they close at Spm), Petitioner Dixon asked Kathy Donovan the Deputy Commissioner, who all Democratic Petitions, Objections and other related documents are filed exclusively with if any Specific Objections had been received and again she told me “No!” 17. On Tuesday, July 21, 2015, at or about 9:15am, Petitioner Dixon called the Board18. 19, 20. 21. 22. of Election to inquire as to when the specific objections were going to be heard and although they were scheduled to be start at 10:00am, I was again lead to believe by the deputy Commission that the only specific objections duly filed with the board pertaining to the 4" legislative district were filed against the Chapman petition. On Tuesday, 21, 2015, at or about 12pm, Petitioner Dixon received a facebook ‘message from a local reporting saying “I hear you were knocked off the ballot” Petitioner Dixon, immediately called the Albany county Board of Elections to inquire as to the validity of the facebook message and if so how can that happen without specific objections being filed but was he told the Deputy Commissioner ‘was in a meeting and no one could answer my questions. Petitioner Dixon, arrived at the Albany County Board of Elections to speak to Deputy Commissioner Donovan at or about 12:30pm and was told by her that “the Specific objection was presented to her just before the hearing” and that she told ‘me repeatedly that no Specific Objection had been filed because the Respondent Democratic Commissioner had not told her about it or given it to her until just before the 10am hearing on July 21, 2015. Deputy Commissioner Donovan was then instructed by the respondent ‘Commissioners Clyne and Bledi to file The Specific Objection against Petitioner Dixon causing it to now appear on the “Petitions and Objections Report” but with the retroactive date of July 17, 2015. (See Exhibit G) On July 21, 2015, The Respondent Albany County Board of Elections used an untimely non-Specific Objection to invalidate the Dixon Petition despite the fact that it was untimely, did not specify the sheets or lines objected, did not specifythe basis or law the requested relief was based, and based on the well settle law of Schwartz V. Heffernan (citation omitted) was out of the their scope, authority and jurisdiction to do so because it was outside the four comers of the document. 23. On July 22, 2015, at or about 10:45am, The Respondent Albany County Board of Elections validated the Chapman Petition by stating it contained 144 valid signatures, after ruling 189 of the 333 signatures submitted of said petition were invalidated by the aforementioned specific objection of the petitioner-Objectors. 24. The Respondent Board validated the Chapman Petition as having 31 more than the minimum threshold of valid signatures despite the fact that they failed to rule on the Specific Objections to the Witness Statement of sheet(s) 4, 5, 6, 8, 13, 21 and 27 which represent another 40 invalid signatures alone. (SEE EXHIBIT F) 2. The Respondent Board validated the Chapman Petition as having 31 more than the minimum threshold of valid signatures because they arbitrarily, capriciously and in violation of the law ruled “F” (false) to the Specific Objection to the Witness Statement of Sheet 18 that the subscribed date of “6/20/15” is false despite the fact that they rule the specific Objection of line 2 of “Date Altered from 7/2/15 to 6/20/15” based on the specific objection of Willie Buchanan was “True” which represents 8 more invalid signatures. (SEE EXHIBIT F) 26. The Respondent Board validated the Chapman Petition as having 31 more than the minimum threshold of 113 valid signatures despite the fact that they failed to rule on the Specific Objection of Petitioner-Objector Dickson to sheet 6, line 3 which are another 10 invalid signatures. (SEE EXHIBIT F) 27. The Respondent Board validated the Chapman Petition as having 31 more than the minimum threshold of valid signatures by ruling false on specific objectionsdespite the fact that the Petitioner objectors gave clear and convincing proof of their validity. 28. The Respondent Board ruled or failed to rule arbitrarily, capriciously, unlawfully and/or erroneously on 101 Specific objections to the Chapman Petition. 29. The Albany County Board of Elections was provided with clear and convincing, proof that the Candidate Norma J. Chapman, has knowledge of and directly participating in the fraudulent activity in regards to her Chapman Petition. 30. Upon information and belief, that the aforesaid Chapman Petition is insufficient, ineffective, null, void, false, fraudulent, invalid, and does not conform to the provisions of the New York State Election, and other laws of the State of New York, the Rules and Regulations of the New York State Board of Elections and is null and void by reasons of the facts and allegations set forth herein, including but not limited to the Objections and Specifications incorporated by reference herein. 31. Accordingly, the Respondent Albany County Board of Elections should be restrained and enjoined from conducting a primary election for the Democratic Party in Albany County 4" Legislative District with Norma J. Chapman listed on the ballot as a candidate. 32. Upon information and belief that the Chapman Petition for the aforesaid public office is invalid by reason of the following facts: (a) That the petition does not contain the minimum number of required valid signatures of enrolled voters for the respective designations in the respective party for the respective Candidate. (b) Than many of the signatures were not personally signed by the persons whose names appear upon said petitions, but their names were signed without theirauthority and without their knowledge. (©) Than many of the statement of witness are fraudulent because the signatures, were not obtained by the person or the date purported to be,. (@) That many of the signers did not identify themselves to the subscribing witnesses as set forth in the Norma Petition. (©) That many of the signers did not subscribe their names to the petition in the presence of the subscribing witnesses on the dates indicated in the petition, (0 That signatures to said Norma petition were obtained in violation of the law. (g) That many of the respective subscribing witnesses of the Petition, including the candidate, did not actually see the separate signatories subscribe their individual signatures thereto, (® That the subscribing witnesses of some or all of the sheets of the purported petition did not know each and every one of the signatories of the respective sheets authorized by them. (i) That some of the respective statements of witnesses in the purported petition ‘were not actually executed by the respective witnesses on the dates indicated. (k) That on some of the respective sheets of the purported petition, material alterations and/or additions were thereon made subsequent to the obtaining of the signatures and/or subsequent to the execution thereof by the subscribing witnesses. (1) That the purported petition is replete with fraudulent dates and forged signatures and/or initials of the signatories and/or subscribing witnesses. (m) That many of the signatures affixed to the purported petition were so affixed as the result of false and fraudulent representations made to the signers by the Circulators and subscribing witnesses of the petition; and the signatures wereaffixed in reliance upon such misrepresentations. (1) That on some or all of the sheets of the purported petition, there appear signatures of persons who were not properly apprised as to the legal significance of the document they were subscribing, (0) That many of the signatories set forth incorrect, incomplete, insufficient or untrue residence addresses, or no addresses. (p) That many alterations, interlineations, erasures and mutilations appear in dates, signatures and addresses of signatories. (@ That in some instances, the person listed as the subscribing witness in the introduction of the statement of witness is not the same person who executed the statement of witness. (®) That several signatures were subscribed prior to the first day for signing petitions. (® That many of those signatures appear on said purported petition had previously signed the same petition. (u) That in some instances, the date of execution of witness statements is missing, incomplete or insufficient. (v) That in several instances, the date of execution of a witness statement on a sheet is prior to the date one or more signatories signed said sheet (w) That many signatures, dates and addresses are illegible. (x) That the date of some signatures are incomplete, missing or inaccurate. (y) That many persons signing said purported petition are not registered voters as stated and/or enrolled in the party for which the candidate is to be designated, although they allege on their sheets that they are enrolled in said party.(That many signatories failed to set forth their complete and true names. (aa) That in several instances, the addresses set forth for signers are incorrect and, in some instances, said addresses do not exist. 33. Upon information and belief, that in other respects, many of the signature(s) and sheets , may not be counted as valid; and that, in other respects, upon information and belief, the signers to the purported petition, and the subscribing witnesses were parties to fraudulent conduct; and upon information and belief, by reason thereof and on the basis of the allegations heretofore set forth herein, the said purported Designating Petition is permeated with fraud so as to vitiate it in its entirety. 34. That Petitioners intend to prove to this Court that decisions rendered by Respondent Albany County of Elections on both the Chapman Petition and Dixon Petition in favor of Respondent- Candidate on particular specifications of objections filed with said Albany County Board of Elections are arbitrary, capricious, erroneous, unlawful and furthermore, that Petitioners intend to substantiate said specifications of objections which are not sustained by said Albany County Board of Elections. 35. That, in accordance with prior decisions of this and other Courts, whose decisions are controlling, Petitioners retain the right to submit proof establishing the invalidity of individual signatures and sheets on the purported petition not heretofore objected to, and of the purported petition itself, for reasons not heretofore specified, and Petitioners intend to exercise such right. 36. That your Petitioners request leave and reserve the right to submit upon the argument and hearing of this application, evidence by way of affidavits,testimony, and documentary proof to substantiate and support this application. 37. That Petitioners request Respondent Albany County Board of Elections to produce upon the argument and hearing of this application the aforesaid Democratic Designating Petition, and any other documents relating to said petitions, together with the objections and specifications relating to the aforesaid petition, the permanent personal voter registration poll records of voters, computer generated registration lists for the last four (4) years, and all of the worksheets, papers and. the report of the Clerks of the Respondent Board of Elections made on such objections and specifications and records provided for in the Order to Show Cause. 38. Other than this proceeding, your Petitioners have no adequate, sufficient, or effective remedy at law. 39. In order to effect immediate service of the Annexed Order to Show Cause and this petition on the aforementioned Respondents, it is respectfully requested that this, Court direct that such service be made in accordance with the provisions as set forth in said Order to Show Cause. 40. Petitioners are aware that in election matters governed by Article 16 of the Election Law, orders granting alternative methods of service are routinely granted. by this Court in accordance with statute and prior case law. 41. In order that issues with respect to the allegations of this petition be joined expeditiously, itis respectfully requested that the Court fix the time within which the respective Answers of the Respondents shall be served upon your Petitioners attorneys. 42. Pearl Street Albany, NY 12207 ‘To Whom It May Concer: 1am writing to complain about the Albany County Board of Elections (hereafter “ACBOE”) refusal to investigate and make determination to duly and timely filed objection(s) concerning the Designating Petition of Norma Chapman for the public office of Member, Albany County Legislature 4" Legislative District; filed with them on July 9, 2015. New York State Election Law Section 6-144 dictates that petitions for nomination as a candidate of the Albany County Legislature must be filed with the ACBOE. In accordance with the aforementioned law, both Norma Chapman (the Incumbent) and I both submitted Democratic designating Petition to be candidates of Albany County Legislature for the 4" legislative District in the upcoming Primary 2015. ‘New York State Election Law Section 6-154 further mandates that written objections to designating petition must be filed exclusively “with the officer or board with whom the original petition or certificate is filed...”. In accordance with this law so far, two of the four individuals ‘who submitted timely General Objection to the ACBOE have submitted Specific Objections detailing misconduct and/or crimes against the elective franchise, by County Legislature Norma Chapman and councilman Ronald Bailey, which include but not limited to those specifically described in Section(s) 17-120 “Misconduct in relation to certificates of nomination and official ballot”, 17-122 “Misconduct in relation to petition”, 17-152 “Conspiracy to promote or prevent election”, 17-158 “Corrupt use of position of authority” and 17-160 (2) “Procuring fraudulent documents in to vote [or any other person to vote]”. (See Exhibits A & B) Furthermore, New York State election law Section 3-218 gives them the power to subpoena any person to appear before them and be examined by them in relation to any matter ti which the ACBOE is charged. I any personally aware of the fact that this is a power the ACBOE has used in the past. However, here, they are arbitrarily, capriciously and in neglect of their duties refusing to do. Despite the fact that New York State Election law gives the ACBOE the exclusive jurisdiction to make determinations regarding the objection filed I was informed today by the ACBOE Democratic Commissioner that although he was in receipt of Exhibits A & B the ACBOE would not be having a hearing and/or making a determination in regards to them. He said an Article 16 would be required to seek determinations on those claims. “A public officer or employee whoknowingly and willfully omits, refuses or neglects to perform any act required of him [or her] by this chapter or who knowingly and willfully refuses to permit the doing of any act authorized by this chapter or who knowingly and willfully hinders or delays or attempts to attempts to hinder or delay the performance of such an act is, if not otherwise provided by law, guilty of a felony.” According to Section 17-128 of the New York State Election Law. It is a denial of equal protection under the law to require any citizen with standing to receive a determination prescribed by law to be made by the ACBOE file an Article 16. Election law proceedings have a myriad of special rules and requirements that only a handful of lawyers practice election law, Mandating a citizen either hire an attorney for thousands of dollars or have the knowledge and or expertise amounts to an unconstitutional “tax” in violation of the Voting Rights Act for any political subdivision but especial Majority-Minority ones like the 4" Legislative District in Albany County. Therefore, upon the facts stated, I respectfully request herein, the New Yok State Board of Elections having oversight and enforcement power in accordance with New York State Election law Section 3-102 (and any other applicable law) protect the rights of all Albany County voters by insuring that all duly and timely filed objections obtain determinations by the ACBOE.
