CORPORATION ACT - 1968


(NLCD 226)
Section - 1 - Establishment Of Ghana Broadcasting
Corporation.
(1)ThereisherebyestablishedabodycorporatetobeknownastheGhana
BroadcastingCorporation,inthisDecreereferredtoas"theCorporation".
(2)TheCorporationshallhaveperpetualsuccessionandacommonsealandmay
sueandbesuedinthenameassignedtoitbysubparagraph(1)ofthisparagraph.
(3)TheCorporationshallhavepower,forthedischargeofanyofitsfunctions,to
acquireandholdanymovableorimmovablepropertyandtodisposeofsuch
property,andtoenterintoanycontractorothertransaction.
(4)Wherethereisanyhindrancetotheacquisitionofanypropertyundersub
paragraph(3)ofthisparagraph,thepropertymaybeacquiredfortheCorporation
undertheStatePropertyandContractsAct,1960(CA6)orasthecasemaybe,
undertheStateLandsAct,1962(Act125),andeachsuchActshall,asthecasemay
be,applywithrespecttoanysuchacquisitionwithsuchmodificationsasmaybe
necessarytoprovideforthevestingofthepropertyacquiredthereunderinthe
CorporationandforthecostofacquisitiontobedefrayedbytheCorporation.

Section - 2 - Objects Of The Corporation.


(1)TheobjectsoftheCorporationshallbe
(a)toundertakeSound,CommercialandTelevisionbroadcasts;
(b)toprepareinthefieldofculture,education,informationandentertainment
programmesreflectingNationalprogressandaspirations;
(c)tobroadcasttheprogrammespreparedundersubparagraph(b)inthemain

GhanaianlanguagesandinEnglishandsuchotherforeignlanguagesasthe
Corporationmaydetermine;
(d)tocarryonanexternalserviceofsoundbroadcasting;
(e)toenterintoagreementfortheutilisationofprogrammespreparedinother
countries;and
(f)tocarryonsuchotheractivitiesasareincidentalorconducivetotheattainment
ofalloranyoftheforegoing.
(2)Withoutprejudicetothegeneraleffectofsubparagraph(1)ofthisparagraph,
theCorporationshallhavepowertocarryoutalloranyofthefollowingactivities:
(a)toerect,maintainandoperatetransmittingandreceivingstations;
(b)toinstallandoperatewiredbroadcastingservices;
(c)toenterintoarrangementsforthepurposeofobtainingrights,privilegesand
concessions;

(d)toproduce,manufacture,purchaseorotherwiseacquirefilms,television,
gramophoneandothermechanicalorelectronicrecords,andmaterialsand
apparatusassociatedtherewith,andtousetheminconnectionwiththebroadcast
services;
(e)toprovidetoandtoreceivefromothercorporationsandpersonsmattertobe
broadcast;
(f)toorganise,provideandsubsidisepublicentertainmentforthepurposeof
broadcasting;
(g)tocollectnewsandinformationinanymannerthattheCorporationdeemsfit
inanypartoftheworldandtosubscribetonewsagenciesandservices;
(h)toacquirecopyrights;
(i)topublishprintedmatterthatmaybeconducivetothedischargeofanyofthe
functionsoftheCorporation;
(j)todosuchotherthingsconducivetoattainingtheobjectsoftheCorporation
includingtheprovisionoffacilitiesfortrainingandeducationforthepurposeof
advancingtheskillofpersonsemployedbytheCorporationandthecarryingoutof

researchtoimprovetheefficiencyoftheequipmentoftheCorporationandthe
mannerinwhichthatequipmentisoperated.

Section - 3 - The Board.


(1)ThegoverningbodyoftheCorporationshallbeaBoard.
(2)TheBoardshallconsistof
(a)aChairman;
(b)theDirectorGeneraloftheGhanaBroadcastingCorporationreferredtoin
paragraph6ofthisDecree;and
(c)eightothermembers.
(3)TheChairmanandtheothermembersoftheBoardtobeappointedundersub
paragraph(2)(c)ofthisparagraphshallbeappointedbytheNationalLiberation
CouncilontherecommendationsoftheCommissionerandshallholdofficefora
periodoftwoyears:
Providedthatofthefirstmemberstobeappointedundersubparagraph(2)(c)of
thisparagraphfourshallholdofficeforoneyearandsuchperiodshallbespecified
intheirinstrumentsofappointment.
(4)PersonstobeappointedChairmanoftheCorporationorasmembersofthe
Boardundersubparagraph(2)(c)ofthisparagraphshallbepersonswhohave
recognisedpublicstandinginthecommunityorpersonswhohavehadexperience
inandshowncapacityinanyofthefollowingfieldsofendeavourthatistosay:
industry,trade,finance,science,administration,education,publicentertainment,
socialservice,journalism,broadcastingandlaw.
(5)NopersonshallbequalifiedtobeamemberoftheBoard

(a)ifhehasbeensentencedtodeathortoatermofimprisonmentexceeding
twelvemonthswithoutoptionofafineorhasbeenconvictedofanoffence
involvingdishonestyandhasnot,ineachcasebeengrantedafreepardon,
(b)ifheisapersonwho,havingbeendeclaredinsolventorbankruptunderany
lawforthetimebeinginforceinGhanaorinanyothercountryisanundischarged
insolventorbankrupt,

(c)ifheisamemberofanyLegislativeAssemblyorotherbodyhavingforthetime
beingauthorityeitheraloneorinconjunctionwithanyotherbodytoenactlaws
whichhaveeffectthroughoutGhana,
(d)ifheisadjudgedtobeofunsoundmind,
(e)ifinthecaseofapersonpossessedofaprofessionalqualification,heis
disqualifiedorsuspended,otherwisethanathisownrequest,frompractisinghis
professioninGhanaorinanyothercountrybyorderofanycompetentauthority
madeinrespectofhimpersonally,
(f)ifheisanofficeroftheCorporationotherthantheDirectorGeneralorisa
publicofficerwheretherearealreadynotlessthanthreepublicofficersonthe
membershipoftheBoard.
(6)Withoutprejudicetosubparagraph(5)ofthisparagraph,amemberofthe
BoardotherthantheDirectorGeneralmayberemovedfromtheBoardbythe
NationalLiberationCouncilontherecommendationoftheCommissioner
(a)ifhesuspendspaymentwithhiscreditors,
(b)ifheisabsentfromthreeormoreconsecutivemeetingsoftheBoardwithout
suchgroundasappearstotheNationalLiberationCouncilasreasonable,
(c)ifheisguiltyofunethicalbehaviourorifheisguiltyofanyseriousmisconduct
inrespectofhisdutiesasamemberoftheBoardandsuchbehaviourormisconduct
iscertifiedinwritingbynotlessthansevenmembersoftheBoard.
(7)AnymemberoftheBoardotherthantheDirectorGeneralmayresignhisoffice
bynoticeinwritingaddressedtotheCommissioner.
(8)WheretheofficeofamemberoftheBoardbecomesvacantpriortotheexpiry
ofhisfulltermofofficetheNationalLiberationCouncilshall,uponthe
recommendationoftheCommissionerandsubjecttotheprovisionsofthisDecree
appointanotherpersoninhisplacetoholdofficefortheunexpiredportionofhis
term.
(9)AllpersonsceasingtobemembersoftheBoardshallbeeligibleforre
appointmenttotheBoard.
(10)TheBoardmaypaytoitsmembersandalsotopersonscooptedunder
paragraph4ofthisDecreetoattendanymeetingoftheBoardsuchsubsistence,
travellingandotherallowancesandatsuchratesastheBoardmaywiththejoint

approvaloftheCommissionerandtheCommissionerresponsibleforFinance
determineeitherinrelationtoanyparticularmemberorgenerally.
(11)TheChairmanandmembersoftheBoardwhileholdingofficeontheBoard
shallnot
(a)holdanyofficeinorbeamemberofanycommitteeofanypolitical
organisation;
(b)offerthemselvesascandidatesornominateanyotherpersonsascandidatesat
anyelectionofmemberstoanyLegislativeAssemblyorotherbodyhavingforthe
timebeingauthorityeitheraloneorinconjunctionwithanyotherbody,toenact
lawswhichhaveeffectthroughoutGhanaortoaCouncilwithinthemeaningofthe
LocalGovernmentAct,1961(Act54);
(c)indicatepubliclytheirsupportfororoppositiontoanypoliticalpartiesor
candidatesortothepoliticalprogrammesofsuchpartiesorcandidates;
(d)publishorcausetobepublishedanyarticleorothermatterofapartisan
politicalnature;
(e)canvassonbehalfofpoliticalcandidates;
(f)speakinpublicorbroadcastonanysubjectofapartisanpoliticalnature;
(g)allowthemselvestobeinterviewedorexpressanyopinionforpublicationon
anysubjectofapartisanpoliticalnature,
andanycontraventionoftheprovisionsofthissubparagraphmaybecertifiedto
beaseriousmisconductinrelationtothedutiesofamemberoftheBoardforthe
purposesofsubparagraph(6)ofthisparagraph.
(12)ThereshallbeaSecretarytotheBoardwhoshallbeanofficerofthe
Corporationandwhoshall,subjecttosuchgeneraldirectionsastheBoardmay
giveandsubjecttotheotherprovisionsofthisDecree,arrangethebusinessfor,and
causetoberecordedandkepttheminutesofallmeetingsoftheBoard.

Section - 4 - Meetings Of The Board.


(1)TheBoardshallordinarilymeetforthedespatchofbusinessatsuchtimesandat
suchplacesastheChairmanmayappointbutshallmeetatleastonceinevery
month.

(2)AspecialmeetingoftheBoardshallbecalledbytheSecretarytotheBoard
uponarequestmadetohimforthatpurposeinwritingsignedbynotlessthanfour
membersoftheBoardincludingtheDirectorGeneral.
(3)AteverymeetingoftheBoardatwhichheispresent,theChairmanshall
presideandinhisabsence,amemberoftheBoardappointedbythemembers
presentfromamongthemselvesshallpreside.
(4)QuestionsproposedatameetingoftheBoardshallbedeterminedbysimple
majorityofmemberspresentandvotingandintheeventofanequalityofvotes,
thepersonpresidingshallhaveasecondorcastingvote.
(5)ThequorumatanymeetingoftheBoardshallbefoursohoweverthatno
quorumshallbeformedunlesstheDirectorGeneralispresentatthemeeting.
(6)TheBoardmayatanytimecooptanypersonorpersonstoactasanadviseror
advisersatanyofitsmeetingsso,however,thatnopersonsocooptedshallbe
entitledtovoteatanysuchmeetingonanymatterfordecisionbytheBoard.
(7)ThevalidityofanyproceedingsoftheBoardshallnotbeaffectedbyany
vacancyamongitsmembersorbyanydefectintheappointmentofanyofthem.
(8)AnymemberoftheBoardwhohasanyfinancialinterestinanycompanyor
undertakingwithwhichtheCorporationproposestoenterintoanycontractor
whohasanyfinancialinterestinanycontractwhichtheCorporationproposesto
makeshalldisclosetotheBoardinwritingthenatureofhisinterestandshallbe
disqualifiedfromparticipatinginanydeliberationsoftheBoardonthecontractor
votinginanydecisionoftheBoardonsuchcontract.
(9)Anycontraventionoftheprovisionsofsubparagraph(8)ofthisparagraph
maybecertifiedtobeaseriousmisconductinrelationtothedutiesofamemberof
theBoardforthepurposesofsubparagraph(6)ofparagraph3ofthisDecree.

Section - 5 - Role Of The Board.


(1)TheBoardshallberesponsibleforthebroaddirectionoftheaffairsofthe
Corporation,theconductofcorporaterelationswiththeGovernmentandits
agenciesandtheauthorizationoftheannualreportoftheCorporation'sactivities.
(2)Foritsdeliberations,theBoardmayutilizeFinance,ProgrammeAdvisoryand
Staffcommitteeswhichmaydealwithsuchmattersasthefollowingwhicharenot

necessarilylimitinginscope:
(a)establishmentandrevisionofbyelawsandotherinstrumentsmadeunder
paragraph19ofthisDecree;
(b)establishmentofbasicpoliciesanddirectivesdeemednecessaryforthe
guidanceoftheDirectorGeneral;
(c)establishmentorapprovalofobjectiveswithrespecttoadministrative,
coverage,financeandcontrol,management,programmingandsales;
(d)considerationofbiannualreportsofaccountabilitybytheDirectorGeneral;
(e)adviceandguidancewithrespecttoanyaspectoftheaffairsoftheCorporation.

Section - 6 - Director-General And Deputy Directors-General.


(1)ThereshallbeaDirectorGeneraloftheCorporationwhoshallbethechief
executiveofficeroftheCorporationandshallberesponsibletotheBoardforthe
daytodayadministrationoftheCorporation.
(2)ThereshallalsobetwoDeputyDirectorsGeneraloftheCorporationwhoshall,
subjecttotheprovisionsofthisDecree
(a)bechargedwiththeperformanceofanyofthefunctionsoftheDirectorGeneral
whentheDirectorGeneralisabsentfromGhanaorisotherwiseincapacitatedfrom
performingthatfunction,and
(b)otherwiseassisttheDirectorGeneralinthedischargeofthesaidfunctionsand
performsuchfunctionsastheDirectorGeneralmaydelegatetoanyofthem,
andaccordinglyunlessthecontextotherwiserequiresanyreferenceinthisDecree
toDirectorGeneralshallincludereferencetoaDeputyDirectorGeneral.
(3)TheDirectorGeneralandthetwoDeputyDirectorsGeneralshallbeappointed
bytheNationalRedemptionCouncilandshallholdandvacateofficeuponsuch
termsandconditionsastheNationalRedemptionCouncilmaydetermine.
(4)ApersontobeappointedDirectorGeneralorDeputyDirectorGeneralshallbe
apersonwhohashadexperienceofandhasdemonstratedcompetenceinoneor
moreofthefollowingfieldsofendeavour,thatistosay,publicutilityoperation
andpractice,industry,broadcasting,trade,finance,scienceandadministration.

(5)TheDirectorGeneralshallexercisesupervisionandcontrolovertheactsofall
employeesoftheCorporationandshallberesponsiblefordisposingofall
questionsrelatingtothepay,privilegesandallowancesoftheCorporation's
employeesaslaiddownbytheBoard.
(6)TheDirectorGeneralisresponsiblefortheimplementationoftheCorporation's
policies,byelaws,otherinstrumentsandobjectivesinthedaytodayoperationsof
theaffairsoftheCorporation.[AssubstitutedbytheGhanaBroadcasting
Corporation(Amendment)Decree,1975,(NRCD334)s.1a].

Section - 6 - (A) Directors And Regional Directors/Managers.


(1)ThereshallbeinchargeofeachdivisionandregionalofficeoftheCorporationa
DirectorandRegionalDirector/Managerrespectively.
(2)TheDirectororRegionalDirector/ManagershallbeappointedbytheNational
RedemptionCouncilontheadviceoftheDirectorGeneral.";

Section - 7 - Staff.
(1)TheBoardmayfromtimetotimeappointsuchemployeesasmaybenecessary
fortheproperandefficientconductofthebusinessandfunctionsofthe
Corporation.
(2)EmployeesoftheCorporationshallholdandvacateofficeuponsuchtermsand
conditionsastheBoardmaydetermine.
(3)TheCorporationmayalsoengagetheservicesofsuchconsultants,advisersand
otherpersonsastheBoardmaydetermineanduponsuchconditionsastheBoard
mayprescribe.
(4)PublicofficersmaybetransferredtotheCorporationormayotherwisegive
assistancethereto.
(5)TheCorporationshallhaveanInternalAuditorandtheappointmentand
dismissalofanypersontoorfromthepostofInternalAuditorshallbemadebythe
AuditorGeneral.[AsinsertedbytheGhanaBroadcastingCorporation
(Amendment)Decrree,1975,(NRCD334)s.1b].
(6)SubjecttotheprovisionsofthisDecree,anInternalAuditorshallberesponsible

totheDirectorGeneralfortheperformanceofhisfunctions.
(7)AspartofhisfunctionsunderthisDecree,anInternalAuditorshall,atintervals
ofthreemonths,prepareareportontheinternalauditworkcarriedoutbyhim
duringtheperiodofthreemonthsimmediatelyprecedingthepreparationofthe
reportandshall,assoonaspracticableafterthepreparationofthereport,submit
thereporttotheDirectorGeneral.
(8)TheDirectorGeneralshall,assoonaspracticableafterreceivinganyreport
submittedtohimundersubparagraph(7)ofthisparagraph,forwardacopyofthe
reporttotheChairmanandalsoacopythereoftotheAuditorGeneral.
(9)Withoutprejudicetothegeneraleffectofsubparagraph(7)ofthisparagraph,
anInternalAuditorshallmakeineachreportsuchobservationsasappeartohim
necessaryastotheconductofthefinancialaffairsoftheCorporationduringthe
periodtowhichthereportrelates.

Section - 8 - National Requirements Of The Corporation.


(1)ItshallbethedutyoftheCorporationtoprovideasapublicservice,
independentandimpartialbroadcastingservices(soundandtelevision)forgeneral
receptioninGhana.
(2)TheCorporationshallincollaborationwithsuchdepartmentsofStateasmay
beappropriateprovideanexternalsoundservicethroughtransmissionforgeneral
receptionincountriesandplacesoutsideGhana.
(3)TheCorporationmayengageincommercialbroadcastingthroughthesaleof
paidadvertisementsscheduledatprescribedspotsinitsprogrammeservice.

Section - 9 - Output Requirements.


(1)Initspublicservicebroadcasting,theCorporationisexpectedtoprovidefor
(a)Governmentpronouncements,thatis,speechesbymembersoftheNational
LiberationCouncilandCommissionersresponsiblefordepartmentsofState
consistingofstatementsoffactorexplainingthepoliciesandactionsofthe
Government;
(b)partypoliticalspeechesdealingwiththeviewsandpoliciesofthevarious
politicalparties(whentheycomeintobeing);

(c)speechesexpressingdifferentpointsofviewonmattersofcontroversy;
(d)mattersofanykind(includingreligiousservicesorceremonies)representing
themainstreamofreligiousthoughtorbeliefinthecountry.
(2)Initsbroadcastingoftheitemsmentionedinsubparagraph(1)ofthis
paragraphtheCorporationshallallocateandapportionairtimeequitablybetween
theparties,pointsofviewandreligiousbodiesaccordingtotheirrespectiveclaims
upontheinterestofmembersofthepublicofGhana.

Section - 10 - Funds Of Corporation.


(1)ThefundsoftheCorporationshallinclude
(a)grantsmadebytheGovernmenttotheCorporation;
(b)loansobtainedontheguaranteeoftheGovernmentfromtheNational
InvestmentBankorsuchotherBanksastheCommissionerresponsibleforFinance
mayapprove;
(c)anymoneysaccruingtotheCorporationinthecourseofthedischargeofits
functions.
(2)AllmoneysreceivedbytheCorporationshallbedepositedtothecreditofthe
CorporationintheGhanaCommercialBankorsuchotherbankasthe
CommissionerresponsibleforFinancemayapprove.
(3)NoloansshallberaisedbytheCorporationexceptwiththepriorapprovalof
theCommissionerresponsibleforFinance.

Section - 11 - Accounts.
(1)TheCorporationshallkeepproperbooksofaccountandproperrecordsin
relationthereto.
(2)TheCorporationshallprepare,inrespectofeachfinancialyear,astatementof
accountwhichshallinclude
(a)abalancesheet,astatementofincomeandexpenditureandastatementof
surpluscontainingsuchinformationashadtheCorporationbeenacompany

registeredundertheCompaniesCode(Act179)wouldberequiredtobelaidbefore
thecompanybytheDirectorsatanannualmeeting,and
(b)suchotherinformationinrespectofthefinancialaffairsoftheCorporationas
theCommissionerortheCommissionerresponsibleforFinancemayrequire.
(3)TheCorporationshall,assoonaspossiblebutwithinthreemonthsafterthe
terminationofeachfinancialyear,submittotheCommissioneranannualreport
whichshallincludethestatementsofaccountspecifiedinsubparagraph(2)ofthis
paragraphandtheCommissionerresponsibleforInformationshallassoonas
practicablecauseittobelaidbeforetheNationalLiberationCouncil.
(4)TheCorporation'sfinancialyearshallendonthe30thdayofJuneineachyear.
(5)Forthepurposesofthisparagraphtheperiodextendingfromthe
commencementofthisDecreetothe30thdayofJune,1968,shallbedeemedtobea
financialyear.

Section - 12 - Audit.
(1)ThebooksandaccountsoftheCorporationshallbeauditedeachyearbythe
AuditorGeneraloranauditorappointedbyhim.
(2)TheAuditorGeneralshall,notlaterthanthe30thdayofSeptemberineach
year,forwardtotheCommissioneracopyoftheauditedaccountsofthe
Corporationforthefinancialyearendingthe30thdayofJuneimmediately
precedingandhisreportthereon.
(3)TheAuditorGeneralortheauditorappointedbyhimshallreportannuallyto
theBoardtheresultofhisexaminationoftheaccountsandfinancialstatementof
theCorporation,andthereportshallstatewhetherinhisopinion
(a)properbooksofaccountshavebeenkeptbytheCorporation;
(b)thefinancialstatementoftheCorporation:
(i)waspreparedonabasisconsistentwiththatoftheprecedingyearandisin
agreementwiththebooksofaccounts;
(ii)inthecaseofthebalancesheet,givesatrueandfairviewofthestateofthe
Corporation'saffairsasattheendofthefinancialyear;

(iii)inthecaseofthestatementofincomeandexpenditure,givesatrueandfair
viewoftheincomeandexpenditureorprofitandlossoftheCorporationforthe
financialyear;
andtheAuditorGeneralortheauditorappointedbyhimshallcalltheattentionof
theBoardtoanyothermatterfallingwithinthescopeofhisexaminationwhich,in
hisopinion,shouldbebroughttotheattentionoftheBoard.
(4)TheAuditorGeneralortheauditorappointedbyhimshall,fromtimetotime
maketotheCorporationsuchotherreportsashemaydeemnecessaryorasthe
CommissionerresponsibleforFinancemayrequire.
(5)TheannualreportoftheAuditorGeneralortheauditorappointedbyhimshall
beincludedintheannualreportoftheCorporation.

Section - 13 - Power Of Corporation To Authorise Entry Of


Lands.
(1)Subjecttotheprovisionsofthisparagraphanypersonauthorisedinthatbehalf
bytheCorporationforthedischargeofitsfunctionsunderthisDecreemayenter
andremainonanyland
(a)forthepurposeoferecting,maintainingandinspectinganyinstallations
belongingtotheCorporation(suchasitswiredbroadcastinginstallations)orfor
thepurposeofrepairing,alteringorremovinganysuchinstallations;
(b)tocutandremoveonthesiteofanyproposedorexistinginstallationallsuch
treesandunderwoodasmayinterfereorbelikelytointerferewiththeconstruction
orproperworkingofanyinstallation;and

(c)forthepurposeofcarryingoutanyotherworkoractivityreasonablynecessary
forgivingeffecttotheprinciplesandpurposesofthisDecree.
(2)Exceptwiththeconsentoftheowneroroccupierofthelandorofhis
authorisedagentnopersonshallenteruponanylandundersubparagraph(1)of
thisparagraphexceptbydayorunlesstheowneroroccupierorhisauthorised
agenthasbeengivenreasonablenoticeoftheintentiontoenterthelandandofthe
purposeofsuchentry:
Providedthatwheretheconditionofanyinstallationissuchastoendangerlifeor
propertyapersonauthorisedbytheCorporationmayenteranylandonwhichthe
installationissituatedatanyreasonabletimeforanyofthepurposessetoutinsub

paragraph(1)ofthisparagraph.
(3)Iftheowneroroccupierofanylandtobeenteredunderthisparagraphorhis
authorisedagentcannotbefoundafterreasonableenquiryitshallbesufficientfor
thepurposesofsubparagraph(2)ofthisparagraphifthenoticereferredtointhat
subparagraphisputintowritingandaffixedtosomeconspicuousplaceonthe
landproposedtobeenteredforareasonablelengthoftime.
(4)Anypersonauthorisedtoenteranylandunderthisparagraphshall,in
discharginganyfunctionunderthisparagraphdoaslittledamageaspossibleand
theCorporationshallpaycompensationinrespectofsuchdamageandwherethe
surfaceofanyroadorstreethasbeendisturbedinthedischargeofanysuch
function,theCorporationshall,asfaraspracticablerestoreittoitsformer
condition.
(5)Theamountofanycompensationtobepaidundersubparagraph(4)ofthis
paragraphshall,inthecaseofdifference,besettledbyarbitrationinaccordance
withtheprovisionsoftheArbitrationAct,1961(Act38).

Section - 14 - Interference With Wires, Etc. Of Corporation By


Other Person.
WhereanyGovernmentDepartment,localauthority,statutorycorporationorany
individualorotherpersonundertakesanyrepairsoralterationsofanyroad,street,
railway,wharf,pier,bridge,waterworksorofanytelegraphic,telephonic,or
electricpowercables,entailingtheremovaloforanyinjurytoanywired
broadcastingoutputorplant,worksorequipmentbelongingtotheCorporation,
theexpensesoftherepair,removalandreplacementofsuchwiredbroadcasting
output,plant,worksorequipmentshallbeborneasthecasemaybe,bythe
GovernmentDepartment,localauthority,statutorycorporation,individualorother
personconcerned.

Section - 14 - (A) Unauthorised Connection To Broadcasting


Output, Etc. Of Corporation.
Anypersonwhowithintenttoreceiveordisruptanybroadcastingserviceofthe
CorporationandwithouttheauthorityoftheCorporation,makesaconnectionto
anypartofthewiredbroadcastingoutput,network,plantorequipment,ofthe
Corporationcommitsanoffenceandshallbeliableonafirstconvictiontoafinenot
exceedingfiftynewcedis,andonasubsequentconvictiontoafinenotexceeding
onehundrednewcedisortoatermofimprisonmentnotexceedingsixmonthsor

tobothsuchfineandimprisonment.[AsinsertedbyGhanaBroadcasting
Corporation(Amendment)Decree,1969(NLCD385)s.1].

Section - 15 - Radio And Television Receiving Set Licence Fees


To Be Fixed On The Recommendations Of The Corporation.
Wherepowerisgrantedbyanyenactmenttoanyauthorityorpersontofixthefees
tobepaidforobtainingaradioreceivingsetlicenceoratelevisionreceivingset
licencethepowershallonlybeexercisableupontherecommendationsofthe
CorporationandtheTelecommunicationsAct,1961(Act112)andtheTelevision
LicensingDecree,1966(NLCD89)shallhaveeffectaccordingly.

Section - 16 - Corporation Exempted From Provisions Of Act


112.
TheprovisionsoftheTelecommunicationsAct,1962(Act112)shallnotapplysoas
torequiretheCorporationtoobtainanylicenceunderthatAct.

Section - 17 - Exemption From Income Tax.


TheCorporationinitscommercialandancillarybusinessoperationsshallbe
exemptedfromtheprovisionsoftheIncomeTaxDecree,1966(NLCD78).

Section - 18 - Emergency Power Of The Government.


(1)WhereatanytimetheNationalLiberationCouncilisoftheopinionthata
nationalemergencyhasariseninwhichitisnecessaryinthepublicinterestthatthe
GovernmentshouldcontrolbroadcastsmadebytheCorporation,theNational
LiberationCouncilmaysodeclarebynoticepublishedintheGazetteorbysuch
othermodeofpublicannouncementornotificationasthecircumstancesmay
permit.
(2)Whereanemergencyhasbeendeclaredundersubparagraph(1)ofthis
paragraph
(a)theCommissionermaygivesuchdirectionstotheCorporationastheNational
LiberationCouncilmaydeemtobenecessarytomeettherequirementsofthe
emergencysodeclared,andtheCorporationshallgiveeffecttosuchdirections,

(b)theGovernmentmaytakeovertheBroadcastingServiceoftheCorporation,so,
however,thatitshallonlydosobyspecificdemandmadeinthatrespectbythe
ChairmanorinhisabsencebytheDeputyChairmanoftheNationalLiberation
Council.

Section - 19 - Power To Make Bye-laws And Other Instruments.


TheCorporationmaybytheBoardmakebyelawsandotherinstrumentsnotbeing
inconsistentwiththeprovisionsofthisDecreeforthepurposeofregulatingits
businessoranymatterfallingwithinthescopeofitsfunctionsandwithout
prejudicetothegeneralityoftheforegoing,suchbyelawsorotherinstruments
mayregulatetheapplicationoftheCorporation'ssealtolegaldocumentsandmay
alsoregulatetheconditionsofserviceoftheemployeesoftheCorporation.

Section - 20 - Interpretation.
InthisDecree,unlessthecontextotherwiserequires
"Corporation"meanstheGhanaBroadcastingCorporationestablishedbythis
Decree;
"Commissioner"meanstheCommissionerresponsibleforInformation.

Section - 21 - Dissolution And Transfer Of Assets And


Liabilities.
(1)Thebodycorporateknownimmediatelybeforethecommencementofthis
DecreeastheGhanaBroadcastingCorporationisherebydissolvedand
consequentlytheGhanaBroadcastingCorporationInstrument,1965(LI472)is
herebyrevoked.
(2)Allassets,rightsandliabilitiesofthesaidbodyareherebytransferredtothe
Corporation.
(3)TheDirectorGeneral,theDeputyDirectorGeneralandallemployeesofthe
saidbodyholdingofficeimmediatelybeforethecommencementofthisDecree
shallcontinueinofficesubjecttotheprovisionsofthisDecree.
(4)AnyinstrumentmadeunderPartXoftheGhanaBroadcastingCorporation

Instrument,1965(LI472)andinforceimmediatelybeforethecommencementof
thisDecreeshallcontinueinforceasifmadeunderparagraph19ofthisDecree.
(5)Anyreferenceinanyenactmentinexistenceatthecommencementofthis
DecreetotheGhanaBroadcastingCorporationshallbeconstruedasareferenceto
theCorporationestablishedbythisDecree.
