Intellectual Property Rights (IPR) are conferred in respect of work that results from
the creative and inventive activity of the human mind. The protection of intellectual
property plays a key role in gaining an achieving technological, industrial and
economic growth of a country. Intellectual Property Rights include the patent,
copyright and related designs of integrated circuits and protection of know-how and
undisclosed information. Patents are legal protection for new inventions
government for a limited period of time. The number of patents filed in a
particular country has been an index of technological development of the country.

technological community.
DO YOU KNOW?
Patents are granted for even small but novel inventions.
Patents are territorial right. There is no Global or World patent.
For obtaining Patent rights in different countries, one has to submit separate
patent applications in al the countries of interest.
If the country of interest is a member country of Patent Corporation Treaty
(PCT), one can file through PCT and mention the names of the countries of
interest as Designated States.
If the country of interest is not a member country of PCT, one can file a
Patent application in the respective Patent Office of that Country.
Patents cannot be granted for scientific principles, formulation of abstract
theory, frivolous inventions contrary to well established natural laws or
morality for injurious to public health, method of agriculture or horticulture,
inventions related to atomic energy and processes for medical treatment.

TIPS TO INVENTORS
Do not publish/present/display your invention before filing patent application
Maintain records of your research methodically
Conduct patent search before filling patent application to judge the
patentability especially to establish novelty.
Do not discuss your invention with anybody including your colleagues
without signed contract of confidentially.
File patent application as early as possible. You may even file application with
provisional specifications.
Patent is a techno-legal document. It is always better to draft claims through
an attorney.
Define your rights, royalties & commercial benefits clearly with your coworkers and employers.
While licensing, define rights to be transferred clearly.
Ensure maximum commercial exploitation within the tenure of the
intellectual Property Right.

Computer software per se are not Patentable but copyrightable

items in India. However, these are Patentable aboard.
