Sub: Implementation of Section 23 of Chapter 03 of Metalliferous Mining


Regulations, 1961 through Board of Mining Examinations, Director
General of Mines Safety, Dhanbad the matter is pending for more
than 50 years (since 1961) in the interest of Thousands of victimized
Mining Engineers in India and for the grant of Exemption Certificates
all the eligible Mining Engineers by way of consideration for ONE
TIME RELAXATION (resubmitted with modifications) reg.

This is bring to your kind knowledge that in India the people who studied BE /
BTech / Diploma in Mining Engineering are to possess Mines Managers First
Class / Second Class Certificates of competency -Restricted / Unrestricted
issued by the Board of Mining Examinations, Director General of Mines Safety,
Dhanbad, as per the provisions of MMR, 1961 / CMR, 1957, under Ministry of

Labour and Employment, Government of India, for employments in Mining, latest


copies received from DGMS, Dhanbad vide RTI Application dated09/06/2015
(enclosed in Annexure-I).
Whereas, the Board of Mining Examinations, Director General of Mines
Safety (DGMS), Dhanbad who is the competent authority to the issue of
above certificates as per the provisions mentioned in MMR, 1961 / CMR,
1957, has failed to implement provisions of Section 23 of Chapter 03 of
MMR, 1961 for the issue of SERVICE CERTIFICATES OF FIRST CLASS /
SECOND CLASS MINES MANAGERS CERTIFICATES, WITHOUT
CONDUCTING EXAMINATIONS, till this day nor any omission clause /
deletion clause / amendment / notings / circulars issued in this connection.
The matter is conveyed to the Board of Mining Examinations / DGMS, Dhanbad
for more than 15 years and is being persuaded through Right to Information Act,
2005 since 2012. But, till this day, no action is initiated by the Board of Mining
Examinations, DGMS, Dhanbad for the implementation of Section 23 of Chapter
03 of MMR, 1961 and hence CMR, 1957.
Thousands and Lakhs of Mining Engineers who obtained BE / BTech /
Diplomas in Mining Engineering in India are being victimized by way of
forcing them to write WRITTEN EXAMS which is not a required under the
provisions of Section 23 of Chapter 03 of MMR, 1961 and hence CMR, 1957.
The Board of Mining Examinations and Director General of Mines Safety,
Dhanbad are being cheating the Mining Engineers against their carrier upgradation and progression for then 50 years from the date of issue of MMR,
during 1961 and CMR, during 1957.
Recently, a candidate namely Srinivas, Foreman, Chettinad / Dalmia Cements
Ltd., Tamilnadu, as committed suicide and died in this connection (?). No action
is being taken by the concerned authorities leading continued harassment of the
candidates who possess BE / BTech / Diploma in Mining Engineering by way of
mental torture, humiliation, depromotions, suppression, depressions, etc., for the
want of FIRST CLASS / SECOND CLASS MINES MANAGERS
CERTIFICATES, by forcing them to undergo COMPITITIVE WRITTEN
EXAMINATIONS, which is not required as per the provisions of Section 23 of
Chapter 03 of MMR, 1961 and hence CMR, 1957 (justifications enclosed
Annexure II)
The information received through RTI, from Director General of Mines Safety,
Dhanbad is implying that the blame is being placed to the Secretary, Ministry
of Labour and Employment and the Government of India i.e., President of
India, for the want of Government Gazette Notifications for the
implementation of provisions of Section 23 of Chapter 03 of MMR, 1961 and
hence, CMR, 1957, for the issue of SERVICE CERTIFICATES FOR FIRST

CLASS / SECOND CLASS MANAGERS, WIOUTH WRITTEN EXAMINATIONS


for those who completed BE/BTech/Diploma with 06 / 08 years of mining
experience (enclosed in Annexure III).
Hence, the concerned authorities mentioned above, are requested kindly to look
into the matter on priority basis in the interests of Lakhs and Thousands of
Mining Engineers in India who are suffering the humiliation and victimization by
the Board of Mining Examinations and Director General of Mines Safety, DGMS,
Dhanbad.
Note 1 :

A protest against the amendments of MMR, 2012 and CMR, 2006


(by way of deletion of Section 23 of Chapter 03 of MMR, 1961),
without the implementation of Section 23 of Chapter 03 of MMR,
1961 / hence CMR, 1957, to presently all eligible candidates and
hence, is hereby placed on behalf of the lakhs and thousands of
victimized Mining Engineers in India and the injustice caused to
them in their de-promotions / lack of promotional avenues and
degradation of their carriers / services for the want of issue the
above certificates by the Board of Mining Examinations, DGMS,
Dhanbad and hence the Government of India.

The President of India, Government of India, New Delhi is kindly requested


for the grant of One Time Relaxation for the issue of Exemption Certificates
of First Class / Second Class Manager, for all eligible candidates / Mining
Engineers who has satisfied the provisions for issue of Service Certificates
having BE / BTech / Diploma in Mining Engineering with 06 / 08 years of
mining experience as on 20/08/2015 ( or those who BE/ BTech in Mining
Engineering appeared for First Class Examination as on 2009 and those
with Diploma in Mining Engineering appeared for First Class Manager
Examination as on 2007) as per the provisions of Section 23 of Chapter 03
of MMR, 1961 and hence, CMR, 1957, in view of the lakhs and thousands of
Mining Engineers being victimized by the Board of Mining Examinations,
DGMS, Dhanbad for more than 50 years. This will be a justice for all those
who suffered the losses in carrier progress / employment / promotions /
humiliation / degradations / etc.
The Minister for Labour and Employment, Government India / Secretary,
Ministry of Labour and Employment, Government, New Delhi are kindly
requested for necessary instructions to the concerned authorities for the
implementation of Section 23 of Chapter 03 of MMR, 1961 and hence, CMR,
1957 and hence, for the consideration for the grant of One Time Relaxation
for the issue of Exemption Certificates of First Class / Second Class
Manager, for all eligible candidates / Mining Engineers who has satisfied
the provisions for issue of Service Certificates having BE / BTech / Diploma
in Mining Engineering with 06 / 08 years of mining experience as on

20/08/2015 ( or those who BE/ BTech in Mining Engineering appeared for


First Class Examination as on 2009 and those with Diploma in Mining
Engineering appeared for First Class Manager Examination as on 2007).

The Chairman, Board of Mining Examinations, Director General of Mines


Safety, Dhanbad is kindly requested to initiate necessary action for the
implementation of Section 23 of Chapter 03 of MMR, 1961 and CMR, 1957;
hence for the grant of ONE TIME RELAXATION by of issue of Exemption
Certificates of First Class / Second Class Managers Certificate to all those
eligible candidates who appeared for exams (BE/BTech with 06 years of
experience as on 2009 and Diploma holder with 08 years of experience as
on 2007) before the implementation of Amended MMR/ CMR.
Note 2 :

As the Board of Mining Examinations and the Director General of


Mines Safety, DGMS, Dhanbad are responsible for the
implementation of provisions under MMR and CMR, they have
failed in their duties for last 50 years, even though the subject is
raised on many occasions and through communications to them
leading to victimization of lakhs and thousands of eligible mining
engineers in India.

It is has been resolved by all those victimised by DGMS, Dhanbad that in case of
failure for necessary positive action by the concerned authorities within 30 days
from the receipt of this communication, in the above matter, we (Victimized
Mining Engineers Association of India VMEAI) may be forced to approach a
competent Court of Law for Justice.
