Okay Walid - after our conversation I went ahead and did a google search on the names below. I am not sure if
they are spelled correctly. I did not find anything questionable. Since I do not know most of them - I cannot
vouch for their reputations. You will have to do that. Kamal Nawash cannot be on the list - for the reasons we
discussed.
Remember this: We do not want to do anything that might harm the President's chances of re-election by
exposing him to any controversy. If you have doubts about these names - perhaps we don't need to do this
press release at all.

The major speakers will be former Cong. JC Watts in Columbus, and Maryland Lt. Gov. Michael Steele and Texas
Railroad Commissioner Michael Williams for Dayton and Toledo. More information with specific details will be
available tomorrow (Wednesday), but I wanted you to save the date and begin contacting others so that we will
have as many people as possible attending.
The message of these events will include empowerment (economic and educational) and highlight the policies
and accomplishments of the Bush-Cheney Administration. The Toledo event has been designated as an Ohio and
a national event for pastors and the faith-based community. A Friday article in the New York Times ("Black
Pastors Backing Bush Are Rare, But Not Alone") prematurely announced the Toledo event, but underscores the
importance of our state and the African American clergy and community to winning election.
All three events are invitation only, closed to the media and RSVP's are needed, but we hope you will share your
invitation with as many people as possible within your sphere of friends and that you will bring others with you

The best case I've found so far is New Orleans Pub. Serv., Inc. v. Council of New Orleans, 491 U.S. 350, 359
(1989). In this case, the Court found that Younger abstention did not apply to a state court's review of city
council's decision. The Court reasoned that Younger principles did not weigh as heavily in cases that do not
implicate the state courts' ability to perform their judicial functions ("[I]t has never been suggested that Younger
requires abstention in deference to a state judicial proceeding reviewing legislative or executive action. Such a
broad abstention requirement would make a mockery of the rule that only exceptional circumstances justify a
federal court's refusal to decide a case in deference to the States."). Depending on the posture of our case, this
could be a slam-dunk argument: for instance, in the event that the state court was reviewing a decision by the
Secretary of State to leave Nader off the ballot. I do not know if this is in fact the posture of the case, but from
your brief description I suspect that it was not.
Nonetheless, New Orleans does have some favorable language that could be used to argue that abstention is the
"exception, not the rule," and that the Younger should therefore not apply in this instance:
[T]here are some classes of cases in which the withholding of authorized equitable relief because of undue
interference with state proceedings is "the normal thing to do," Younger v. Harris, 401 U.S., at 45. We have
carefully defined, however, the areas in which such "abstention" is permissible, and it remains "'the exception,
not the rule.'" Hawaii Housing Authority v. Midkiff, 467 U.S. 229, 236 (1984), quoting Colorado River Water
Conservation Dist. v. United States, 424 U.S. 800, 813 (1976). As recently as last Term we described the federal
courts' obligation to adjudicate claims within their jurisdiction as "'virtually unflagging.'" Deakins v. Monaghan,
484 U.S. 193, 203 (1988) (citation omitted).
I just spoke with Katie Wheelbarger, and I explained to her that there are two ways to attack Younger. First, we
could argue that the constitutional interests outweigh the state interests. I think this is our strongest argument
and I am looking for any cases that have so held. I've already looked at Supreme Court and 10th Circuit cases
on this point and haven't found anything helpful, but I am going to broaden my search and try again. Second,
we could argue that the state court does not provide us an adequate opportunity to raise the constitutional
challenge because of the time sensitivity involved. It will be difficult to prevail on this argument if we did not
bother to raise these issues in the state court. There are several cases which suggest that the plaintiff's failure to
raise a claim in the state court prevents it from later claiming that it has not had an adequate opportunity to
challenge the constitutionality of the statute. This seems to me to make sense. Therefore, I will continue to focus
on the first argument unless I hear otherwise from you. Even if we do not find a case on point, we can still make
the argument on the basis of Younger and Pennzoil themselves that abstention should not be applied because
the constitutional interest at stake vastly outweighs any state interest in this case.

I spoke with a union official from Hillsborough County, Local 2294. He said they have not made an endorsement
and probably will not be making one. It was his feeling that most locals in Florida would not come out and
endorse either candidate. The majority of his members do support President Bush. He indicated that if there was
an event that was taking place in the Tampa area, there would be no problem turning out a lot of firefighter
support for President Bush. They are very interested in an event such as this.
I get the feeling there is a reluctance to go against the IAFF down there. In 2000, Florida was the only state
organization to go against the IAFF endorsement of Gore and Shaitberger came down hard on them. I am still
waiting to hear from Miami.

is a critical one and we've got a great team. We've got a lot of work to do in the coming weeks, but hopefully will
have some fun too.
You will be receiving a ton of info in the coming days.. specifically, Rebecca Maescher (of the Convention staff
and who will be of huge support to our team) will forward to you a lot of very important info on the network
coverage, requests to date, etc etc .. please print it, study it carefully, begin to create a notebook, and be
prepared to contact your network key contacts. Most of these requests have been registered with the campaign,
the White House, and many of our individual super surrogates. Nonetheless, you will be responsible for your
specific network as we go forward. Our immediate task is to make sense of it all, help make strategic decisions
and begin to make commitments to our network counterparts. Nicole Devenish, Pam Stevens, Jennifer Foley,
Taylor Griffen, Julie Cram and others will be integral to this entire process and work hand in hand with our team.
You will be receiving info on a daily basis, and we will establish a routine way to communicate. I am in NYC and
will be in DC on Thursday, hoping that we can meet to jump start our work. Please let me know your availability
to talk in the next 48 hours by phone. Forgive my delay in getting in touch, but look forward to seeing you soon.
