Dear Mr. Brown:
Re: Repairs of Paver Block Pavement Phase 2 Extension of Time
We acknowledge receipt of your letter dated October 24, 2011 with regard to the
captioned matter.
We acknowledge that the flow of water from an underground source, into the excavations
for edge beams along grid lines 10 and 13 delayed the laying of the paver blocks between
grid lines 10 and 13 and ultimately the placement of the asphaltic concrete between grid
lines 1 and 10. In the absence of this water it is likely that you would have completed
the concrete to edge beams along with the other major concrete works by January 31,
2011, and not January 29, 2011 as indicated in your letter. After January 29 there were
four (4) bays of the concrete base that neither had reinforcement or concrete in them (see
attached picture). As the works to the affected edge beams were completed on February
4, 2011, and the paver block works could not commence prior to February 7, 2011 we are
prepared to grant six (6) days extension of time covering the period February 1- 6, 2011.
In a meeting held on the site on February 18, 2011 involving you, your asphalt subcontractor and us it was agreed that the asphaltic concrete was to be placed on February
22, 2011 in order to allow for the completion of the paver block works against the edge
beams. At this said meeting your subcontractor indicated that water seemingly flowing
from the landside crane rail beam to the northern expansion joint in the concrete base was
undesirable and could be injurious to the newly laid asphalt if it were not addressed.
Subsequently via a telephone conversation (Curriah/Mudahy) on the evening of February
21, 2011 we agreed to postpone the placement of the asphaltic concrete and to address the
problem of the water.

On February 22 and 23 it was determined that the water was coming from the trough of
the landside crane rail beam through a damaged section of the beam itself. On February
24 and 25 the damaged section of the beam was cut out and reconstructed. We were
given verbal assurance on February 25, 2011 that the placement of the asphaltic concrete
would commence on February 28, 2011. However on February 28, 2011 while a
vibrating roller was brought to site the works did not commence. In response to the lack
of action on your part we wrote to you enquiring why the works had not commenced.
No response in writing was ever received.
While you have repeatedly suggested
thereafter that the delay was due to our request for a design for the asphaltic concrete mix
we hereby indicate yet again that this information had been requested from February 21,
2011 and was in fact a requirement of the Contract outlined in the Preliminaries. As
such we may not be held liable for the tardiness of your sub-contactor in providing this
information and any delay that may have resulted. Subsequent to the aforementioned we
are prepared to grant a further six (6) days extension of time covering the period February
22 27, 2011.
As there is no overlap between the two award periods, the overall extension of time to be
granted shall be twelve (12) calendar days or two (2) weeks in accordance with Clause 44
of the Conditions of Contract. This extension of time is granted with additional costs for
time-dependent preliminaries only as per Clause 44 (3) of the Conditions of Contract.
Based on the extended completion date of March 30, 2011 stated in our letter of March
15, 2011, the new extended completion date is April 11, 2011.
