CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF LEASE made entered by and between:
MR. & MRS. XAVIER MARC AMANTE, Filipinos, of legal ages, married and
residents of,
Banilad, Cebu City , hereinafter called the LESSOR , and
__________________________________, of legal age, married/single, and
a resident of _________________________________________________, hereinafter
called the LESSEE.
WITNESSETH:
That the LESSOR is the owner of a three-door apartment building (named OPAL
HOUSE), situated at 2nd Opal St., RGA Village, Obrero, Davao City, and more
particularly described under TCT No. T-400735 and registered with the Registry of
Deeds of Davao City.
That the LESSEE desires to occupy and lease an apartment unit of the property
(particularly described as Door 3);
Now therefore, for and in consideration of the rent and the foregoing premises, the
LESSOR hereby leases unto LESSEE and the latter accepts in lease from the LESSOR
that said unit for rent, subject to the following terms and stipulations, to wit:
1. That the terms of the lease shall be for a period of one (1) year, commencing
on July 01, 2015 and shall expire on July 01, 2016, automatically
renewable for a similar period at the option of both parties;
2. That upon the signing of this contract, the LESSEE shall advance the sum of
PESOS: FORTY FIVE THOUSAND (Php 45,000.00), to serve as TWO
(2) month/s security deposit and ONE (1) month advance rent;
3. That the monthly rent is fixed at PESOS: FIFTEEN THOUSAND
(P15,000.00) to be paid via eleven (11) post dated checks and dated within
the first five (5) days of the month. The eleven (11) postdated checks shall
be issued to the LESSOR upon execution of this contract and each check
shall be deposited to the bank account of the LESSOR on the scheduled due
date;
4. That failure to pay the monthly rent (due to unfunded check) shall entitle the
LESSOR to collect a penalty amounting to no less than PESOS: ONE
THOUSAND FIVE HUNDRED (P 1,500.00) per overdue monthly rent, which
shall become due and demandable, together with payment of the overdue
monthly rent, within twenty (20) days from the agreed due date.
5. That failure to pay the overdue monthly rent plus penalty within twenty (20)
days from the agreed due date shall IPSO FACTO terminate this contract and
shall mean that the LESSEE should vacate said leased premises
immediately. The LESSOR reserves his right to use the security deposit as
payment for the overdue rent, penalty, unpaid utility bills, and repairs needed
on the unit arising from the LESSEEs usage of said unit, and other related
charges.
6. That the leased properties shall be utilized by the LESSEE for residential
purposes only and that the LESSEE shall not sell, assign, sub-lease, or
mortgage his right or any part of the unit, or portion of the leased property,
without written consent of the LESSOR;
7. That the LESSEE shall not keep or store any contraband, prohibited drugs
and that by no means shall the leased properties be utilized for any illegal or
unlawful use or purpose;

8. That the LESSEE agrees to maintain the beauty and cleanliness of the
leased property by exercising caution on the display of unsightly objects such
as garbage and laundry, or any other unsightly materials at the faade and/or
front yard of the leased property or wherever visible from the vantage point of
the subdivision road;
9. That the LESSEE shall not introduce any improvement or renovation nor
make any alteration in the leased premises without the clear consent of the
LESSOR and that all alterations, additions, or improvements, if allowed, shall
become the property of the LESSOR at the expiration or termination of this
lease contract. The LESSEE may drive nails, screws, hocks or other
abutments on the walls, frames and other portion of the premises provided
the said wall shall be returned to its original state at the end of the contract or
occupancy and at the expense of the LESSEE;
10. That during the period of the lease, the LESSEE shall pay for all costs of
light, water, telephone, cable charges as billed in the leased premises as they
fall due. Should the termination of the services or utilities be caused due to
the delinquency of the LESSEE, all reconnection charges shall be borne by
the LESSEE.
Failure on the part of the LESSEE to pay for the utility
charges for two (2) consecutive months shall give the LESSOR the option to
cancel and terminate this contract and forfeit all of the security deposit as
payment for penalty and charges;
11. That should the LESSEE sign for a twelve-month contract but decide to
shorten his/her occupancy or pre-terminate the contract, all deposit and
advance rental previously paid shall be forfeited to cover for electricity and
water bills, cost of repairs, and related damages/losses.
12. That should the LESSEE desire to vacate the leased premises, he/she
should give LESSOR at least thirty (30) days prior notice and shall allow the
LESSOR to put up a For Rent sign at the faade of the leased premises.
13. That should the LESSEE vacate the apartment unit at the end of this
contract, the security deposit shall be used to pay for any un-settled monthly
rent, penalties, repairs, and unpaid utility bills. The remaining un-utilized
portion of the Security Deposit shall be returned to the LESSOR as soon as
the utility bills have been paid and repairs have been made on the unit.
14. That the LESSEE has examined said premises prior to and as a condition
precedent to his acceptance of this contract and is satisfied with the physical
condition thereof and that the LESSEE taking possession thereof shall be
conclusive evidence of the LESSEEs receipt of the leased premises in good
order, and that the LESSEE agrees to keep said premises clean, orderly, and
in good repair, and to yield back said premises to the LESSOR upon
termination of this lease in the same condition of cleanliness, sightlines and
orderliness as the date of execution thereof, regardless of whether the
termination is due to the expiration of the contract or in any manner
whatsoever;
15. That the LESSOR shall not be made responsible for any loss or damage to
property owned by the LESSEE arising from theft or burglary within the
leased premises as well as those caused by fire or other natural calamity;
16. That the LESSEE shall be responsible and liable for any acts, faults or
omissions of the members of his family, his helpers, and all other persons
allowed by him to have access to the leased properties;
17. That the LESSEE agrees to allow the LESSOR free access to the leased
premises for the purpose of examining the same, or making needful repairs
or alterations of said premises which the LESSOR may deem fit to make;

also to allow to be placed upon said premises, if time and/or conditions


warrant it during the term thereof, a For Sale and/or For Rent sign;
18. That this agreement shall be binding not only to the parties hereto but also to
their assigns and successor;
19. That the LESSOR reserves the right to cancel this contract in the interest of
peace and order and in case the LESSEE does not observe the diligence of a
good father of a family in the use and enjoyment of the leased premises;
20. That any violation or breach of any of the above terms and conditions shall
automatically cancel this contract and that in case of court action, the
LESSEE binds himself to pay penalties as well as liquidated damages to
include attorneys fees.
