No.923-L.- 20th April,1976.- The following Act of the West Bengal Legislature, having
been presented to by the Governor, is hereby published for general information:-

West Bengal Act XXIII of 1976

THE WEST BENGAL IRRIGATIION (IMPOSITION OF

WATER RATE FOR DAMODAR VALLEY CORPORATION
WATER) (AMENDMENT) ACT, 1976

Gazette, Extraordinary, of the 20th April, 1976]

An Act to amend the West Bengal Irrigation (Imposition of

water rate for Damodar Valley Corporation Water) Act, 1958.

WHEREAS it is expedient to amend the West Bengal West Bengal Act

Irrigation (Imposition of water rate for Damodar Valley XXVI of 1958
Corporation Water) Act, 1958, for the purposes and in the
Manner hereinafter appearing;

It is hereby enacted in the Twenty-seventh Year of the

Republic of India, by the Legislature of West Bengal, as
Follows:-

Short title 1. (1) This Act may be called the West Bengal
and Irrigation (Imposition of water rate for Damodar Valley
commencement Corporation Water) (Amendment) Act, 1976,

(2) It shall come into force on such date as the State

Government may, by notification in the Official Gazette,
appoint.

Amendment 2. In section 2 of the West Bengal Irrigation (Imposition

of section 2 of water rate for Damodar Valley Corporation Water)
of West Bengal Act, 1958 (hereinafter referred to as the said Act),-
Act XXVI of (i) in clause (8), for the word “March”, the word
1958 “February” shall be substituted,

(ii) after clause (8), the following clause shall be inserted,

namely:-
‘(8a) “summer season” means the part of the year from
March to April;’.

(Sections 3-5)

Amendment 3. In section 4 of the said Act-

of section 4
(a) In sub-section (1),-
(i) for the words “the kharif season or the rabi season”
in the two places where they occur, the words “kharif
season, rabi season or summer season shall be substituted,

(ii) for clauses (a) and (b) , the following clauses shall
be substituted, namely:-
“(a) rupees thirty-two for and area of .4047 hectares
for kharif season
(b) rupees forty-eight for an area of .4047 hectares
for rabi season, and
(c) rupees one hundred and sixty for an area of .4047
hectares for summer season,”;

(b) after sub-section (3), the following sub-section shall be

added, namely:-

“(4) The water rate imposed under clause (b) of sub-

section (3) shall remain effective until the same
is revised by the State Government by similar notification
issued under this section.”
Amendment 4. In section 7 of the said Act,-
of section 7 (a) in sub-section (1), for the words “the kharif season
or for the rabi season”, the words “kharif season,
rabi season or summer season” shall be substituted;

(b) in sub-section (2), for the words “the kharif season

or the rabi season” in the two places where they
occur, the words “kharif season, rabi season or
summer season’ shall be substituted.
Amendment 5. In section 10 of the said Act, in clause (b) of sub-
of section 10 section (1), for the words “the kharif season or the rabi
season”, the words “kharif season, rabi season or summer
season” shall be substituted.
