Classroom Limited Use License Agreement

Carefully read the following Terms and Conditions before installing this CD. By installing and using this
CD you accept the terms and conditions of this License Agreement. If you do not agree to these terms and
conditions, you may return this product along with all documentation and packaging, and your proof of
purchase to Kendall/Hunt Publishing Company within 90 days for a full refund.
Use of the term "you" herein means both the individual using this CD and his or her employer.
1. LICENSE. Kendall/Hunt Publishing hereby grants you, and you, individually and on behalf of your
employer, accept a non-exclusive and non-transferable license, to use this Manual of In-Flight Medical
Care CD-ROM, subject to all terms and conditions set forth herein.
2. TERM. This License Agreement is effective until terminated. You may terminate it at any time by
destroying the Licensed Program and all copies made (with or without authorization).
3. AUTHORIZED USE OF CD. You shall have the right to use this CD on a single computer and at a single
location. You may not use this CD on a network or multi-user basis without notifying Kendall/Hunt
Publishing Company and obtaining and paying for an appropriate network license to do so. You may
selectively copy and print the READ ME portion of the CD for your personal or classroom
non-commercial use; provided, however that any such portions of the CD will continue to be subject to the
terms and conditions of this License, and you acknowledge that any copy, modification, or portion printed
or merged into other programs is protected by U.S. copyright law. Upon termination of this License, you
agree to destroy all copies, modifications, and merged content in any form. IF YOU TRANSFER POSSESSION
OF ANY COPY, MODIFICATION, OR MERGED PORTION OF THE CD TO ANOTHER PARTY, YOUR LICENSE IS
AUTOMATICALLY TERMINATED AND ANY SUCH TRANSFER OR ATTEMPTED TRANSFER SHALL BE VOID.
4. USE RESTRICTIONS. You may not (a) copy the CD, except to load it into a computer in accordance with
instructions set forth in the Read Me file; (b) distribute copies of the CD to any other person; (c)
distribute copies of the contents of the CD to any other person except for your permitted classroom use
expressly provided for in this License; (d) modify, adapt, translate, reverse engineer, decompile,
disassemble, or create derivative works based on the CD; (e) copy, download, store in a retrieval system,
publish, transmit, or otherwise reproduce, transfer, store, disseminate, or use, in any form or by any
means, any part of the data or content contained within the CD except as expressly provided for in this
License; (f) transfer, resell, sublicense, lease, or grant any other rights of any kind to any individual
copy of the CD to any other person; or (g) remove any proprietary notices, labels or marks on the CD or
its contents. You shall take reasonable measures to maintain the security of the CD.
5. PROPRIETARY RIGHTS. You acknowledge and agree that the CD and its contents is the sole and exclusive
property of MedAire, Inc., and the CD is licensed to you only for the term of this License and strictly under the
terms hereof. MedAire, Inc. owns all right, title, and interest in and to the content in the CD. Except for the
limited rights given to you herein, all rights are reserved by MedAire, Inc.
6. TERMINATION. If you should fail to perform in the manner required in this License, this License shall
immediately terminate and Kendall/Hunt Publishing Company may exercise any rights it may have. Upon
termination, Kendall/Hunt Publishing Company may require that you destroy the CD and all content copied,
downloaded, or printed from the CD and that you so certify your compliance in writing to Kendall/Hunt
Publishing Company. All provisions of this License with regard to the protection of the proprietary rights
of Kendall/Hunt Publishing Company shall continue in force after such termination.
7. WARRANTIES, INDEMNITIES, AND LIMITATION OF LIABILITY. THE CD AND ITS CONTENTS IS PROVIDED
"AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE
IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. KENDALL/HUNT
PUBLISHING COMPANY NEITHER GIVES NOR MAKES ANY OTHER WARRANTIES OR REPRESENTATIONS
UNDER OR PURSUANT TO THIS LICENSE. Kendall/Hunt Publishing Company does not warrant, guarantee or
make any representations that the content or functions contained in the CD will meet your particular requirements
or that the operation of the CD will be uninterrupted or error free. The entire risk as to the results and
performance of the CD is assumed by you.

If the CD is defective in workmanship or materials and Kendall/Hunt Publishing Company is given timely
notice thereof, Kendall/Hunt Publishing Company 's sole and exclusive liability and your sole and
exclusive remedy, shall be the replacement of the defective CD. In the event of a defect in a CD covered
by this warranty, Kendall/Hunt Publishing Company will replace the CD provided that you return the
defective CD to Kendall/Hunt Publishing Company. The foregoing states your sole remedy and Kendall/Hunt
Publishing Company 's sole obligation in the event of the occurrence of a defect coming within the scope
of the Limited Warranty.
IN NO EVENT SHALL KENDALL/HUNT PUBLISHING COMPANY, ITS SUPPLIERS, OR ANYONE ELSE WHO HAS
BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE CD, ITS CONTENTS, OR RELATED
DOCUMENTATION BE LIABLE FOR ANY LOSS OR INACCURACY OF DATA OR CONTENT OF ANY KIND, OR
FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE OR EXEMPLARY
DAMAGES ARISING OUT OF OR RELATED IN ANY WAY TO THE USE OF, OR INABILITY TO USE, THE CD OR
ITS CONTENTS, OR FOR EFFECTS THE CD MAY CAUSE WITH REGARD TO THE COMPUTER ON WHICH IT IS
USED OR OTHER SOFTWARE IN USE ON SUCH COMPUTER, EVEN IF KENDALL/HUNT PUBLISHING COMPANY
OR ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF
LIABILITY SHALL APPLY TO ANY CLAIM OR CAUSE WHATSOEVER WHETHER SUCH CLAIM OR CAUSE IS IN
CONTRACT, TORT OR OTHERWISE.
The limited warranty set forth above is in lieu of all other express warranties, whether oral or written.
The agents, employees and distributors of Kendall/Hunt Publishing Company are not authorized to modify
this warranty, nor to make additional warranties binding on Kendall/Hunt Publishing Company. Accordingly,
additional statements such as distributor representations, whether written or oral, do not constitute
warranties of Kendall/Hunt Publishing Company and should not be relied upon as a warranty of Kendall/Hunt
Publishing Company. In no case shall Kendall/Hunt Publishing Company 's liability exceed the cost of the
CD. You agree to indemnify and hold Kendall/Hunt Publishing Company, its suppliers, and all of their
officers, directors, employees and agents, as well as all those individuals or organizations providing
information for the CD, harmless from any and all claims of third parties resulting from or incidental to
your use or operation of the CD or its contents, or arising from any breach by you of any provisions of
this License. Kendall/Hunt Publishing Company may, at its option, institute or defend any action arising
out of the aforesaid clauses with counsel of its own choice. [Some states do not allow exclusions or
limitations of implied warranties or liability in certain cases, so the above exclusions and limitations
may not apply to you.]
8. GENERAL. (a) This License shall be governed by the laws of the State of Iowa and the United States. (b)
If any provision of this License is deemed to be unlawful, invalid, or unenforceable, the remaining
provisions shall remain in full force and effect as if the unlawful, invalid, or unenforceable provision
had been omitted. (c) Any legal action, suit, or proceeding arising out of or relating to this License or
the breach thereof shall be instituted in a court of competent jurisdiction in the State of Iowa and each
party hereby consents and submits to the personal jurisdiction of such court and consents to service of
process by registered or certified mail, return receipt requested, at the last known address of such
party. (d) The above warranties and indemnities shall survive the termination of this License. (e) Use,
duplication, or disclosure by the United States Government is subject to restrictions as set forth in FAR
52.227-14 (June 1987) Alternate III (g)(3) (June 1987), FAR 52.227-19 (June 1987), or DFARS 52.227-701
(c)(1)(ii)(June 1988), as applicable. System licensor: Kendall/Hunt Publishing Company, 4050 Westmark

parties hereto confirm that it is their wish that this License, as well as all other documents relating
hereto, including notices, have been and shall be drawn up in the English language only.
9. ACKNOWLEDGMENT. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND
AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU ALSO ACKNOWLEDGE THAT THIS LICENSE
IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN KENDALL/HUNT
PUBLISHING COMPANY AND YOU, AND THAT IT SUPERSEDES ANY PROPOSAL, PRIOR AGREEMENT, OR
OTHER COMMUNICATIONS, WHETHER ORAL OR WRITTEN, BETWEEN YOU AND KENDALL/HUNT.
PUBLISHING COMPANY RELATING TO THE SUBJECT MATTER OF THIS LICENSE. THIS LICENSE CANNOT BE
MODIFIED OR AMENDED EXCEPT BY A FURTHER WRITTEN INSTRUMENT EXECUTED BY YOU AND KENDALL/
HUNT PUBLISHING COMPANY.
