On 27 Dec 14, following a briefing at 1600hrs. The MFF (BFO 1 PSO and CRT officers) detail will monitor
and facilitate, as necessary, a planned 4 hour Die In demonstration/march located at or near 14th
Broadway/Frank Ogawa Plaza. The mission of this operation is to:

Encourage communication and cooperation between event organizers, participants and assigned officers
Uphold Constitutional rights of free speech and lawful assembly
Enforce reasonable time, place, and manner restrictions as discussed in the Operations Plan
Protect life and property
Protect vital facilities
Maintain officer safety
Conduct fair and impartial enforcement of laws, statutes and ordinances, by, citing subjects, and
arrestees as quickly and efficiently as possible

Commanders Intent:
Purpose This operations purpose is to monitor a lawful rally/protest and march in compliance with
Department policy - Training Bulletin III-G, Crowd Control and Crowd Management and to respond to
related but unlawful activities as determined necessary. Overall intent is to allow peaceful assemblies
and marches without the Mobile Field Force engaging or directly facilitating. Squads will be
strategically placed based on crowd/event location, direction of travel, and actions.
Key Tasks The following is a list of mission-essential tasks:

Establish contact and communication with event organizers or leaders


Successfully stage or station MFF resources with the ability to flexibly and rapidly deploy from multiple
directions as needed
Monitor rally and March and communicate developments.
Enforce applicable laws. Arrest those responsible for criminal acts of violence or vandalism when
tactically sound to do so
End State This operation will be successful if the following conditions are achieved:

All tasks are completed without preventable or unnecessary injuries to citizens, officers, or suspects
Acts of violence or vandalism successfully prevented, reduced, or otherwise addressed through
enforcement, arrest or investigation where prevention was ineffective.
First Amendment rights exercised and upheld
No Uses of Force occur, or only objectively reasonable force is used while executing this mission

Case Background / Intelligence

General Fuck the Police (FTP) marches were commonplace following Occupy encampment removal; most
marches and demonstrations were peaceful and required little to no enforcement action. Recent current events
have renewed FTP and ACAB (All Cops Are Bastards) and #WeCantBreathe rallies and marches where
attendees typically express displeasure regarding an alleged police state and lack of police legitimacy both
locally and nationwide.
Recent specific Indybay.org (https://www.indybay.org/newsitems/2014/12/17/18765736.php) posted a FTP
Friday for December 19, 1900hrs with location details listed as 14th and Broadway. After weeks of revolt and
repression, come together again this Friday to say "Fuck The Police!" Attendees were requested to wear black.

The event contains a photo of an SFPD patrol car with spray paint graffiti to fuck cops.
A similarly organized FTP event was held on 18 Dec 14. Approximately 30 participants gathered at FOP/14th
and Broadway and marched to PAB where they spoke and demonstrated on the south west corner of 7th and
Broadway without incident before returning to FOP.
Thursday 25Dec:
1700 14th & Broadway: FTP NO TIME OFF Christmas Day FTP march 5pm. OGP 14th Broadway

Saturday 27Dec:
1900 14th & Broadway: 4 1/2 hour die-in. There will be a March also. This is a peaceful action
that the whole family can come out for. We will march to a location soon after we will do a die
in for 4 in a half hours.

Sub-Team Mission

Concept of Operation and Tasks to Subordinate Units


This is a planned event requiring an ICS based, limited response consisting of one incident commander and 5
MFF squads. If events dictate and/or additional squads are needed, The Patrol Division shall supplement with
selected units from each of the Patrol service areas.
Our mission is not to arrest every law violator but instead to manage the entire event. Personnel shall strive to
not create a situation which needlessly exacerbates the overall incident. When tactically feasible, arrests should
be made as safely and quickly as possible for incidents of violence or property damage.

- MFF shall assess crowd size, activities as needed for situational awareness.
- MFF officers shall radio broadcast or otherwise communicate situational awareness updates.
- Contact and attempt communication/collaboration with participants or organizers
Exhaust all reasonable options of establishing contact and communication with event organizers
or formal and informal leaders. Attempt to establish coordination and cooperation for march
route and duration and crowd management at primary or secondary sites
Communicate to event organizers or leaders that access to vital facilities, freeway on and off
ramps, or other circumstances falling outside of reasonable time, place, and manner may be
restricted.
Request cooperation and coordination with preventing or identifying unlawful acts committed by
individuals within the crowd, and their cooperation with our efforts to achieve desired end state
Attempt to utilize liaison and communication to minimize confrontation and maximize
operational success

or anticipated actions and march routes
As directed by the Incident commander, and as authorized by TB III-G, carry out required unlawful
assembly dispersal orders

On order, deploy to self-identified staging area near Frank Ogawa Plaza, but out of sight from Frank
Ogawa Plaza and 14th and Broadway, with ability to act as QRF.
Maintain flexibility of deployment by staging MFF van and/or Marked Patrol cars nearby with driver
and stowed personal with crowd management and control gear
Rapidly respond to contingency or need - When tactically advantageous, quickly respond to scenes or
reports of criminal activity to identify, report, or intervene.
Each squad to utilize a John unit in marked patrol vehicle to maintain ability to safely escort
unmarked vans and to act as stop car if needed.
Immediately following briefing, stage vans and one marked patrol vehicle John unit per squad near or
at PAB.
Prepare to rapidly respond to contingency or need at or near PAB.
When tactically advantageous, quickly respond to reports or incidents of criminal activity.
At conclusion of planned demonstrations and marches, MFF Alpha squads will maintain a visible
presence around FOP, the Downtown Area, and any identified demonstration locations and march routes
until relieved

Mutual Aid
- If mutual aid is requested, each agency that responds to the Citys request for mutual aid will be briefed
at a designated staging area on OPDs Crowd Management and Use of Force policies and given an
overview of the operation plan detailing the Commanders intent by Mutual Aid liaison or Incident
Commander Designee. Each agency will be assigned an OPD liaison (Pathfinder) to maintain the
Incident Commanders command and control, communication, and situational awareness while
executing the mission.

commander oversight of less lethal and chemical agent deployment, and outside agency personnel and

Arrest Procedures in Major Crowd Situations


Where a criminal act occurs within a large crowd, efforts shall be made to identify the suspect(s) for arrest(s).
Field commanders shall consider the safety of officers and bystanders in their decision to move into a crowd to
make an arrest.
Individual arrests shall comply with Departmental policies and procedures. Juveniles shall be separated from
adult offenders and processed in accordance with Departmental policy. Arrest teams shall be responsible for
completing and submitting a separate supplemental report documenting each arrest at the conclusion of the
operation. In the event of a major incident or arrest, one crime report to be written for the incident with
supplementals falling under one RD. Arrests require an ASI form, and all uses of force to be preliminarily
reported using a PUFR. K-4 timelines and reporting remain unchanged document any exceptions to
requirements due to exigency or circumstances.
In the event of riotous behavior, a field commander will evaluate and recommend if the crowd should be
dispersed. The Incident Commander shall make the final determination. Dispersal orders may be made in the
following conditions:

When crowd violence targets law enforcement personnel at a level likely to cause injury to personnel
and arrests are not possible or are not likely to succeed

When crowd violence includes arson and arrests are not possible or likely to succeed

When crowd violence targets buildings/property with felony malicious mischief and arrests are not
possible or likely to succeed

When individuals in the crowd begin to attack other people in the crowd with force likely to produce
injuries requiring medical assistance and arrests are not possible or likely to succeed

Dispersal orders may be given even if arrests are possible and have been made so that order may be restored
among the remaining members of the group. The field commander will give or direct another to provide the
dispersal order contained in TB III-G ensuring that it is heard and documented. If officers are directed to use
flex cuffs, they must mark each side of the lock to show the position of the cuffs at the time of arrest.
Anticipated Scenarios:
-

Protestors take over/occupy a building and refuse to leave and/or commit law violations
Protesters riot /commit vandalism/assault police
Protesters march in roadway (continuing to flow causing minimal disruption to traffic flow)
Protestors obstruct free flow of vehicle traffic at major intersection causing significant disruption to
commute traffic and/or commerce
Protesters deviate from the expected route

Each of these scenarios requires an assessment of the threat to life and property so that commanders can decide
the appropriate response. Minor vandalism and disrupting vehicular traffic will not initiate a major response

from law enforcement. Sit ins and marches will be allowed, unless life is threatened, serious bodily injury is
threatened, significant property damage occurs, or it causes significant disruption to normal business activities
for a prolonged period of time (to be determined by the Incident Commander).
In the event a decision is made by the Incident Commander to confront any number of protestors for any reason,
the safety of officers and uninvolved protestors shall be considered. Additionally, the likelihood of increased
police presence agitating protestors and the capacity for police resources to manage a hostile crowd shall also be
considered.
The Incident Commander must consider the impact of minimizing police responses during a crowd control or
riot situation. Such a strategy can actually escalate violence and vandalism by members of the crowd who
observe no response from the police thereby empowering individuals and groups in the crowd to act even more
recklessly and without consequences.
Reporting/Evidence Collection.
In the event a major crowd disturbance occurs, each member involved in the major crowd disturbance
operation shall complete a supplemental report documenting his or her activities and observations during the
course of the operation. Such an incident shall be properly identified by the Incident Commander.
Supervisors and commanders are responsible for reporting and investigating uses of force within their squads.
Members shall account for and report to their supervisor, each individual use of force and document it in a use
of force, supplemental or crime report.
Officers who have been assigned a PDRD shall activate the camera when directly engaged with the crowd or
individuals and shall document activation of the PDRD or any reason why PDRD was not activated - in the
appropriate report if required.
If the PDRD is lost, stolen, damaged, or malfunctions during the duration of the incident, the
circumstances shall be documented in the appropriate Departmental reports and Supervisor
notified as soon as possible. PDRDs shall be inspected prior to deployment.
Media.
The media have a right to cover demonstrations, including the right to record the event on video, film, audio
recording, or in photographs from any location the public is allowed. When declaring an unlawful assembly,
OPD will designate a dispersal route for all persons present, to include members of the media, to use when
evacuating the area. Local media representatives may carry OPD press passes, but press credentials issued by
other law enforcement agencies or media outlets - clearly identifying the media representative should be
recognized. Self-identified legal observers and crowd monitors (i.e., streamers, bloggers) do not have the same
status as the professional media. A commander shall be notified in circumstances requiring press access/activity
mediation, grievance resolution, or dispute.
TB III-G, XI states: The media shall be permitted to observe and shall be permitted close enough access to the
arrestees to record their names. Even after a dispersal order has been given, clearly identified media shall be
permitted to carry out their professional duties in an area where arrests are being made unless their presence
would unduly interfere with the enforcement action.

Neither policy nor the law states that media are entitled to remain at the scene of declared unlawful assemblies.
In instances where arrests are anticipated or are being made, credentialed media shall be permitted viewing
access in manner that does not interfere with enforcement action. If arrests of participants are planned or occur,
a media staging area, reasonable viewing location or public information officer (PIO) accompaniment will be
designated. These media coverage options must be provided in a manner that does not obstruct, hinder, or
interfere with law enforcement actions or public safety; the selection of news media viewing or staging areas
will take into consideration factors of time, place, manner, public and officer safety, police tactics, and media
input.
The distance from or to arrests only needs to afford reasonable view required to observe not close enough
proximity during arrests to record (arrestees) names. The ability to record arrestees names will be facilitated,
upon request, at mobile booking site or after the arrests have taken place and when safe to afford access.
Fire or Medical Assistance
All request for fire department services or medical aid shall be made through a dispatcher. All personnel must
provide as much information about the emergency as possible. Special arrangements may be needed to escort
fire and medical response.

CONTINGENCY PLANS

If individuals damage property/commit criminal acts: At the direction of a commander, arrest team(s) will
make surgical arrests of individuals who damage or destroy property, or otherwise intervene and arrest when
tactically feasible.
If individuals set fires: OPD will use fire extinguishers to put out small trash can fires. If needed, OPD escort
officers will provide force protection to OFD to put out larger fires.
If a large group marches on public roadways: OPD personnel will facilitate peaceful marches.
If shots are fired from within the crowd: OPD officers shall try and identify the shooter and react with the
appropriate force, if possible. If there is no immediately identifiable target then officers shall seek immediate
cover positions. The on-scene commander will decide if the use of chemical agents, smoke or diversionary
devices should be deployed to disperse the crowd, and/or shooter

If individuals enter and take over a building or private lot refusing to leave: OPD will identify the building
owner and determine if police services are requested to remove the trespassing occupants (unless obvious and
on-going crimes are occurring; fire set, vandalism). If police services are requested, OPD shall surround the
building or lot and contain the occupants. OPD will provide announcements directing trespassers to
immediately leave and shall arrest anyone found exiting the building or lot. OPD shall determine a tactical plan
to enter the building or lot and arrest remaining trespassers.
If individuals obstruct free flow of vehicle traffic at major intersection causing significant disruption to
commute traffic and/or commerce: OPD will assess the time, place and manner in which people are engaged
in these acts. The Incident Commander shall make the determination whether or not to remove people from
intersections based on the severity of the impacts if nothing is done to remove them. The Incident Commander
shall balance the level of disruption to traffic against the OPD policy of facilitating 1st Amendment activity; the
practicality of relegating the crowd to sidewalks or an alternate-route; the expected duration of the disruption,
and the traffic disruption expected in making a mass arrest if demonstrators refuse to leave the street.
