GENERAL INSTRUCTIONS TO TENDERERS FOR SUBMISSION OF TENDER FORM

The tender is open for all interested applicants who are permanent residents of India of
having sound financial background and to successfully operate this work and fulfill
the terms and conditions of this tender document.
Tender should be filled legibly and clearly either in Hindi or English and be signed by
the Applicant/applicants.
Latest passport size photo of the tenderer/s at the space provided on the tender form
should be affixed.
Tenderer/s should sign on the all pages of the Tender document.
Any error(s)/overwriting/alterations should be duly countersigned by the applicant. No
change either in the condition or the offer after the opening of tender will be entertained.
Failure to comply with these instructions shall render the application invalid and can be
rejected.
The onus of obtaining and acquainting himself / themselves about the terms & conditions and
other information which are relevant to this tender rests with the applicant/applicants.
The applicant(s) if they so desire may visit the site which is proposed to be allotted at
his/their own cost in order to satisfy themselves about the tender notification. The
area / boundaries are final. Any changes/disputes in this regard shall not be entertained
by the Railway administration at a later stage or after allotment.

Tender forms are available in the office of the Sr. Divisional Commercial Manager, DRM Office,
Central Railway, Kingsway, Nagpur on any working day between 12.30 Hrs to 17.00 Hrs on payment
of prescribed cost of tender form.
Applicant or Authorized representative can be present at the time of opening of tender. Tender
received without valid Earnest Money Deposit will be summarily rejected. For details of tender, tender
document may be referred.
This document can be downloaded from the website
www.cr.indianrailways.gov.in. However, tender forms downloaded from the net should be Invariably
accompanied with the cost of tender form in the form of a demand draft equivalent to the cost of tender
form drawn from a nationalized/scheduled bank payable to Sr.Divisional Finance Manager, Central
Railway, Nagpur or in the form of money receipt which has been deposited with the Chief Booking
Supervisor of the concerned station. Tender forms which have been down loaded and submitted
without the cost of tender form as mentioned above shall be deemed as invalid and summarily
rejected.

1.

GENERAL TERMS AND CONDITIONS

The tender is required to be filled either in Hindi or English and to be signed by the
person or persons submitting the tender and all entries must be made by hand and
written in ink. All the pages of tender form should be duly signed and to be
enclosed with tender documents.

2.

All errors and alterations in filling the tender must be attested by initials of the
tenderer (s). Over writing of figures is not permitted. Failure to comply with either of
these conditions will render the tender liable for rejection. No advice of any change in
rate or conditions after the opening of the tender will be entertained.

3.

The tenderer must obtain for himself on his own responsibility and his own expenses
all the information which may be necessary for the purpose of filling a tender and
acquaint himself with all local conditions, means of access to the work, nature of
work and all matters pertaining there to.
The tenderer in his own interest may visit the site and should satisfy himself before
applying for the parking stand. Any dispute regarding area/ boundaries will not be
entertained after allotment of contract.

Tender must be addressed to the Divisional Railway Manager (Commercial), Central

Railway, Nagpur in sealed cover super scribed Tender for Pay and Park contract
at (Station) as per the nature of contract mentioned in NIT published and must be
dropped in the sealed box kept in the office of the Divisional Railway Manager
(Commercial) Central Railway, Nagpur on the date prescribed in Tender Form.
Tenders received in box or received by post later than the date and time prescribed
as above shall be considered as invalid.
If the tenderer(s) fails to furnish any of the documentary requirements at the time of
submission of the tender, the tender is liable to be rejected.
The information submitted by the tenderer will be scrutinized and evaluated to decide
the eligible tenderers.

5.

The tenderer should note name of parking contract station, location, its area
Reserve price, total contract value, Rate of Parking per vehicle as mentioned in
special conditions while quoting offer.

6.

The Administration does not bind itself to accept the highest or any other tender and
reserves the right to accept or reject any or all the tenders either in whole or in part
thereof without assigning any reasons for doing so. The Administration reserves the
right to accept or reject the tender without assigning any reasons.

7.

If the applicant is applying as Individual, the address should be supported with

documentary proof such as Electric bill, Ration card, Pan Card, Rent bill etc. If the
applicant is applying as Proprietorship/Partnership firm, the address should be
supported with documentary proof such as Electric bill, Telephone bill and Rent bill.
In the event, the tender is being submitted by the firm, it must be signed by each
partner thereof and in the event of the absence of any partner, it shall be signed on
his behalf by a person holding power of attorney, authorizing him to do so. The
tenderer is advised to get legal opinion when drawing up his power of attorney.

8.

The tenderer is required to submit Statement of his Bank Account of a

Nationalized/Scheduled bank for a period of last six months which should be duly
attested by MP/MLA or Special Executive Magistrate or a gazetted officer.

9.

Earnest Money: Tenderer(s) must deposit Earnest Money 5% of the contract value
in from of cash with the Chief Booking Supervisor, Central Railway, Nagpur. The
Earnest Money may also be paid in the form of Demand Draft or Bankers Cheque
issued by Nationalized/ scheduled Bank, in the name of Sr. Divisional Finance
Manager, Central Railway,Nagpur and the original DD/BC/MR only (No
FDR/TDR/Confirmation of Deposits will be accepted) should be enclosed along with
the application, without which no tender will be considered.
The Earnest Money will be adjusted in Security Deposit of successful tenderer and
refunded to the unsuccessful tenderers after finalization of the tender and no interest
will be paid for the period.
The Earnest Money will be forfeited in whole or in part at the discretion of the
Divisional Railway Manager, Nagpur as may be deemed necessary and in the event
of the contractor withdrawing his offer either before the expiry of 120 days from the
date the tenders are opened or after the acceptance of his tender is communicated
to the contractor.

10.

Police verification certificate in his own name issued not later than 3 months prior to
the date of notification of tender should be submitted by the tenderer along with
tender.

11.

A character certificate in the name of the tenderer issued by any Gazetted officer or
Special Executive Magistrate or MLA/MP dated not later than three months prior to
the tender notification date, should be submitted along with tender form.

PAN no. and valid certificate of SERVICE TAX Registration Number should be
submitted along with tender form, failing which tender shall be rejected.

13.

A valid telephone number/Mobile No. in the name of the tenderer should be

mentioned in the tender form and a documentary proof to this effect should also be
submitted along with tender form. The successful tenderer shall be contacted on this
number by Railway administration as and when required.

The tenderer may have an experience in running parking contracts either awarded by
Central Govt./State Govt. or Municipal authorities. Tenderer may submit the
experience certificate issued by Central Govt./State Govt. or Municipal authorities to
that effect. Experience is desirable, but not compulsory.

15.

The tenderers may have experience in other business currently. if yes the tenderer
may produce proof of status of business in parking or any other area.

16.

Conditional tenders shall not be considered.

17.

The successful tenderer will have to provide all facilities like stand, shelter fencing
and enclosures and other facilities at his cost as per extent policy. Any disputes
regarding above will not be entertained after allotment of contract.

18.

The successful tenderer will be allowed to charge the vehicles as per the rates
prescribed in the Tender Form and Terms and conditions.

The cycles, scooters, motorcycles parking stand should be opened to all Railways
commuters to the extent space available. No cycle/scooter/motorcycle/car should be
kept outside the allotted space. Vehicles of the Railway Staff on duty shall be parked
free of charges in special circumstances after producing an identity card issued by
railway administration

The contractor is entirely responsible for any thefts, pilferages or damage to the cycle
/ scooter / motorcycle car while the same are kept at the stand. He is also directly
responsible to settle all claims, which may be made by owners of the vehicle for loss
of damage etc.

21.

Levy of service charges or excess charges (Such as service charges etc) other than
the tariff are not permitted and complaints to this effect from the public will be liable
for penalty/ fine /termination of contract, which may be noted.

22.

A tariff Board indicating the allotted area and parking tariff rates should be
displayed prominently at the entrance of the parking stand.

23.

The successful tenderer shall have to execute a written agreement with Railway
Administration before commencement of the contract.

24.

The agreement will be in force for a period prescribed from the commencing date of
contract.

25.

The contract will be awarded subject to verification of credentials in support of

financial stability etc.

26.

Security Deposit - The successful tenderer shall, in all cases make payment of
security deposit equal to One Year license fees for a period of 42 months in the form
of Bank Guarantee of a Nationalized Bank after adjusting EMD amount with the
provision of renewal of Bank Guarantee. This security deposit will not bear any
interest. This security deposit will be refunded after expiry of the contract.

Payment of license fee He will make payment of one quarterly installment of

license fee in addition to Security Deposit in advance within a period of seven days
from the receipt of letter of award and has to start functioning within fifteen days from
the date of receipt of letter of award failing which the contract awarded will be liable
for termination and Earnest money will be forfeited.
The payment of license fee should be made in advance on quarterly basis, on or
before up to 10th day of the first month of each quarter irrespective of the date of
allotment of the contract. Every year license fee will be increase with cumulative
10% escalation in the previous year license fees
In case the licensee/licensees delay (s) the payment of licence fee, the
administration after giving a grace period of 7 days will have the liberty to impose
penalty @2% of the amount due for each delay of payment by 7 days or part thereof.
In case of the failure in payment of two subsequent advance quarterly license fee,
administration may decide to terminate the contract by issuing a show cause notice.

In case the Licensee/Licensees makes/make any default in the payment of Licence

fee or any other charges that may be due to the Administration, the Administration
shall be at liberty to recover such rent or other dues from the said amount of security
deposit, forfeit the balance if any as liquidated damage forthwith determine the
Licensee/Licensees and proceed to resume possession in a manner stipulated
herein.

If for any reasons the contract is extended beyond the expiry date of the contract, the
contractor shall pay the license fee at the revised rate decided by the Railway
Administration.
Extract of Clause No.1 (d), (e) of the agreement:
1.(d) : If any payment herein before mentioned shall not be made on the due date or
in the event of the licensee(s) failing to observe and perform any of the
terms, stipulation and conditions as herein contained on his/their part to be
observed and performed, there shall be lawful for the Administration to
terminate the license forth with. In the event of the Administration becoming
entitles to terminate his license under the provision aforesaid, then even
though it may exercise such right of termination without prejudice to all
other rights of the administration, the administration shall also be entitled to
forfeit the said Security Deposit or to adjust towards payment of any amount
which may be due to the administration in whole or part as administration
may in its discretion deem fit. Upon any such determination, adjustment of
forfeiture, the licensee(s) shall have no claim for any compensation
whatsoever against the Administration.

30.

The railway administration will have a right to increase/decrease area/ rates of

parking in its own discretion and to revise its license fee during the contract period
on pro-rata or other basis.

31.

Subletting of contract will not be permitted.

32.

The agreement is subject to termination of contract from either side after completion of
one year by giving three months (90 days) prior notice without assigning any reason
on payment of all Railway dues.

The permitted parking area as indicated in NIT should be covered with decent
temporary shelter if required, fencing etc. at licensee cost.

No space other than allotted area for parking should be utilized for parking vehicles.
The tenderer will be responsible for maintaining the standard of cleanliness in &
around the parking area.

36.

Licensee/Licensees should give computerized coupons at A1& A category of station

i.e. Nagpur, Wardha, Ballarshah, Chandrapur & Betul station which shall clearly
depict the name/identification of parking lot, date and time of issue of coupons, the
name of the contractor, Sr.number on coupons with counterfoils and amount charged
for coupon/Monthly pass.

Violation of any of the Terms and conditions stipulated in the tender form and
contract agreement will invite penalty /fine/cancellation / termination of the contract
and may result in forfeiture of Security Deposit.

38.

Penalty:The Licensee/Licensees shall be liable to pay such penalty as the Railway

Administration may inflict for complaints against the Licensee/Licensees Managers
etc., which in the opinion of the Railway Administration are bonafide and
substantiated. Without prejudice to the other remedial, which may be available under
the agreement, the licensee/licensees shall be liable to pay at the sole discretion of
the Railway Administration also penalty not exceeding a sum of Rupees 10,000/- (Rs
Ten thousand only) per incidence, for any action in contravention of any of the
clauses of this agreement.

39.

Payment of Tax: As and when notified by IT authorities, Central Excise authorities or

any other authorities of the land prescribed by the law of land, the licensee shall be
legally liable to pay any tax/duty/surcharge/cess apart from the license fee.

40.

Tenderer will have to pay TCS, Service Tax & all other taxes & Charges at the
prescribed prevalent rate over the offered amount annually with 1st installment of
license fees. Tenderer will have to pay TCS (Presently 2.266%), Service Tax
(Presently 14%) on the license fees apart from license fees.

41.

Tenderer himself will have to make arrangements for security at his own cost.

42.

The Staff of parking contractor shall wear specified uniform at their own cost and
also wear on duty ID card issued by Divisional Authority.

The Licensee/Licensees shall have insurance for two wheeler vehicles against loss,
fire, theft and burglary due to fire, theft and burglary. Licensee/Licensees shall pay
the premium thereon regularly to Insurance Company and submit receipt to the
Railway Administration along with the xerox copy of such insurance policy premium
receipt for verification. Licensee/Licensees will make good the losses due to theft,
fire, and burglary to the owners of the vehicle. Licensee/licensees will get the
insurance policy renewed from time to time during the contract period.
All the paras mentioned in the agreement shall be applicable to this contract.
