my client Mr. Mohammad Kutubuddin Shaikh

. I have to address you as under as
follows :1. My client says that he is Holder and possessor
of the property located at village Pimpri
Waghhere bearing City Survey No. 2522 and
PCMC no. 568 admeasuring area 850 sq. ft.
Ground floor, 850 sq. ft 1 st floor and 850 sq. ft
2nd floor details of which are there in the leave
and license agreement hereinafter referred as
said property.
2. My client says that he had given you the said
property on leave and license basis wide leave
and license agreement dated 26th September
2011 on your Approach to my client to give

to start Hospital in said property and the said
property was suitable according to location
and it was furnished, all the medical
equipments machinery, it was already
established by some other doctor in said
property which was later on taken over by my
client.
3. My client says that considering you as very
genuine and simple person, based upon your
assurances. My client entered into leave and
license agreement on 26/09/2011 before
Notary Public Sanjay Kambale. My client says
that based upon your request to same your
time due to your busy routine my client agreed
for Notary Registered agreement.
4. My client says that you immediately shifted in
the said premises and at initial stage were
paying license fees regularly but later on you
started delaying the same for which my client
started requesting you pay the license fees in
time.
5. My client says that the duration for the leave
and license was commenced from 01/10/2011
till 30/09/2016 for the consideration of
monthly license fees Rs. 51,000/- for 1st 12
months, 56,000/- for 2nd 12 months, 62,000/for 3rd 12 months and 68,000/- for 4th 12
months and 75,000/- for 5th 12 months and
security deposit of Rs which was

6. My client says that by virtue of clause D 1st
Para Page No. 4 you had agreed to pay license
fees to before 10th of every month further it is
stated that you did not pay the license fees
regularly and on time my client says you have
defaulted the payment of monthly license fees
for ----------- month and sometimes by giving
reason of financial crunch you have made
short payments / part payments towards
license fees but my client first to help you and
in good faith accepted the same but you had
taken my client as granted and made it you
habit.
7. My client says that in clause ------------ of page
no. ------- you has agreed to pay the light bill of
the said property regularly on time but you
have defautlted the same which was paid by
my client to avoid disconnection it is the
breach of terms and condition agreed between
my client and you for which my client reserves
his right to seek damages for the physical
mental and financial loss caused to him.
8. My client says that he had provided you
various medical furniture, equipments and
machinery for usage and you were obliged to
maintained the same in good and working
condition but you have not done the same and
you have caused loss my misusing all the

equipments and also you have lost some


equipments due to which loss amounting to
Rs. -------------- have been caused to my client.
9. My client says that he had send you letter /
notice for payment of unpaid license fees for
four months on 15/11/2015 then you made
part payment then again you defaulted for
further months and again my client send you
letter dated 28/06/2015 for recovery of license
fees due but you were negligent. My client
says that again on 29/09/2015 my client send
letter for recovery of money due on account
belonging and give of license fees and remove
you possession but you were reluctant to
same.

My client says that your behavior was
intolerable as my client is senior citizen having
the license fees as his source of income but
due to your behavior my client had to face
agony and he had no money on his auspicious
festival like Eid. So he decided to take
possession from you and give it to else one.
But you started giving reason to avoid the
some but finally after due warning from my
client to file criminal case and civil case you
gave possession of said property to my client
but loss to equipments unpaid light bill and
unpaid license fees Rs. . Still is due
which you need to pay to my client.

My client hereby call upon you to pay the
some within 7 days from receipt of this notice
or else my client will be constrained to take
legal action against you in competent court of
law and thereafter you shall be solely liable for
cost and consequences arising from it.

My client says that your illegal and
mischievous behavior has constrained my
client to send this notice. Hence the cost of
this notice Rs. 10,000/- is laid upon you take
note of it.
