GeneralDefinition
:

COMMUNITYSERVICE
isaprogramofthe13thJudicialDistrictwhereintheCourt,anditsresourcesare
engagedwithFederal,State,County,Localgovernments,AgenciesandNonGovernmentalAgenciesin
meetinghuman,career,educationalorenvironmentalcommunityneeds,bywayofdeveloping,implementing
andsupervisingconditionsofCourtsentencingregardingmattersofadultcriminal,juvenilecriminal,family
dependencyand/ordomesticrelationscases.Itistheperformanceoftasksdesignatedtoaccomplishanyofthe
following:
(1)Environmentalpreservation,enhancementandremediation.
(2)Promotionofthewellbeingofchildren,theelderly,personswithphysicalordevelopmental
disabilitiesandpersonswithlowincomes.
(3)Educationaldevelopment,including,butnotlimitedto,literacytraining,adultbasiceducation
coursesandinstructioninjobsearchskillsandjobapplicationskills.
(4)Improvementactivitiesonpubliclandsorfacilities.
(5)Projectsoractivitiescalculatedtoimprovepublichealth,safetyandwelfaredevelopedbytheboard.
(6)Educationalactivities,throughaPennsylvaniaeducationsystemoracommunityorgovernmental
entity,thatinstillanethicofcivicresponsibilityandcitizenshipinallPennsylvaniansandinparticular
youngPennsylvanians.

ThepositionofForemanisamanagementandsupervisorypositionwhichhasasitsresponsibilitythe
scheduling,planning,casemanagement,andreportingpursuanttovariousRulesandRegulationsofthe
CriminalandFamilyDivisionsoftheCourtofCommonPleas.ThisincludestheMagisterialDistrictCourts.

TheForemanwillassisttheDirectorinestablishingstandardsandprogramming,monitoringindividualsand
assigningtasksthatareintendedtomeettheenforcestandardsofvarioustypesofCourtOrders.Workwill
includescheduling,supervisingandtrackingcommunityserviceprojects.Occasionalcourtroomtestimony,and
dressmaybenecessary.WorkissubjecttovariousFederalandStatelaws,RulesofthePADepartmentof
EducationandWelfare,andvariouslocalCourtAdministrativeRules.Workwillbepursuanttostandards
developedby(andfor)theCourtofCommonPleas,theMagisterialDistrictCourts,andtheCourtsDomestic
RelationsDepartment.TheForemanwillneedtoworkwellasanassociateoftheDirector,andallother
membersoftheJudicialDistrict,Countyandlocalofficials,andthepublic.

TheForemanmustbecomefamiliarwiththeCriminalandtheFamilyDivisionsoftheCourtofCommonPleas
andMagisterialDistrictCourts,andtheirRules,andGreeneCountyHumanServiceandJobTraining
Departmentsandprograms,andthepoliciesandproceduresoftheGreeneCountyPrison.

TheForemanisnonUnionandservesAtWillandasassigned.
TheForemanshallassistintheadministrationofprogramsofrehabilitation,education,jobtrainingand/orthe
contemptprosecutionofaviolator,asappropriate.
TheForemanshallensureresponsibleonsitesupervision.

TheForemanwillberesponsibletocomplywithprovisionsmorefullydefinedthroughoutthePARulesof
CourtandaccordingtoTitle71P.S.5827,StateGovernment,PartITheAdministrativeCodesandRelated
Provisions,Chapter2TheAdministrativeCodeof1929,ArticleXXIIBCoordinofCommonwealth
CommunityServicePrograms,and5827.CommunityServiceAdvisoryBoard(Code2207B)

FURTHER,andpursuanttoTitle71PS5824,theForemanwillassisttheDirectorofCommunityService
wheneverpossibleinthefollowinggoals:

(1)(i)DevelopjointlywiththeDepartmentofEducation,thePennsylvaniaHigherEducationAssistance
Agency,andGreeneCountysSchoolDistricts,VocationCareerCenterandIntermediateUnit,aplanunder
whichatleasttenpercentum(10%)ofthefundsavailableunderTitleIVoftheHigherEducationActof1965
(PublicLaw89329,79Stat.1219)maybeusedtopermitstudentstoperformcommunityservice.Andassist
theDepartmentofEducation,thePennsylvaniaHigherEducationAssistanceAgency,andGreeneCountys
SchoolDistricts,VocationCareerCenterandIntermediateUnitinpreparingapublicinformationprogramfor
studentsreceivingthefundstoapprisethemofthecommunityserviceoption.
(ii)DevelopjointlywiththeDepartmentofEducationandthePennsylvaniaHigherEducation
AssistanceAgencyandWaynesburgUniversityaplantoencouragecollegeanduniversitystudentsto
participateinthirty(30)hoursofcommunityserviceeachyear.Theplanshallincludetuitionreimbursementor
academiccoursecreditortuitionreimbursementandacademiccoursecreditforstudentswhoperform
communityservice.

(2)TocooperatewiththeCountyofGreeneandthePADepartmentofCommunityAffairstoproducethe
following:
(i)Aplantoadviselocaltownshipsandboroughgovernmentsoftheprocedureforestablishing
communityserviceprograms.Theplanshallincludecreationofadatabase,andwebsitethatwillenablelocal
governmentstoshareinformationwitheducationalinstitutions,communitybasedagenciesandotherentities
andindividualsconcernedwithcommunityserviceandtheprivatesectoronalocalandregionalbasis.
(ii)Aninformationalbrochureorpamphletforlocalgovernmentsthatdescribescommunitybased
agenciesandexplainsthedesirabilityofhavingparticipantsincommunityserviceandrecipientsof
communityserviceserveonthegoverningboardofcommunitybasedagencies.

(3)ToworkjointlywiththeGreeneCountyPrisonBoard,thePADepartmentofCorrectionsandtheState
BoardofEducationtoformulateandimplementaprojecttoencouragechildrenadjudicateddelinquentfor
commissionofnonviolentoffensestoperformcommunityserviceforlocalgovernmentsandschooldistricts.
Theprojectshallincludeanevaluativeandreflectivecomponent.

(4)ToimplementthepolicyoftheStateBoardofEducationthatallsecondary,collegeanduniversitystudents
beencouragedtobecomeinvolvedincommunityservice.

(5)(i)ToworkwithotherbureausandofficesoftheCountyandCommonwealthtoattempttoobtainincreased
FederalfundingforGreeneCountyprogramming,thePennsylvaniaConservationCorpsandSummerYouth
Corpsprograms.
(ii)Tomeetandconsultwithotherbureausandofficesofthedepartmenttoenhancethequalityand
efficiencyofjobtrainingprograms.

(6)ToassisttheCounty,theCountyOfficeofDevelopment,theCountyConservationand/orRecreation
Departments,andDepartmentofEnvironmentalResources,andnongovernmentagencies,inincorporatingthe
goalsofprotectingtheenvironment,promotingrecreationalfacilitiesandrestoringpublicparksintothemission
ofthePennsylvaniaConservationCorps.

(7)ToworkwiththeDepartmentofAgingtoproducethefollowingresults:
(i)Involvementofyoungpeopleinassistingprofessionalstaffinthedeliveryofservicestoolder
PennsylvanianslivinginGreeneCountyinnursinghomes,retirementcommunitiesorpersonal
households.
(ii)ExpansionofserviceopportunitiesthatcombinethehumanresourcesofyoungerPennsylvanians
withthehumanresourcesofolderPennsylvanianstoexpandintergenerationalprogramssoasto
combinetheenergy,wisdom,strengthandtimeofbothouryoungerandolderpopulationinorderto
addressvitalsocialneeds.

(8)TodevelopwithCountyAgencies,NonGovernmentAgenciesandthePADepartmentofHealthaproposal
thatwillallowyoungpeopletobeinvolvedinthehealthrelatedactivities,including,butnotlimitedto,the
following:

(i)Educationalprogramsthatareaimedatincreasingawarenessincommunitiesandeducational
institutionsaboutcommunityhealthproblems.

(ii)Engagementwithcommunityhealthclinicsandprofessionalmedicalpersonneltoensurethatall
Pennsylvaniachildrenareimmunized.

(iiI)MentalHealth,Drug,AlcoholandSubstanceAbuseprograms.

(9)ToworkwiththeDepartmentofTransportationtomeetthetransportationandinfrastructureneedsof
PennsylvaniabyensuringtheeligibilityofthePennsylvaniaConservationCorpsorlocalcorpstoperform
contractworkthatmayinclude,butneednotbelimitedto,maintenancework,rehabilitationandrepaintingof
bridgeandunderpassstructuresandbeautifyingeffortsalongpublicroadways.

(10)TodevelopandimplementwiththeCounty,CommonwealthandDepartmentofPublicWelfareaplanfor
jobtrainingprogramsthatwillhavecommunityserviceoptionswhichcanserveasatransitionfrompublic
assistancetosustainedemployment.

APPLICABLECRIMINALCODE:
Title75/3804(f)Communityserviceassignments.Inadditiontothepenaltiessetforthinthissection,the
sentencingjudgemayimposeupto150hoursofcommunityservice.Wheretheindividualhasbeenorderedto
drugandalcoholtreatmentpursuanttosections3814and3815,thecommunityserviceshallbecertifiedbythe
drugandalcoholtreatmentprogramasconsistentwithanydrugandalcoholtreatmentrequirementsimposed
undersections3814and3815.

Apersonconvictedofanoffenseunder18Pa.C.S.3304(a)(4)(relatingtocriminalmischief)and3307(a.1)
(relatingtoinstitutionalvandalism),andwhointheopinionofthesentencingcourtwouldbenefit,shallbe
sentencedtoatermofsupervisedcommunityservice,includingrepairingorrestoringdamagedproperty,in
accordancewiththefollowing:
(1)Ifthedamagetothepropertyislessthan$200,thetermofcommunityserviceshallnotbelessthan
50daysnormorethan74days.
(2)Ifthedamagetothepropertyisatleast$200,butlessthan$1,000,thetermofcommunityservice
shallnotbelessthan75daysnormorethan99days.
(3)Ifthedamagetothepropertyis$1,000ormore,thetermofcommunityserviceshallnotbelessthan
100daysnormorethan200days.
(b)Satisfactorycompletionofcommunityserviceprogram.

Satisfactorycompletionofthecommunityserviceprogramundersubsection(a)shallresultinadismissalof
chargesandexpungementoftherecordofthepersonsentencedundersubsection(a).Thecourtshallfollow
proceduressimilartothoseestablishedfortheAcceleratedRehabilitativeDispositionProgram.

APPLICABLEDOMESTICRELATIONSCODE:
Ifanobligorowesoverduesupportwithrespecttoanychildreceivingcashormedicalassistance,onmotionof
thedepartmentordomesticrelationssection,thecourtmustorderthatoverduesupportbepaidinaccordance
withaplanapprovedbythecourtorthattheobligorparticipateinworkactivitiesapprovedbythedepartment.
Suchactivitiesinclude:
(1)subsidizedorunsubsidizedpublicorprivatesectoremployment
(2)workexperienceprograms
(3)worktrainingprograms
(4)communityserviceprograms
(5)jobsearchrequirements
(6)jobreadinessprograms
(7)educationdirectlyrelatedtoemployment
(8)attendanceatsecondaryschooland
(9)forpersonnotgraduatedHS,studyleadingtoaHSdiplomaorequivalent.

Thepredominant,butnotthesoleresponsibilityoftheForemanshallbetocoordinatethedevelopmentand
implementationofcommunityserviceprogramswithinthisJudicialDistrict.
(b)TheJudicialDistrictshallworkwithPennSERVEwhichwasestablishedtomakecommunityservicethe
commonexpectationandexperienceofallPennsylvanianswithaspecialconcentrationonGreeneCountys
youngpeople.
(c)ItshallworktorenewtheethicofcivicresponsibilityinGreeneCountyandtoinvolveandenrollyoung
peopleinserviceopportunitiesthatwillbenefitPennsylvaniawhileofferingouryoungpeopleliteracyskillsand
improvedjobskills.ItshallbuildontheexistingorganizationalframeworkofState,localandcommunitybased
programsandagenciestoexpandfulltimeandparttimeserviceopportunitiesforallcitizens,butparticularly
youth.
(d)AllCountyandCommonwealthdepartments,agencies,boards,commissionsandinstrumentalitiesshall
shareinformationandcooperatewiththeofficetoenableittoperformthefunctionsassignedtoit.

TheOfficeplanwillfocusparticularlyonthefollowingstrategicinitiatives,namely:
1.EnforcingCourtordersandProgramPolicies
2.Mobilizecommunities,interestgroupsandvolunteers
3.servingatriskyouthandconnectingthemwithserviceopportunities
4.engagewitheducationalinstitutions&theirstudentswithinGreeneCountycommunities
5.disasterservices.
