4.

3 PRINCIPLE OF MAQASID SYARIAH


The objectives of Syariah could be achieved in the highest degree only when
Syariah is implemented in true letter and spirit. The section illustrates the
desirable properties of an Maqasid Syariah index with a key objective to
attain justice in a society. These desirable properties are mentioned as
axioms. (Hasan, 2014)
These axioms are derived from Syariah (Quran and Hadith). One of these a
hadith is about the questions to be asked from every person by Allah on the
Day of Jugdement. These questions are related to life, youth, earning and
spending wealth and knowledge which can be linked to four of the five
maqasid syariah such as preservation of religion, preservation of life,
preservation of intellect, preservation of lineage and preservation of wealth.

The Prophet Muhammad (S.A.W) said : the son of Adam will not pass
away from Allah until he is asked about five things : how he lived his
life, and how he utilized his youth, with what means did he earn his
wealth, how did he spend his wealth, and what he do with his
knowledge. (Sahih hadith reported by Imam Al-Tirmidzi) (Hasan, 2014)
4.3.1 FULFILLMENT OF MAQASID SYARIAH
1) Religion (Ad-Din)

Maintaining the purity of religion and belief. The main thing is affirmed by the
order or hierarchy of objectives of the syariah. Islam came to liberate the
human mind and confidence from the bondage of superstition, superstition,
hypocrisy and openly. Islam invites people to believe in God the One and
Only God who is God Almighty and matters related to it [the pillars of faith]
and away from the elements of polytheism and explain the various guide
unluk performing obedience to Allah.
Allah said in surah Al-Ikhlas :

Say: He is Allah, the One and Only( 1) Allah, the Eternal, Absolute (2)
He begetteth not, nor is He begotten (3) And there is none like unto
Him (4)
Allah said in surah Ali-Imran :

The Religion before Allah is Islam (submission to His Will): Nor did the
People of the

Book dissent therefrom except through envy of each

other, after knowledge had come to them. But if any deny the Signs of
Allah, Allah is swift in calling to account.(Ali-Imran 3:19)
2) Life (Al-Nafs)
Ensuring the safety of life and limb of the human body. Islamic law also
comes to ensuring the safety of life and limb of the human body. Therefore,
Islam has required individuals to protect themselves and at the same time
prohibits acts which threaten the safety of life potentiometer yourself or
others. As a Muslim, we must to control health effectively.
Allah said in surah Al-Maidah :

On that account: We ordained for the Children of Israel that if any one
slew a person - unless it be for murder or for spreading mischief in the
land - it would be as if he slew the whole people: and if any one saved
a life, it would be as if he saved the life of the whole people. Then
although there came to them Our apostles with clear signs, yet, even

after that, many of them continued to commit excesses in the


land.(Al-Maidah 5:32)
3) Intellect (Al-Aql)
One of the privileges bestowed by Allah Almighty to the people and not given
to other creatures is the mind and the power of thought. Through these
human rights be given status as successors to inhabit the earth in
accordance with the rules and dictates of Allah Through it man can exploit all
natural gift for human well-being. In line with this objective and in order to be
able to function reasonably accordingly, Islamic law has insisted on the
importance to demand and acquire knowledge. Common sense will respond
through a variety of his knowledge. If people do not make sense with
science, it will cause to the weakening of the power of thought. If this
happens, people will squander the humanitarian and caliphate. Their life will
be low value and sometimes worse than animals that only live for livestock,
drinking and indulgence only.
Islamic law also in its efforts to ensure the soundness and strength of
thought has banned any form of treatment that can affect the function of the
mind. Thus Allah forbid liquor and intoxicants.
Allah said in surah Al-Mujadalah:

O ye who believe! When ye are told to make room in the assemblies,


(spread out and) make room: (ample) room will Allah provide for you.
And when ye are told to rise up, rise up Allah will rise up, to (suitable)
ranks (and degrees), those of you who believe and who have been
granted (mystic) Knowledge. And Allah is well- acquainted with all ye
do.(Al-Mujadalah 58:11)
4) Lineage/honor (Al-Nasb)
Ensure the honor and dignity. Dignity and personality of someone very
important in the life of every individual. He was closely associated with honor
and dignity. That's because Islamic law are very concerned about this issue.
Even Islam itself, which is built on good character. Prophet never said which
means: "I have been sent to effect good character".
If observed all the commandments and prohibitions of Allah, will find that it is
intended solely to shape the personality of the great and respected. Look at
the impact of the duty to pray, fast, give alms, pilgrimage, and many others.
All worship khususiyyah if fulfilled with a full order will be established height
and glory of morals. At the same time, if observed the prohibition and
rejection of God Almighty, it has the purpose of which is to prevent people

from falling into the valley of humiliation. Consider the impact of the ban on
adultery, swearing, lying, stealing, and many others. This is because, Allah
has forbidden these actions. All the commands and prohibitions of Allah can
be attributed to the need to ensure the honor and dignity.
Allah said in surah Al-Isra :

Nor come nigh to adultery: for it is a shameful (deed) and an


evil, opening the

road (to other evils).(Al-Israa 17:32)

Allah said in surah Al-Maidah :

O ye who believe! Intoxicants and gambling, (dedication of) stones,


and (divination by) arrows, are an abomination,- of Satan's handwork:
eschew such (abomination), that ye may prosper.(Al-Maidah 5:90)
5) Wealth (Al-Mal)
Ensure business ownership and control of property. It is undeniable that the
perfect life for a human person is also strongly associated with ownership
and control of property. Recognizing this, Islamic law outlines the rules, laws
and their laws of its own in terms of assets. It was widely discussed in the

discipline and field of its own, known as Fiqh Muamalat Generally, this area
has outlined certain procedures starting from the business to own, control
and spending of a property. Islam insists on the importance of seeking the
wealth of grace and mercy of Allah swt
Allah said in surah Al-Qasas :

"But seek, with the (wealth) which Allah has bestowed on thee, the
Home of the Hereafter, nor forget thy portion in this world: but do thou
good, as Allah has been good to thee, and seek not (occasions for)
mischief in the land: for Allah loves not those who do mischief."(AlQasas 28:77)

In addition, in order of ownership of this property, apart from usury, Islamic


law has forbidden such as gambling, corruption and fraud in the reduction or
scales.
Allah said in surah al-Mutaffifin :

Woe to those that deal in fraud,- (al-Mutaffifin 83:1)
