TENANCY AGREEMENT
AN AGREEMENT OF TENANCY made the day and year stated in Section 1 of the Schedule hereto between the
first party whose name and particulars are stated in Section 2 of the Schedule hereto (hereinafter referred to as "the
Host") of the one part AND the second party whose name and particulars are stated in Section 3 of the Schedule
hereto (hereinafter referred to as "the Tenant") of the other part.
AND WHEREAS the Host is letting the premises described in Section 3 of the Schedule hereto (hereinafter referred
to as "the said Premises") in his capacity as described in Section 4 of the Schedule hereto.
WHEREBY IT IS AGREED subject to the accompanying General and Special Conditions, the Host lets and the
Guest stays at the said Premises for a term stated in Section 5 of the Schedule hereto commencing on/deemed to
have commenced on the date stated in Section 6 of the Schedule hereto at the monthly rate stated in Section 7 of
the Schedule hereto of every month in advance.

GENERAL CONDITIONS
1.

The Guest hereby agrees and covenants with the Host as follows :-

a.

To pay the Host upon the execution of this Agreement the sum (hereinafter referred to as

' he said Deposit") hereto (the receipt of which the Host hereby acknowledges) as and by
way of deposit or security (if any) for the due performance and observance by the Guest of
all and singular the several covenants on the part of the "Guest herein contained.

b.

The Deposit (if any) shall not be deemed to be payment of the rent in advance nor shall it be
treated or used by the Guest as payment for the rent due under this Agreement without prior
consent of the Landlord and shall be retained by the Landlord until the expiration of the term
hereby created but the said Deposit or any part thereof may be applied in or towards
payment of fees charges outstanding or for making good any breach of this Agreement on
the part of the Guest BUT SUBJECT as aforesaid shall be refunded within fourteen (14)
days to the Guest upon the expiration of the term hereby created.

c.

To keep the said Premises clean and to be responsible for the locking and securing of the
windows doors and gates of the said Premises.

d.

Not to fell any trees, plants or shrubs and to maintain the gardens and pleasure grounds, if
any in good order and ornamental condition and to use them only as such.

f.

To use the surrounding land and environment in a proper manner and to keep clear at all

times the driveway and entrance to the said Premises and all passageways leading thereto.

g.

Not to make or permit to be made any alteration or addition or partition to the said Premises
or to the Hosfs fixtures, fittings and decorations therein without having first obtained the
written consent of the Host therefore and upon the determination of the term hereby
created, if so requested by the Host, to restore the said Premises to its original state and
condition at the expense of the Guest.

h.

Not to do or permit to be done on the said Premises anything which will or may infringe any
of the by-laws, laws or regulations in force or which in the opinion of the Host may constitute
nuisance or annoyance or inconvenience to the Host or to the Guest or occupiers of the

adjacent or neighbouring buildings or properties.


i.

Not to store or bring upon the said Premises any articles of a specially combustible
inflammable explosive or dangerous in nature and to do or suffer anything to be done by
reason whereof whereby the present or any future policy or policies of insurance on the said
Premises against damage by fire may become void or voidable or whereby the premiums

thereon may be increased and to make good all damage suffered by the Host and to repay
to the Host on demand all sums paid by them by way of increased premium and all
expenses incurred by the Host in or about any renewal of such policy or policies rendered
necessary by a breach or non-observance of this covenant without prejudice to the other

rights of the Host.


k.

To keep the said Premises, the flooring and interior plaster or other surface material or
rendering on walls and ceilings and the Host's fixtures thereon including doors, windows,

glass shutters, lock fastenings, electric wires, installations and fittings for the light and power
and other fixtures and additions therein in good and tenantable repair and clean
condition and to replace or repair any part of the said Premises and the Host's fixtures
and fittings therein which shall be broken or damage due to malicious, negligent or
careless acts or omission of the Guest his assistants, agents, invitees or otherwise and
further that if any damage is caused to the Host or to any person whomsoever directly
or indirectly through the said damaged condition of any part of the interior of the said

Premises (including floorings, walls, ceilings, doors, windows and other Host's fixtures) the
Guest shall be wholly responsible therefore and shall fully indemnify the Host against all
claims, demands, actions and legal proceedings whatsoeve_r made upon the Host by any
person in respect thereof.

I.

To permit the Host and the Host's assistance, agents and workmen and with all necessary
equipment and appliances at all reasonable time after prior notice to the Guest to enter
upon the said Premises and to view the condition thereof and to do such works and things
as may be required for any repairs, alterations or to any other part or parts of the said

building and forthwith to repair and amend in a proper and workman like manner any defect
for which the Guest is liable and of which a notice shall be given to the Host.
m.

To use the said Premises only for the stated period only (1 month)

n.

Forthwith to notify the Host of any notices served by any competent authority and with all
due speed to comply with the terms of the said notice as are effective and to keep the
Landlord indemnified from and against all actions, costs, claims, demands and liability in
respect thereof.

o.

Not to assign, underlet or part with the actual or legal possession or the use of the said
Premises for any term whatsoever without the previous consent of the Host first obtained.

p.

Not without the previous consent of the Host to affix, paint or otherwise exhibit on the
exterior of the said Premises or the windows thereof or any part thereof or any name plate,
signboard, placard, poster or advertisement of any flagstaff or other thing whatsoever or use

the outer wall of the said Premises for the purpose of any public announcement or to exhibit
anywhere outside the said Premises any indication of business or otherwise except upon
the consent of the Host.

q.

Not to install or caused to be installed in the said Premises any heavy equipment or
electrical appliances consuming high voltage without the prior written consent of the Host
first had and obtained.

r.

During the last seven (7) days of the tenancy to permit the Host to affix upon the said
Premises a notice for re-letting and to permit persons with authority from the Host at at
reasonable times to view the said Premises.

s.

At the expiration or sooner determination of this tenancy to deliver up to the Host the said
Premises in such state of repair condition order and preservation as shall be in strict
compliance with the Guest's stipulations herein contained and with all locks and keys and

fastenings complete.
t.

At the expiration or sooner determination of the terms hereby created peaceably and quietly
to yield remove therefrom all partitions additions and any ot11er structures and fittings
installed by the Guest with the consent of the Host and all damage caused by such removal
shall be made good and service the air conditional by the Host to the reasonable
satisfaction of the Host PROVIDED that if the Host or the incoming guest has no objection
to the same, the Guest need not remove any such partitions additions and other structures

and fittings.

At the Guest's own expenses and responsibility and at all times during the term hereby
created to comply with all such requirements as may be imposed on the Host by any
ordinance or Act of Parliament now or hereafter in force and any orders, rules, regulations,
requirements and notices there under.

2.

The Host hereby covenants with the Guest as follows :-

a.

To pay the said rate (RM4000) in respect of the said Premises.

b.

At all times throughout the tenancy to insure and keep insured the said Premises but
excluding the Guest's fixtures fittings and chattels from loss or damage by fire and to pay all
premiums necessary for that purpose.

3.

Provide always and it is hereby expressly agreed as follows:-

a.

Should the Guest determine the tenancy hereby created at any time before the expiration of
the terms hereby created, the said Deposit (if any) hereto shall then be absolutely forfeited
by the Host WITHOUT PREJUDICE to any right of action the Host may have against the
Guest in respect of unpaid rent or any antecedent breach of the stipulation herein contained.

b.

Any notice or other document or writing required to be served delivered or given hereunder

shall be sufficiently served if left addressed to the Guest on the Said Premises or sent to the
Guest by registered post addressed to the Guest's last known address in Malaysia and any
notice document or writing to the Host shall be sufficiently served if sent by registered post
to the Host's last known address.

The Schedule shall be taken, read and construed as part of this Agreement.
Time wherever mention shall be the essence of the Agreement.

This Agreement shall be binding upon the successor-in-title and assigns personal
representatives and heirs of the Host and the Guest.

4.

IT IS NEREBY EXPRESSLY AGREED BY THE PARTIES HERETO THAT THE "SPECIAL


CONDITIONS" annexed hereto (if any) SHALL FORM PART OF THIS AGREEMENT and that should
there an inconsistent or repugnant term or terms, the term or terms contained and inserted in the
"SPECIAL CONDITIONS" herein referred shall prevail over the same contained in Clauses 1 to 3 of
the General Conditions.
