Brief facts leading to the appeal:


The appellant sought information under RTI dated 19.02.2015 ( A1) addressed to CVC
(central Vigilance Commission) consisting of 3 points pertaining to,inter alia,NIACL CVO letters
to CVC in respect of the applicant . The CVO NIACL was transferred RTI vide CVC letter
09/3/2015 by ,CPIO.
CVO NIACL did not respond, however CPIO,NIACL ,vide reference No. CPI CELL/HO
/2015507 (shortened for brevity) vaguely demanded Rs. 2 or 4 for supplying a tiny fraction of
information .
The shocked applicant had to run from pillar to post for depositing vague amount.
Vide e-mail dated 11 April 2015 the applicant informed chairman of PSU about insensitive
CPIO who goes beyond the RTI act to inflict delay and denial tactics.
That order No.25/2015 was issued to allow escape of accountability. One Renjeet Gangadharan
presumed on his own whims that e-mail 11th April 2015 of applicant to chairman ,PSU is an RTI
appeal. He suo motu issued order dated 10 June 2015 ; actually dispatched on 28.08.15 thus a
deliberate back- dated order appears to be issued.
Prayer or Relief sought: 1. The information be disclosed ;delay tactics be viewed seriously.
2. That obstruction to information be put under scanner under Section 20 (10) of the Act.
Compensation Sought: The appellant prays for compensation as per Sec 19(8)* of the RTI
his right to information is suppressed by altering the grammar and spirit of RTI act
Grounds for the Prayer or Relief:
It is settled :Disclosure of information is a norm;,denial an exception in terms of RTI act(P.T.O.)
;spirit of transparency requires that CVO letters of a PSU be disclosed to the concerned
citizens,even without invoking RTI. No public servant is empowered to issue back dated orders

applicant.

Re; Consistent Abuse of public money- resources of NIACL
That I am an honest citizen of India who writes consistent RTI's since 2007.That by way of RTI
19.2.2015(annexure 4) Information consisting of 3 points was sought.The NIACL CPIO replied by letter
dated 31.03.2015,(annexure 1) dispatched on 6/4/15,he denied all information on one pretext or the
other,however he vaguely demands either Rs. 2 or 4 in respect of one information he is ready to
disclose.
This act of a Public Sector Undertaking's RTI officials is in sharp contrast to privileges historically
enjoyed by NIACL RTI officials,as per RTI reply dated 09.07.2013 under CPI CELL/HO/2013-14/75
(annexure 2)addressed to Shri Gopal Soni's RTI dt. 31.-5.2013 the expenses incurred by one of the RTI
official of NIACL in respect of Bill for Delhi Tour on 20.05.2013 are as under:Air Fare Rs. 20929.00 Halting Rs. 1200.00 Conveyance Rs. 581.00
You are requested to take cognizance of the matter and direct the RTI officials of NIACL to be sensitive
to RTI applicants,though I have deposited the amount of Rs.4 to your Jaipur regional office (annexure
3)dated 10.4.2015.I also request you to interfere in person in keeping with ethics in public life and
request for your directions to appellate authority of NIACL to ensure sincere disclosure of all
information.

A culture of impunity is created when people in power break the law, escape social or legal
punishment, and then continue breaking the law.
Impunity allows the powerful to get away with it to break existing laws but also to exploit legal
loopholes...
During 2010-2013 those in the Public Sector Undertaking (PSU) New India Assurance company head
office Mumbai deliberately misread the notice(s) of the Central Information Commission (with copy to
appellants ,e.g. the complainant) to attend video conference.
The complainant witnessed systematic loss of public money of approx. Rs. 10000/- to 25000/- per
person to claim habitual ,uncalled for Delhi tour to embezzle public money ..
